HomeMy WebLinkAboutRES 11111-H - TxDot Disadvantaged BusinessRESOLUTION NO. 1 1 I 1 I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ("CITY") ADOPTING THE TEXAS DEPARTMENT OF TRANSPORTATION'S (' TxDOT") FEDERALLY - APPROVED DISADVANTAGED BUSINESS ENTERPRISE PROGRAM AND AUTHORIZING A MEMORANDUM OF UNDERSTANDING WITH TxDOT RELATED THERETO; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, from time to time, the City receives federal funds from the Federal Highway Administration ("FHWA") through TxDOT to assist the City with the construction and design of projects partially or wholly funded through FHWA; and WHEREAS, the City, as a sub -recipient of federal funds, is required by 49 CFR 26, to implement a program for Disadvantaged Business Enterprises ('DBEs"), as defined by 49 CFR 26 ("DBE Program"); and WHEREAS, TxDOT has implemented a DBE Program that is approved by the FHWA pursuant to 49 CFR 26; and WHEREAS, certain aspects of the City's procurement of construction and design services are subject to review and/or concurrence by TxDOT as a condition of receiving federal funds from FHWA through TxDOT; and WHEREAS, the City and TxDOT undertake substantially similar roadway construction projects and design projects and construct and designtheir respective projects using substantially the same pool of contractors; and WHEREAS, the City desires to implement a federally compliant DBE Program by adopting the TxDOT-approved program, as recommended by FHWA; and WHEREAS, TxDOT and the City find it appropriate to enter into a Memorandum of Understanding to memorialize the obligations, expectations and rights each has as relates to the City's adoption of the TxDOT DBE Program to meet the federal requirements. Resolution No. i l i 1 Authorizing MOU with TxDOT re Adoption of TxDOT DBE Program Page 1 of 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SEC 1'HON 1. the facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council further finds that the adoption of this resolution is not inconsistent or in conflict with any 2030 Comprehensive Plan Policies. SECTION 2. The City Council of the City of Georgetown finds it to be in the best interest of the citizens of Georgetown to adopt TxDOT's federally -approved DBE Program as its DBE Program and hereby authorizes the Multiple Use Agreement attached hereto as Exhibit "A" and made a part hereof and the City has no objection thereto. SECTION 3. I he Mayor is herby authorized to sign this Resolution and the subject MOU, and the City Secretary is authorized to attest thereto, on behalf of the City of Georgetown. this resolution shall be effective immediately upon adoption.
