Legislative Regular Agenda
AZ. Public hearing and possible action on a request for a Subdivision Variance to waive the
requirements of Unified Development Code Section 12.02.030 regarding the requirement of a 6-foot
sidewalk along the road frontage of all major thoroughfares, and Section 12.05.030 regarding the
requirements for interparcel connectivity, for the property generally located southwest of the
intersection of RM 2243 and CR 176, bearing the legal description of 27.263 acres out of the Key West

Irrigation Company Survey, Abstract No. 711, to be known as 5 Star RV and Boat Storage (2020-2-

Staff report presented by Wesley Wright. The applicant is requesting a variance from Section 12.02.030
of the Unified Development Code which includes table 12.02.030 which requires a 6-foot sidewalk be
installed along major collectors and larger classification streets. CR176 is a major collector and FM2243
is a major arterial. Also, the applicant is requesting a variance from Section 12.05.030. which reads as
follows: "All new commercial Site Development Plans and Stormwater Permits that require off-street
parking and driveways shall provide driveway connections to the adjacent properties parallel to any
street fronting the development, whether such property is developed or undeveloped. Access
Easements shall be provided where necessary to achieve such a connection."
Commissioner McCord asked about the sidewalk requirements and Munk explained that the code does
not require sidewalk on the undeveloped parts, only what is developed now.
Chair Brashear asked if a site plan was approved for this process. Munk explained there is currently a
Storm Water Permit application in process. Chair Brashear also asked if the existing buildings required
a Site Development Plan and why the cross -access issue was not brought up at that time. Munk
explained that they required a Storm Water Permit before the existing buildings were built. He also
explained that the previous owner developed under the old code which had different requirements.
Commissioner McMichael asked is the right-of-way issue is a real issue for the applicant as referenced
in the applicant's letter. Wright explained that the applicant is working with the County on the cross
section for Leander Road. The City will try to put the sidewalk as close to the property as possible or
provide the applicant the option of a fiscal financial guarantee that would cover cost of sidewalk in the
future when the road is built. The City's risk with this option is that if the cost increases in the future,
the City would have to make up the difference.
Amy Payne, the applicant, addressed the Commission. She explained that when she purchased this, a
sidewalk was not a requirement at that time. She further explained the project and working with the
County to fulfill the requirements.
Chair Brashear opened and closed the Public Hearing as no one signed up to speak.
Motion to deny Item AZ (2020-2-WAV) by Commissioner Warren. Second by Commissioner
McCord. Denied (4-3) ,vdtll Commissioner McMichael, McCord, and Heintzmarin opposed.
BA. Public Hearing and possible action on a request for a Zoning Map Amendment to zone, upon
annexation, approximately 22.27 acres out of the Barney C. Low Survey, Abstract No. 385, to the Local
Commercial (C-1) district (4.18-acres), the High Density Multi -Family (MU-2) district (12.82 acres), and
the Low Density Multi -Family (MF-1) district (5.27-acres), for the property generally located at 1100 &
1200 Westinghouse Road (2020-4-ANX) -- Ethan Harwell, Senior Planner

Staff report presented by Harwell. The applicant is seeking to incorporate the subject property into the
city limits and entitle it for development for multi -family and commercial uses. Consequently, the
applicant is requesting the properties to be zoned Local Commercial (C-1), High Density Multi -Family
(1\4F-2) and Low Density Multi -Family (1\417-1). See Exhibit 5 for the applicant's letter of intent. A one -
acre tract, currently identified as being within the city limits and zoned AG, is included as a part of this
request. This one -acre tract was annexed as part of a larger area in a planned annexation by the City.
The boundary of this one -acre tract was not made clear in 2011, so it is included in this request for
annexation and initial zoning to clarify it status.
Chair Brashear asked about ratios and percentages, and how many acres of land were included in the
calculation. Harwell explained that this is approximately 700 acres.
Commissioner McMichael asked if the percentage recommended has to be exact. Harwell explained it
is currently 25.77% residential, 68.7% nonresidential, with 5.5% unentitled. This request puts us at
28.391/o, which is 3% over the target goal for residential. There is one property that is 11.2 acres, which
is 1.6% of the total Future Land Use area.
Chair Brashear opened and closed the Public Hearing as no one signed up to speak.
Motion to recommend to the City Council approval of Item BA (2020-4-ANX) by Commissioner
Warren. Second by Alternate Commissioner Salyer. Approved (7-0).
BB. Public Hearing and possible action on a request for a Zoning Map Amendment to rezone an
approximately 0.34-acre tract of land out of the C. Stubblefield Survey, Abstract No. 558, from the
Office (OF) district to the Residential Single -Family (RS) district, for the property generally located
at 609 W 15th St (2020-6-REZ) -- Andreina Davila -Quintero, AICP, Current Planning Manager
Staff report presented by Davila -Quintero. The applicant has submitted a request to change the
zoning designation of the subject property from Office (OF) to Residential Single -Family (RS) in
order to redevelop the property with residential uses. The subject property was previously
developed as a single-family residential home (circa 1964). Based on property records, it appears
