Chair Brashear opened the Public Hearing.
Tohn Byers; public speaker; is opposed to this request. He owns adjacent property and is
concerned that the street configuration shown in the proposed subdivision plat layout does not
conform to the existing access easement location he has used for many years to gain access to
his property.
Harwell explained that the UDC requires the developer to provide public access to all adjacent
properties. This will be a single phased project and that they will work with all parties to
ensure continued access to all adjacent properties, including recorded easements, if necessary.

Motion to disapprove Item AA (2020-35-FP) based on staff recommendations by
Commissioner McCord. Second by Commissioner McMichael. Disapproved (7-0).

AW. Public hearing and possible action on a request for a Subdivision Variance to waive the
requirements of Unified Development Code Section 12.03.030 regarding the requirement of a 5-foot
sidewalk along the road frontage of neighborhood streets, for the property generally located at 1701 CR
147, bearing the legal description of 5.5 acres out of the Burrell Eaves Survey, Abstract No. 216, to be
known as Ranger Ready Mix 147 Plant (2020-5-WAV) -- David Munk, PE, Utility Engineer
Staff report presented by Wright.
Commissioner McMichael asked why this was being presented to the Commission now. Munk
explained that the requirement to apply for a subdivision variance was discovered after the
building was constructed.
Commissioner Heintzmann asked if the County or City maintains the right-of-way. Chair
Brashear explained that the County does.

Commissioner McCord commented that she visited the location and it does not look like there
is anything suitable for residential. It is extremely dusty, heavy industrial area and she does not
see a reason to build a sidewalk.
Richard Mathias, the applicant's representative, gave a brief presentation to the Commission to
explain what is going on in the area. The owner was told that the only permits needed to build
this project was a water quality permit from TCEQ. They did not seek City approvals before
biiiidirig LIM11 IM-111LY. TIM $object prVper y is or, a narrow i—o-an-ty Road and dear an existing
limestone quarry. There is no pedestrian activity in the area.
Chair Brashear opened and closed the Public Hearing as no one signed up to speak.
Motion to deny Item AW (2020-5-WAV) as presented by Commissioner Warren.
Motion dies for lack of a second.
Commissioner Albright commented on his concerns and asked how this project received
permission to build without having to address the sidewalk issue. He understands enforcement
of the code but does not understand why a sidewalk needs to be built here.
There was discussion amongst Commission members regarding enforcement of the code, and
whether this is necessary if there is no benefit to having a sidewalk here.
Motion to approve the request as presented by staff by Commissioner Heintzmann. Second
by Commissioner McMichael. Motion to approve fails (3-4) with Commissioner Perthuis,
McCord, Warren and Brashear opposed.
AX. Public Hearing and possible action on a request for a Zoning Map Amendment to rezone Lots 1
& 2, Saavedra Subdivision (0.459 acres), from the Residential Single -Family (RS) zoning district to the

Staff report by Harwell. The applicant is seeking to redevelop the subject property, currently
developed with single-family homes, with a group of townhomes. The subject property is flat
and contains no significant natural- features. Several mature trees of unknown species and size
are located on the property, primarily around the boundaries of the current single-family lots.
Two single-family homes exist on the subject property. They have estimated construction dates
of 1900 and 1940, and are listed on the Historic Resources Survey as low -priority structures. The
subject property has Future Land Use designation of Mixed Density Neighborhood and is
currently zoned Residential Single -Family (RS).
There was discussion between Commission members and staff about existing land use and
future land use. Commissioner Warren asked why six units would be allowed where usually

one or two houses would be in single family land use. Chair Brashear also requested
clarification how this area can be transition zone from residential to non-residential.
Harwell explained that the map is a future land use map, and while it may not make sense
today, this is what it may be like in the future. If this block continues to develop, there would be
slightly higher density uses in the future.
The applicant, Gary Wong, addressed the Commission and made a presentation to explain the
project request. He presented the conceptual plans for this project and explained the thought
process behind the designs.
Chair Brashear opened the Public Hearing.
Phil Brown commented that he is opposed to this request. This will cause an increase in traffic
and create problems. It is not appropriate within the existing neighborhood.
Alton Trubee is also opposed. The owner has not contacted Trubee to discuss plans.
Jenel Looney is also opposed.
Chair Brashear closed the Public Hearing.
Motion to recommend denial of Item AX (2020-7-REZ) by Commissioner Heintzmann.
Second by Commissioner Warren. Denied (5-1) with Commissioner Perthuis abstained.
Commissioner Perthuis returned to the dais at 8:32p.m.
AY. Discussion and possible direction on the annual review and list of General Amendments to the
Unified Development Code for 2020 -- Sofia Nelson, CNU-A, Planning Director
The purpose of this item is to gather the Commission's feedback on the proposed General
Amendments List to present to City Council. The General Amendments List will be presented
to City Council for consideration at their July 14, 2020 Regular Meeting.
In accordance with Section 3.05.020 of the Unified Development Code (UDC), the UDC shall be
reviewed on an annual basis. The purpose of the review and amendments process is to establish
and maintain sound, stable, and desirable development within the City's jurisdiction, correct
errors in the text, or due to changing conditions in the UDC. The list of amendments to be
reviewed on an annual basis shall be reviewed and approved by the City Council ("General
Amendments List"), after review and consideration by the Planning and Zoning
Commission. Every year City Staff revise a list of items in the UDC that need to be replaced or
updated due to difficulties with the language or outdated provisions.
