HomeMy WebLinkAboutRES 102720-E - Abandon Temp Electric EsmtRESOLUTION NO. 10 2-7 n - E RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS RELEASING AND ABANDONING PORTIONS OF THAT CERTAIN EASEMENT, GRANTED TO THE CITY OF GEORGETOWN BY THE INSTRUMENT RECORDED AS DOCUMENT NO. 2016113818 IN THE OFFICIAL PUBLIC RECORDS OF WILLIAMSON COUNTY, ACROSS LOTS 7 & 10, BLOCK R, WOLF RANCH PHASE 3, SECTION 1 TO MHI PARTNERSHIP, LTD. WHEREAS, the City of Georgetown (the "City") has received an application from MHI Partnership, Ltd. (the "Owners") for the release and abandonment of portions of the above mentioned easement across Lots 7 & 10, Block R, Wolf Ranch Phase 3, Section 1, recorded as Document No. 2020028220 of the Official Public Records of Williamson County, Texas, which are currently Owner's property (the "Easement"); and WHEREAS, said Easement was acquired for the purpose of extending a temporary electric line to replace one which was abandoned at the request of Grantor's predecessor in 2016 to allow for continued services to existing customers during the development of their property, which is now a part of Wolf Ranch Phase 3, Section l; and, WHEREAS, the temporary electrical line has since been removed and replaced by other infrastructure in easements and rights of way through the City's development process; and, WHEREAS, upon considering the request for release and abandonment of the Property, and additional information pertaining to the request, the City Council now finds that a public need for the Easement no longer exists and it may, therefore, be abandoned. WHEREAS, nothing herein shall operate to release any other easement, nor any portion of the Easement not herein described. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that the adoption of this resolution is not inconsistent or in conflict with any of the City's 2030 Comprehensive Plan policies. The Mayor is hereby authorized to execute a Quitclaim Deed in substantially the same form attached hereto as document(s) necessary to complete the release described herein, and the City Secretary is hereby City of Georgetown. Exhibit "A" and any other conveyance and abandonment of the utility easement authorized to attest thereto on behalf of the SECTION 3. This resolution shall be effective immediately upon adoption.
