December 15, 1986
The meeting was called to order at 7:00 PM in the Chamber of
Commerce Meeting Room. The following Technical Committee members
in attendance: Bob Schwager, Barbara Pearce, Paul Williams, Ercel
Brashear, Dan Shanahan.
Also in attendance were: Frank Smith, Don Bizzell, and Jimmy
Coffman.
The Technical Committee recommends the following changes to the
proposed Subdivision Ordinance:
SECTION
13000 Add a paragraph that reads, "These regulations are designed and
intended to achieve..... shall be administered so as to" "Encourage
the development of a stable, prospering economic environment."
17000 In the first sentence, delete the phrase "no lot may be sold".
The revised text should read, "No subdivision plat may be recorded
until a final plat...."
17000-G To the phrase, "and no excavation or clearing of land .... unless in
conformity with these regulations.", add a statement to read, "or
commence, within six months preceding the date of application for
any item outlined above, unless in conformity with these regula-
tions and/or as required in the platting process."
23010 In paragraph 2, after the sentence, "shall be required when....
...sold for development", add the following: "If the proposed
land uses on the proposed concept plat are inconsistent with the
comprehensive plan as adopted by the City, the concept plan shall
not be accepted for review or processing by the City." Add, "If
the proposed land uses on the concept plat are inconsistent with
the City's Zoning Ordinance Map, the concept plan shall not be
accepted for review and processing by the City."
23040 In the last paragraph, after the phrase "conditional approval or
disapproval of the plan", add the following phrase: "within five
working days of the commission meeting."
In the next sentence to the phrase "noon of the third day", insert
the word "working" to read, "noon of the third working day".
In the last sentence, insert commas to read "appear on the next
agenda, approved by the director, after repayment of fees".
23040-B Add the word, "proposed", so to read: "a proposed phasing plan".
23040-C Recommend that the staff define "attendant documents".
23060 To the statement, "within 40 days of their first hearing of the
plan", change to read, "within 40 days of submittal of theplan".
To the phrase, "Council shall, within 60 days of the Commission's
action", change to read, "Council shall, within 60 days of the
submittal of the plan".
To the end of the first paragraph, add a statement that reads, "If
the plan is resubmitted to the Commission for consideration of
Council's recommendation, then the subsequent action of the Com-
mission shall be final."
In the last paragraph to the section that reads, "at such time as
the development lags one year behind the approved phasing plan",
amend that to read, "the concept plan approval shall expire if,
upon notice from the City the developer does not submit, in wri-
ting, a request for the extension and continuance of the concept
plan as approved by the City. Such request shall be supplied
within 30 days of date of notification by the City. Approval of
any such extension request shall be automatic."
24010 Behind the phrase, "except as otherwise provided for herein", add
the statement that says, "If the proposed land uses as shown on
the construction plat are inconsistent with the comprehensive plan
as adopted by the City, the construction plat shall not be accep-
ted for review or action by the City." Also add the statement,
"If land uses on the proposed construction plat are inconsistent
with the City's Adopted Zoning Ordinance Map, the construction
plat shall not be accepted for review and processing by the
City."
24031-E Strike the phrase, "and other data required". The phrase will now
read, "slope catagories to demonstrate compliance with...."
24033-F Behind the phrase, 11200 feet of the subdivision boundaries", add
the sentence, "All such information required shall be supplied by
the City."
24034-F Delete the entire paragraph.
24034-I Delete the entire paragraph.
24035-B Delete the original paragraph and substitute the following:
"Methods of calculating proposed utility demand data shall be
submitted for review by the City engineer."
24035-E To the phrase, "a letter of certification...." add the following,
"as applicable," so that the phrase reads, "a letter of certifica-
tion, as applicable, that the plat...."
24040 In the second paragraph, to the phrase "shall be submitted at
least 50 days prior to...." change to 1140 days".
Last paragraph, to the statement, "to the director, who shall
within 30 days after submittal...." change the wording to read,
"who shall within 20 days after submittal." Also change the sen-
tence to read, "met the minimum submittal requirements". Delete
the word "and" and insert the phrase, "the director shall prepare
a report analyzing...." To the phrase "dissaproval of the plat"
insert the following: "dissapproval of the plat, within 30 days
of the submittal deadline."
24040-E Change the phrase, "Section 50080" to "Section 60070".
24060 In the first sentence delete the phrase, "after holding a public
hearing" and change to read, "the commission shall, within 40 days
of submittal, hold a public hearing in accordance with City
codes." After the phrase "commission by-laws,...." add the word
"and" to read "the commission by-laws, and shall...."
To the phrase "the City Council, within 30 days of Commission's
action," amend to read, "City Council, within 60 days of plat
submittal, shall either confirm...."
To the phrase 1112 months after the approval by the council, except
that if the subdivider shall apply", change that to read, "except
that, if upon notification by the City, the developer shall fail
to submit, in writing, a request for an extension, then the plat
shall expire 12 months...."

Since the following are referred to as ordinances pertaining to
the implementation of the subdivision ordinance, it is recommended
each is included as exhibits to the subdivision ordinance. These
ordinance references:
