December 30, 1986
The meeting was called to order at 7:00 PM in the conference room
of Twin Creek Properties. The following Technical Committee mem-
bers were in attendance: Bob Schrawger, Ercel Brashear, and Dan
Shanahan.
Also in attendance were: Frank Smith and Jimmy Coffman.
The Technical Committee recommends the following changes to the
proposed Subdivision Ordinance:
SECTION
24033-C/ After the phrase, "City's extraterritorial jurisdiction", add the
26033-E phrase "as depicted on the City's most recent base map."
26010 Behind the phrase "the final plat shall conform to the approved
construction plans and plat.", add a sentence that reads, "If the
proposed land uses as shown on the final plat are inconsistent
with the comprehensive plan as adopted by the City, the final plat
shall not be accepted for review or action by the City." Also add
the statement, "If land uses on the proposed final plat are incon-
sistent with the City's Adopted Zoning Ordinance Map, the final
plat shall not be accepted for review and processing by the City."
26033-F2 Change the words "large water courses" to "major waterways".
26035-A Change the wording after "water pollution abatement plan approved
by the..." to "water pollution abatement plan submitted to the..."
26035-D Delete the paragraph entirely.
26040 In the first paragraph after subparagraph G, change the phrase
"construction plat" to "final plat" at its first occurance in the
sentence. The revised sentence shall read, "If in the judgment of
the director, the final plat submittal.... or the conditions of
construction plat approval,". Then in the same paragraph, the
last sentence, change that to read "The final plat may be placed
on the next agenda, approved by the director."
26050 Add subparagraph D to read, "Payment of any subsequent user fees
as specified in Section 41070-H."
Add subparagraph E to read, "Copies of any agreements required
providing for the proper and continuous operation, maintenance,
and supervision of any facilities that are of common use or bene-
fit which cannot be satisfactorily maintained by an existing pub-
lic agency, as required in Section 41060."
We need to have added a paragraph setting forth the procedure for
the recording of the final plat. The context of the plat should
include a procedure for notification of the owner when the plat is
to be submitted to the county for review and approval of those
sites in the E.T.J.
27020 In the last paragraph, delete the sentence that begins "The com-
mission and/or council.... public approval of a detailed develop-
ment plan."
27040-A4 The section reading "Direction of proposed drainage provided,..."
revise the sentence to read, "Indication of proposed modifications
to existing site drainage and directions of proposed drainage in-
dicating compliance with the approved final plat."
27040- Revise to read "Lot dimensions; square footage, and percent of
All impervious coverage by proposed improvements."
A14 Delete the paragraph entirely.
B4 Revise to read, "the property address and existing land use."
B7 Revise to read, "all applicable restrictions; the location and
dimensions of boundary lines, easements, required yard with set
backs....".
27040- Revise to read, "storm water drainage and detention information
B15 sufficient to demonstrate compliance with the watershed provisions
in Section 32000."
27050-B Revise to read, "The commission may reserve detail development
plan review and approval authority as set forth in Section 27020
for unplatted land."
27050-F Delete the paragraph entirely.
27060-B Change the approval time from six months to one year.
To the second paragraph, revise that to read "A detail development
plan approval subject to lapse may be renewed if, upon notice from
the City of the pending expiration of the detail development plan,
the developer does not submit, in writing, a request for the ex-
tension and continuance of the detail development plan as approved
by the City. Such requests shall be supplied within thirty days
of date of notification by the City. Approval of any such exten-
sion request shall be automatic."
Delete the statement, "not more than two renewals shall be ap-
proved for any detail development plan."
27060-C To the phrase, "a detail development plan approval shall be sus-
pended upon notification...", change the word "shall" to "may".
To the sentence, "the commission shall hold a public hearing...",
revise to read, "the commission may hold a public hearing within
forty days if either party is not satisfied that the action trig-
gering the notification, or steps required to correct such action,
have not been taken."
To the paragraph "Following the denial of detail development plan
....one year from the date of denial of revocation.", delete the
paragraph entirely.
28000 All actions imposed upon the City Council should be changed to
read, "actions of the City."
28020 The last sentence in the paragraph, delete the sentence entirely.
28040 Note that none of the forms specified as Appendix A, B, or C, are
attached to the ordinance.
Add a provision that states, "If the project is located in the
E.T.J., and is subject to the bonding requirements of the county
for the construction of the roadways, then that amount of money
shall be reduced from the amount required to be posted with the
City."
28040A3C Change the wording "Section 808" to read "Section 28080".
28070-D Change the first sentence to read "the Director of Public Works or
his appointees" shall inspect all required improvements, "includ-
ing all required fences,". In the same paragraph, to the phrase,
"required improvements nor release or reduce a performance bond",
delete the phrase "or reduce"
In the same paragraph, to the sentence "Upon all required improve-
ments having been satisfactorily completed,", change the balance
of the sentence to read, "the Director of Public Works, or his ap-
pointee, shall either accept, in writing, the improvements as hav-
ing been satisfactorily completed, or shall issue a punch list to
the developer denoting items remaining to be completed. The Dir-
ector of Public Works shall issue his report within five working
days of the date of notification by the developer that the im-
provements have been completed. The Director of Public Works
shall have five working days to complete his inspection upon no-
tification by the developer."
Revise to read, "Any and all other provisions identified in the
platting process have been satisfied.
28080 To the phrase, "as determined by the City Engineer.", change that
to read, "as'determined by the Director of Public Works or his
appointees."
28080-B Revise to read, "The City shall not release a surety instrument
unless and until all the conditions of Section 28070 are met."
Delete Items 1-5.
28100 To the phrase "as allowed in Section 28030 of these regulations",
change that to read "Section 28040".
The next meeting of the Technical Committee will be held at 7:00
PM on January 8th. The meeting place is the conference room at
SCB Development Co. Notification of all the Technical Committee
Members will occur prior to that meeting.

Re: Ordinance Draft Activity
Dear Ercel,
Subsequent to our lengthy discussions during the last evening
subject session, I am compelled to call the following facts to
the attention of our subcommittee:
1) Technical specifications are quite basic to the document that
we are drafting.
2) Watershed and drainage ordinances are also basic to our efforts
to assist in providing the City with a workable draft.
3) Obviously, we are required to recommend the draft without
the benefit of said Technical Specifications and ordinances.
4) I suggest that when we find text based on one of the above
omissions or inadequacies, we add appropriate symbols to the
right margin (TS, W, D).
5) An explanation in the Ordinance Footnotes should
clearly explain this procedure.
6) Another Footnote should void requirements in the text which
are not clearly based on valid specification or ordinance.
