A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS
AUTHORIZING THE MAYOR TO SIGN THE AMENDED ADVANCE FUNDING AGREEMENT
WITH THE TEXAS DEPARTMENT OF TRANSPORTATION RELATED TO THE
RECONSTRUCTION OF LEANDER ROAD FROM SW BYPASS TO NORWOOD DRIVE.
WHEREAS, the Texas Transportation Commission passed Minute Order Number 115291 authorizing the
State to undertake and complete a highway improvement generally described as Reconstruct two-lane
roadway to four -lane divided roadway with traffic signal and pedestrian improvements (Project), and
WHEREAS, for the Project the term reconstruct includes constructing a 4-lane divided facility from SW
Bypass to Norwood Drive with traffic signal and pedestrian improvements; and
WHEREAS, as part of the administration of the Project, the Capital Area Metropolitan Planning
Organization, awarded the City of Georgetown a total of $3,600,000 in Surface Transportation Program
Metropolitan Mobility (STP-MM) for the Project, but subsequently withdrew the award to focus on IH-
35 improvements; and
WHEREAS, the City of Georgetown previously entered into an Advanced Funding Agreement with the
Texas Department of Transportation related to the reconstruction of Leander Road from SW Bypass to
Norwood Drive pursuant to Resolution 06119-H;
WHEREAS, it has become necessary to amend that contract because the Capitol Area Metropolitan
Planning Organization (CAMPO) on June 8, 2020 voted to defer this project funding and redistribute
Category 2 grant funds to pay for the IH-35 Capital Express Project.
WHEREAS, the Governing Body of the Local Government has approved to continue this project with
local funding, the Advanced Funding Agreement needs to be amended to reflect the revised budget,
which shows the contract amount is increased by $1,467,879, from $8,881,566 to $10,349,445, because
Local Government is providing 100% funding.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS:
SECTION ONE. The facts and recitations contained in the preamble of this resolution are hereby found
and declared to be true and correct, and are incorporated by reference herein and expressly made a
part hereof, as if copied verbatim.
SECTION TWO. The City Council of the City of Georgetown finds it to be in the best interest of the citizens
of Georgetown to enter in the Amended Advance Funding Agreement with the Texas Department of
Transportation related to the Reconstruction of Leander Road from SW Bypass to Norwood Drive.
SECTION THREE. The Mayor is hereby authorized to sign this Resolution and the Advance Funding
Agreement and the City Secretary to attest thereto, on behalf of the City.

ADVANCE FUNDING AGREEMENT
AMENDMENT #1
THIS AMENDMENT is made by and between the State of Texas, acting through the Texas
Department of Transportation, called the State, and City of Georgetown, acting by and through its
duly authorized officials, called the Local Government.
WITNESSETH
WHEREAS, the State and the Local Government executed a contract on July 7, 2019 to effectuate
their agreement to undertake and complete a highway improvement generally described as
reconstruction of two-lane roadway to four -lane divided roadway with traffic signal and pedestrian
improvements; and,
WHEREAS, it has become necessary to amend that contract because the Capitol Area Metropolitan
Planning Organization (CAMPO) on June 8, 2020 voted to defer this project funding and redistribute
Category 2 grant funds to pay for the IH-35 Capital Express Project.
WHEREAS, the Governing Body of the Local Government has approved to continue this project with
local funding, and entering into this Amendment by resolution dated {Enter Date of Resolution}, which
is attached to and made a part of this Agreement as Attachment A-1 for the Project.
NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements
of the parties, the State and the Local Government do agree as follows:
AGREEMENT
1. Description of Amended Items
a. Attachment A, Resolution or Ordinance, is supplemented by adding Attachment A-1,
Resolution or Ordinance, which is attached and made a part of this amendment.
b. Attachment C, Project Budget, is deleted in its entirety and replaced by Attachment C-1,
Project Budget, which is attached to and made part of the amendment. The budget is
revised, and the contract amount is increased by $1,467,879, from $8,881,566 to
$10,349,445, because Local Government is providing 100% funding.
2. Signatory Warranty
Each signatory warrants that the signatory has necessary authority to execute this agreement on
behalf of the entity represented.
