HomeMy WebLinkAboutRES 082421-J - Parks at Westhaven SAPRESOLUTION NO. 0?29 ZI -5 A RESOLUTION OF THE CITY OF GEORGETOWN, TEXAS, APPROVING THE 2021 ANNUAL SERVICE PLAN UPDATE AND UPDATE TO THE ASSESSMENT ROLL FOR THE PARKS AT WESTHAVEN PUBLIC IMPROVEMENT DISTRICT, IN ACCORDANCE WITH CHAPTER 372 OF THE TEXAS LOCAL GOVERNMENT CODE. WHEREAS, the City Council of the City of Georgetown ("City Council") adopted Resolution No. 012621-M creating the Parks at Westhaven Public Improvement District (the "District") on January 26, 2021 after notice and hearing in accordance with the requirements of the Texas Local Government Code Chapter 372 (the "PID Act"). WHEREAS, subsequently, the City Council adopted Ordinance No. 2021-17 ("Assessment Ordinance") on March 23, 2021 which, among other things, approved the Service and Assessment Plan ("SAP"), the levy of Assessments for Assessed Property within the District, and the Assessment Roll. WHEREAS, pursuant to the PID Act, the SAP and Assessment Roll must be reviewed and updated annually. WHEREAS, in addition, Section 8(a) of the Assessment Ordinance and Sections V.B. and V.D. of the SAP deferred collection of the Annual Installments for a Parcel until the Trigger Date, which is defined in Section 1 of the Original SAP as follows: "Trigger Date" means, for each Parcel, the earlier of. (1) the date a final plat is filed and recorded in the real property records of the County which creates the Parcel, or (2) the date PID Bonds secured by Assessments levied on the Parcel are issued. If the Trigger Date occurs on or before July 31 It of the then current year, then Assessments will be due the January 31It of the following year. If the Trigger Date occurs after July 31IS of the then current year, then the Assessments will be due on the second January 31s1 following the Trigger Date. Collection of the Annual Installments will in no case occur later than the two-year anniversary date of the levy of Assessments on the Parcel (emphasis added). WHEREAS, on May 17, 2021, a final plat for Parks at Westhaven Phase 1 ("Phase 1 Plat") was filed and recorded -in the Official Public Records of Williamson County, Texas as Document No. 2021073328, and said Phase 1 Plat covers approximately 24.694 acres out of the total 88.866 acres of land within the District and includes 100 residential Lots (95 of which are "Lot Type 2" and 5 of which are "Lot Type 3") and 4 Non-Benefitted Lots. WHEREAS, recordation of the Phase 1 Plat is the "Trigger Date" for each Parcel included in the Phase 1 Plat; accordingly, the Parks at Westhaven Public Improvement District 2021 Annual Service Plan Update (which includes an updated Assessment Roll) attached to this Resolution as Exhibit A provides that the 100 residential Lots included in the Phase 1 Plat will begin paying Resolution No. OUL12 I _7 Page 1 of 3 Parks at Westhaven — 2021 SAP and Assessment Roll Update Assessments due on January 31, 2022 but the Parcels not included in the Phase 1 Plat have not yet reached their Trigger Date and only Annual Collection Costs will be collected with the Annual Installments for those Parcels. WHEREAS, the City Council has reviewed and desires to approve the 2021 Annual Service and Assessment Plan Update attached to this Resolution as Exhibit A, which updates the SAP per the PID Act, states the Annual Installment amount (principal and interest) and the Annual Collection Costs due on January 1, 2022, updates the Five Year Budget Forecast, and updates the Assessment Roll for 2021. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: Section 1. Effect of Recitals. The foregoing recitals are found to be true and correct and are incorporated into this Resolution by this reference for all purposes. Section 2. Approval of 2021 Annual Service Plan Update (including the updated Assessment Roll). The Parks at Westhaven Public Improvement District 2021 Annual Service Plan Update attached to this Resolution as Exhibit A, including the updated Assessment Roll contained therein, is hereby accepted and approved by the City Council. Section 3. Defined Terms. Capitalized terms not otherwise defined in this Resolution shall have the meanings set forth in the SAP attached to the Assessment Ordinance, and/or the 2021 Annual Service Plan Update attached to this Resolution, and/or the Assessment Ordinance. Section 4. Severability. If any provision, section, subsection, sentence , clause or phrase of this resolution, or the application of same to any person or set of circumstances is for any reason held to be unconstitutional, void or invalid, the validity of the remaining portions of this resolution or the application to other persons or sets of circumstances shall not be affect thereby, it being the intent ofthe City Council that no portion hereof; or provision or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality, voidness or invalidity of any other portion here, and all provisions of this resolution are declared to be severable for that purpose. Section 5. Effective Date and Responsibility for Implementation. This Resolution shall take effect immediately from and after its final date of passage, and it is accordingly so ordered. The City Council directs and authorizes the Administrator to take all actions necessary to give effect to this Resolution. The District was created pursuant to the Act by Resolution No. 012621-M on January 26, 2021 by the City Council to finance certain Authorized Improvements for the benefit of the property in the District. On March 23, 2021, the City Council approved the Original SAP for the District by adopting an Ordinance No. 2021-17 which approved the levy of Assessments for Assessed Property within the District and approved the Assessment Roll. The SAP identified the Authorized Improvements to be provided by the District, the costs of the Authorized Improvements, the indebtedness to be incurred for the Authorized Improvements, and the manner of assessing the property in the District for the costs of the Authorized Improvements. Pursuant to the Act, the SAP must be reviewed and updated annually. This document is the 2021 Annual Service Plan Update. This 2021 Annual Service Plan Update also updates the Assessment Roll for 2021. PARCEL SUBDIVISION ■ The Parks at Westhaven Phase 1 Plat was filed and recorded within the Williamson County Official Public Records on May 17, 2021. The Parks at Westhaven Phase 1 Plat consists of 100 residential Lots and 4 Non -Benefited Lots. The Parks at Westhaven Phase 1 Plat is attached as Exhibit B. TRIGGER DATE With the recordation of the Parks at Westhaven Phase 1 Plat, 100 residential Lots have reached their Trigger Date and will begin paying Assessments due on January 31, 2022. 95 of these Lots are classified as Lot Type 2 ("Lot Type 2 (2021)") and 5 of these Lots are classified as Lot Type 3 ("Lot Type 3 (2021)"). See Exhibit C for Homebuyer Disclosures for Lot Type 2 (2021) and Lot Type 3 (2021). PARKS AT WESTHAVEN PID 2021 ANNUAL SERVICE PLAN UPDATE 1 The Parcels contained with the approximately 88.866 acres of land, consisting of all property within the District SAVE AND EXCEPT all property within the Parks at Westhaven Phase 1 Plat (the "Remainder Parcel") have not yet reached their Trigger Date. As a result, only Annual Collection Costs will be collected with the Annual Installment for these Parcels. LOT AND HOME SALES Per the Developer, all 100 Phase 1 residential lots are sold to DR Horton. All planned Phase 2 and 3 residential lots are currently under contract with DR Horton. See Exhibit C for Homebuyer Disclosures. OUTSTANDING ASSESSMENT The District has an outstanding Assessment of $7,725,000.00. ANNUAL INSTALLMENT DUE 1/31/2022 ■ Principal and Interest — The total principal and interest required for the Annual Installment is $127,018.10. • Annual Collection Costs — The cost of administering the PID and collecting the Annual Installments shall be paid for on a pro rata basis by each Parcel based on the amount of outstanding Special Assessment remaining on the Parcel. The total Administrative Expenses budgeted for the Annual Installment is $35,000.00. The Parcels or Lots shown on the Assessment Roll will receive the bills for the 2021 Annual Installments which will be delinquent if not paid by January 31, 2022. PARKS AT WESTHAVEN PID 2021 ANNUAL SERVICE PLAN UPDATE 4 EXHIBIT A — ASSESSMENT ROLL Note: For billing purposes only, until a plat has been recorded within the Remainder Parcel, the Annual Installment will be billed to each Tax Parcel within the Remainder Parcel based on the acreage of the Tax Parcel as calculated by the Williamson Central Appraisal District. As the Parks at Westhaven Phase 1 Plat was recorded on May 17, 2021, individual Property IDs associated with that plat will not be billed on an individual basis until the next tax year. Therefore, the Annual Installment Due 1131122 will all be billed to the Initial Parcel based on the acreage of the Tax Parcel as calculated by the Williamson Central Appraisal District.
