HomeMy WebLinkAboutRES 101221-AB - Higgs Road ANXRESOLUTION NO. 10 1 ?_ZI A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, GRANTING A REQUEST FOR THE ANNEXATION OF APPROXIMATELY 3.038 ACRES OF RIGHT-OF- WAY SITUATED IN JOSEPH MOTT SURVEY, ABSTRACT NO.21 AND KNOWN AS HIGGS ROAD; DIRECTING INITIATION OF ANNEXATION PROCEEDINGS; DIRECTING PUBLICATION OF NOTICE FOR PROPOSED ANNEXATION; AND DIRECTING CITY STAFF TO PREPARE A SERVICE PLAN FOR THE AREA TO BE ANNEXED. WHEREAS, Williamson County, as the political subdivision that maintains the hereinafter described right-of-way, desires for the City of Georgetown ("City"), pursuant to Section 43.1055 of the Local Government Code, to annex said area of land into the City of Georgetown, to -wit: 3.038-acre tract of land situated in Joseph Mott Survey, Abstract No.21, more particularly shown on the map in Exhibit "A" and described by metes and bounds in Exhibit 'B," which are attached hereto and incorporated herein by reference as if set forth in full (the "Higgs Road Right -of -Way"); WHEREAS, the annexation of right -of --way under Section 43.1055 triggers the non - consent annexation procedures of Subchapter C-1 of the Local Government Code, including the requirement of two public hearings before a municipality may institute annexation proceedings, the requirement that the annexation must be completed within 90 days after the date the proceedings are instituted, and the requirement that City Staff prepare a service plan for the area to be annexed before annexation; WHEREAS, the area to be annexed must be 1,000 feet in width at its narrowest point unless the annexation is initiated upon the written petition of the owner(s) of the area to be annexed; and WHEREAS, the owner(s) of the area to be annexed have submitted a written petition to the City for the annexation of the Higgs Road Right -of --Way; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: SECTION 1: The City Council of the City of Georgetown hereby grants the Resolution No. Page 1 of 3 Higgs Road Annexation Exhibits A, B written petition of the owner(s) of the Higgs Road Right -of -Way; SECTION 2: City Staff is directed to prepare a service plan for the area to be annexed in accordance with Section 43.056 of the Local Government Code, and said service plan shall be available for public inspection at the public hearings held under Section 43.063 of the same; SECTION 3: The City Secretary is directed to commence the publication of notices of two public hearings before the City Council on the subject of the proposed annexation of said area into the city limits; and further, to place upon the City Council Agendas the consideration of the passage of an ordinance annexing said area into the city limits in accordance with State Law; the tentative schedule for said hearings and ordinance consideration shall be as follows: Resolution Granting Petition for Annexation: First Public Hearing: Second Public Hearing: Approval of the Service Plan: Annexation Ordinance (First Reading): Annexation Ordinance (Second Reading): October 12, 2021 (today) November 9, 2021 November 23, 2021 December 14, 2021 December 14, 2021 January 11, 2022 SECTION 5: The Mayor is hereby authorized to execute, and the City Secretary to attest this Resolution.
