An Ordinance of the City Council of the City of Georgetown, Texas,
amending part of the Official Zoning Map to rezone 12.785 acres in the Isaac
Donagan Survey, Abstract No.178, generally located at 3301 W SH 29, from
the Agriculture (AG) zoning district to the Planned Unit Development
(PUD) zoning district with a base zoning of Low Density Multi -Family (MF-
1); repealing conflicting ordinances and resolutions; including a severability
clause; and establishing an effective date.
Whereas, an application has been made to the City for the purpose of amending the
Official Zoning Map, adopted on the 121hday of June, 2012, for the specific Zoning District
classification of the following described real property ("The Property"):
12.785 acres in the Isaac Donagan Survey, Abstract No. 178, generally located at 3301
W SH 29, as described in Exhibit B, hereinafter referred to as "The Property'; and
Whereas, public notice of such hearing was accomplished in accordance with State Law
and the City's Unified Development Code through newspaper publication, signs posted on the
Property, and mailed notice to nearby property owners; and
Whereas, the Planning and Zoning Commission, at a meeting on January 18, 2022, held
the required public hearing and submitted a recommendation of approval to the City Council
for the requested rezoning of the Property; and
Whereas, the City Council, at a meeting on January 25, 2022, held an additional public
hearing prior to taking action on the requested rezoning of the Property.
Now, therefore, be it ordained by the City Council of the City of Georgetown, Texas,
that:
Section 1. The facts and recitations contained in the preamble of this Ordinance are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this
Ordinance implements the vision, goals, and policies of the Georgetown 2030 Comprehensive
Plan and further finds that the enactment of this Ordinance is not inconsistent or in conflict with
any other policies or provisions of the 2030 Comprehensive Plan and the City's Unified
Development Code.
Section 2. The Official Zoning Map, as well as the Zoning District classification for the
Property is hereby amended from the Agriculture (AG) zoning district to the Planned Unit
Development (PUD) zoning district with a base zoning of Low Density Multi -Family (MF-1), in
accordance with the attached Exhibit A (Location Map), Exhibit B (Legal Description), and
Exhibit C (PUD Development Plan) and incorporated herein by reference.

Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.
Section 4. If any provision of this Ordinance or application thereof to any person or
circumstance shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this Ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this Ordinance are hereby declared to be
severable.
Section 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary
to attest. This ordinance shall become effective in accordance with the provisions of state law
and the City Charter of the City of Georgetown.

Being all that certain tract or parcel of land situated in the Isaac Donogon Survey, Abstract No. 178, Williamson County,
Texas, being out of that certain coiled 0.76 acre tract of land described as Tract 1 in the deed to Horace Norvell, recorded
in Document No. 2007030380, Official Public Records. Williamson County, Texas, being a port of the abandoned Old Liberty to
Georgetown Road and being more particularly described by metes and bounds and follows:
BEGINNING at a calculated point at the southwest corner of said 0.76 acre tract, some being the northwest corner of the
Abandoned Old Liberty Hill to Georgetown Road, and being in the east right-of-woy line of a 36.5' right-of-way dedication
per Davis Subdivision, a subdivision of record in Document No. 2017068122 of the Official Public Records of Williamson
County, Texas, from which a 1/2-inch iron rod found in the south line of said Old Liberty to Georgetown Road some being
the north line of that certain called 103.9327 acre tract of land described in the deed to Elbert L. Brown and wife, Beverly
D. Brown by deed of record in Volume 2189, Page 585, Deed Records of Williamson County, Texas, bears S22'23'43"E o
distance of 46.24 feet;
THENCE N22'23'43"W, along the west line of the 0.76 acre tract, some being the east line of Davis Subdivision, a distance of
301.00 feet to a 1/2-inch iron rod found at the northwest corner of the 0.76 acre tract, some being the northeast corner
of the Davis Subdivision, and being in the south right-of-way line of State Highway No. 29 (R.O.W. varies), from which a
1/2-inch iron rod found with plastic cop stomped "RPLS 5784" at the curve return of the west right-of-way line of said
36.5' right-of-way said Davis Subdivision tract, and being the northeast corner of Lot 1, Block B, Davis Subdivision, bears
S81'58'19"W a distance of 62.65 feet;
THENCE along a curve to the left, with the south right-of-woy line of State Highway No. 29, some being the north line of
the 0.76 acre tract, having a radius of 5779.65 feet, on arc length of 87.30 feet, a delta angle of 00'51'56", and a chord
which bears N81'09'59"E a distance of 87.30 feet to a calculated point; from which a 1/2-inch iron rod found at the
northeast corner of the 0.76 acre tract bears N81'49'20"E a distance of 18.20 feet;
THENCE crossing through the 0.76 acre tract the following Four (4) courses and distances:
1. Along a non-tangentiol curve to the left, having a radius of 25.00 feet, an arc length of 41.15 feet, a delta angle of
94'18'47", and a chord which bears S33'38'27"W a distance of 36.66 feet to a calculated point;
2. S13'30'57"E a distance of 22.47 feet to a point of curvature;
3. Along a tangential curve to the left, having a radius of 333.00 feet, on arc length of 51.61 feet, a delta angle of
08'52'46", and a chord which bears 51757'20"E a distance of 51.56 feet to a point of tongency;
4. S22'23'43"E a distance of 186.82 feet to a calculated point in the south line of the 0.76 acre tract, some being the
north line of the Abandoned Old Liberty Hill to Georgetown Rood;
THENCE S68'03'33"W, along the south line of the 0.76 acre tract, some being the north line of the Abandoned Old Liberty Hill
to Georgetown Road o distance of 47.00 feet to the POINT OF BEGINNING and containing 0.33 acres of land.

Riverpointe - PUD
A. Purpose and Intent
1. The Riverpointe PUD is composed of approximately 12.785 acres within the community of
The Heights at San Gabriel. The development of this property is planned as a single-family
residential community with detached single family units with garages accessed from a rear
alley.
B. Applicability and Base Zoning
1. All aspects regarding the development of this PUD shall comply with the City of Georgetown
Unified Development Code (UDC), except as established in this exhibit, titled Exhibit A.
2. For the purpose of establishing development standards for the PUD, the following base zoning
districts have been selected from the UDC.

1. A Conceptual Site Layout has been attached to this PUD, Exhibit C, to illustrate the design
intent for the property. The Conceptual Site Layout is intended to serve as a guide to illustrate
the general community vision and design concept and is not intended to serve as a final
document.
D. Allowable / Prohibited Uses
1. The allowable uses shall be multi family, detached dwelling units, per the UDC. The nature
of these dwellings is further defined as single family detached homes.
2. The maximum number of dwelling units permitted in the PUD is 65 units.

F. Landscapiniffencing-
1. The following landscape requirements shall fully satisfy any landscape planting
requirements for the neighborhood, with the exception of tree mitigation requirements.
2. Each housing unit shall have a minimum of five (5), five (5) gallon shrubs and three (3), 3
gallon shrubs as a foundation planting.
3. Each housing unit shall have an individually fenced in back yard area enclosed with either
decorative metal or wood fencing. Fencing shall be six (6) feet in height.
4. A residential boundary wall shall be provided along Whisper Creek Drive as required by
UDC section 8.07.060.
5. Each neighborhood entry shall incorporate a minimum of 500 square feet of landscape bed
area.
Street trees are required as indicated below:
i. One (1) three (Y) caliper inch street tree shall be planted at a spacing not to exceed
thirty (30') feet along the private drives, unless necessary to avoid utility conflicts, fire
hydrants or street light poles (see Exhibit D for street sections).
ii. Street trees shall be planted per Exhibit D in a location specified as part of the Site
Development Plan. Street trees shall also comply with all requirements of UDC section
12.06.G.
iii. Street trees shall be an allowable source of tree mitigation, if all provisions of UDC
section 12.06.G are satisfied.
iv. The street tree species selected for each private drive shall be identified on the Site
Development Plan.
V. Street trees shall be planted in unison to ensure consistent tree size and growth. Street
trees shall be maintained by the HOA. All Street tree installation shall be inspected by
the City Landscape Planner prior to filling in. This note shall be required on all
landscape sheets, details, and any other referenced location addressing street trees.
G. Parkland / Amenities
1. This PUD boundary is part of a larger community called the Heights at San Gabriel. Within
the Heights at San Gabriel, a private park with playground, swimming pool, restroom
building, trails and improved open space is being developed. Riverpointe will also have a
pocket park located within the PUD boundary. The pocket park would consist of a
playground and picnic tables.
2. Residents within the boundary of the Riverpointe PUD shall be allowed full access to the
Heights at San Gabriel community private park. Section 13.08 Parkland will be satisfied by
the private park in the Heights at San Gabriel.

3. Per the Georgetown Park Board action, 50% credit will be provided towards the overall land
dedication and park development improvement requirements for the Heights at San Gabriel,
including the Riverpointe PUD. The remaining 50% land dedication and park improvement
fee will be satisfied by paying $650 per unit for land dedication and $1,000 per unit for park
development improvement.
4. The common amenity requirements of UDC section 6.06 do not apply.
H. Architectural Requirements
1. The following architectural criteria shall apply to the PUD and shall satisfy any
requirements for architectural treatment of the homes. Section 7.03 of the
Georgetown UDC shall not apply.
i. All Single family detached dwellings shall contain a minimum of 1,400
square feet of enclosed living space, exclusive of porches, decks, garages.
ii. All residential homes shall have a minimum roof pitch of 6:12, except porch
coverings or secondary roof features.
2. Each front elevation shall contain a minimum of two of the following elements, to be
identified on the architectural plans submitted for building permit:
i. A minimum of two wall planes on the front elevation, offset a minimum of 18
inches
ii. Covered front porch or patio with a minimum size of 35 square feet
iii. The addition of one or more dormers on the front elevation to complement the
architectural style of the home
3. Prototypical home representations are included as Exhibit E to this PUD to illustrate
the general architectural style planned for the community. The images are not to be
interpreted as the only elevations allowed within the community or a final product,
but merely to represent the general intent for the street scene and home style.
4. All units shall have garages accessed from an alley.
5. Additional architectural details shall be incorporated into the design of each home to
enhance the character and aesthetic of the neighborhood. Each elevation that faces or
backs onto a street or park space shall incorporate these design features. Each home
shall incorporate three (3) of the following design details:
i. Homes that incorporate a front porch or porch posts shall have posts that are
at least ten (10) inches in width or incorporate tapered column with pedestal
base.

ii. Window awnings, shutters and/or window trim that provides architectural
shadow relief and dimension to the window opening provided on front
elevations as well as any elevation that sides or backs onto an unloaded
collector/arterial or park open space.

I. Transportation
1. The Riverpointe PUD may include private drives. Private Drive and Alley cross sections are
defined on Exhibit D.
2. On drive parallel parking will not be allowed and head in or off drive parking areas will be
provided throughout the neighborhood for visitor parking. A minimum of 15% of the total
required spaces shall be provided for visitor parking.
3. Each unit shall have a minimum of 2 driveway parking spaces and 2 enclosed garage spaces.

1. With approval of a license agreement (per UDC 3.21), The Heights at San Gabriel may
incorporate a subdivision entry sign within the median of Whisper Creek Drive where it
intersects Highway 29. The sign face of the sign shall not exceed 40 square feet.
2. The sign face may be mounted to a vertical design element which may be a maximum of 20
feet in height. The sign may be oriented perpendicular to highway 29.
3. One sign face shall be allowed on each side of the vertical structure, if the structure is
perpendicular to the highway.
4. The City may allow the sign, associated landscaping and irrigation within the median and
public right of way via a license agreement.
5. See Exhibit F for conceptual rendering of sign concept and location. Renderings are
conceptual in nature and are intended to convey the general size, maximum height and
location. Final design, height, and location of the monument sign is subject to approval of a
license agreement. This license agreement must include clear zone and sight distance studies.
