This item was pulled from the consent agenda. Travis Baird presented the as a Preliminary Plat
and explained that the disapproval recommendation was based on the submittal missing some
criteria which the code specifically calls for. He also explained the "shot clock" and why there
must be reviews with the code and then action taken by the commission within 30 days of the
original submittal. Often, there is not enough time after the comments by staff are made on the
first submittal o allow the applicant to make corrections and then resubmit in time for the
posting of the next commission meeting. The submittal must still be placed on the agenda with
the recommendation of disapproval by staff, in order to meet the state requirements for review.
Chair Heintzmann opened the Public Hearing and closed it with not speakers coming forth.
Motion by Commissioner Dickey to disapprove this application for the reasons set forth.
Second by Commissioner Tiland. The motion was approved 4 - 0.
F. Consideration and possible action to approve application for Construction Plans, consisting of

This item was dulled for separate action by Commissioner Allen, who asked why this was the
third time this application was before the commission. Travis Baird explained that this was
another example of forced action by the shot clock, and where the applicant has still not been able

finalize the engineering for the Traffic Impact Analysis and the lift station, along with other
engineering items.
Chair Heintzmann opened the Public Hearing and closed it with not speakers coming forth.
Motion by Commissioner Dickey to disapprove this application for the reasons set forth.
Second by Commissioner Allen. The motion was approved 4 — 0.

Items H, U, AEA, and AC were pulled from the consent agenda by staff for separate action. Items
E, J and AJ were pulled by Commissioner Allen for separate action.
Motion to approve the Consent Agenda by Commissioner Dickey minus the noted items
which were pulled for separate action. Second by Commissioner Allen. Approved 4-0.
Note: Actions on pulled items were addressed individually at this point in the meeting but are
noted under each of the items above.
Legislative Regular Agenda
AT Public Hearing and Possible Action on a request for a zoning Map Amendment to zone, upon
annexation, a 38.24-acre tract out of the Isaac Donagan Survey Abstract No. 178 to Residential
Single-family (RS) zoning district for the property generally located at 3307 and 3311 State
Highway 29 (2Q22-1-ANX). Cesar Acosta Long Range Planner
Cesar Acosta presented the item, explaining that the applicant is proposing to develop 38 acres
into a residential subdivision. This would connect to the proposed properties that received
approval from the commission in March. This application partially complies with the
Comprehensive Plan criteria. This subdivision does not completely meet the residential density
for this area, however, does comply with all the other criteria.

Commissioner Allen asked about the trail system that is proposed. Acosta reported this would tie
into the Garey Park trail system along the San Gabriel river.
Chair Heintzmann opened the Public Hearing and closed it with no one coming forward.
Motion by Commissioner Dickey, second by Commissioner Allen to approve this item as
presented. Approved 4 - 0.
AUPublic Hearing and possible action on a request for a Zoning Map Amendment to rezone 27.14
acres in the John Berry Survey, Abstract 51 from the Agriculture (AG) zoning district to the
General Comrnercial (C-3) zoning district and 44.870 acres in the John Berry Survey, Abstract 51
from the Agriculture (AG) zoning district to the Low -Density Multi -Family (MF-1) zoning
district, for the property generally located at 350 State Highway 195 (2022-3-REZ). Ryan Clark,
Planner
Ryan Clark presented the staff report of the proposed development. This development would be
at the northwest corner of Hwy 195 and IH 35, with proposed C-3 zoning on the highway side
and multifamily zoning on the back and interior side. There is a large area of floodplain land on
the east and north side of the property, making that portion of the property un-developable for
anything except parkland or reserve. The city reports there is not any wastewater capacity
available to this, property, or the adjacent properties currently. Clark also reports that TxDOT has
a proposed realignment of the highways which will affect the entrances to this property. This
development is not fully compatible with the area developments and the multifamily use does
not fit with the non-residential commercial uses proposed in the area.
The applicant's :representative, Jordan Maddox of Halff Associates, also made a presentation. He
explained the flyover proposed by TxDot will limit the access to this property, so the C-3 zoning
is reasonable. And the developer is proposing a regional detention pond in the south portion of
the property which will limit the commercial area to approximately 16 acres for the commercial
portion and only approximately 5 acres for the residential multifamily area. The rest will be trails
and parkland. David Peak, the developer's engineer explained they are looking at installing a
wastewater interceptor along Dry Berry Creek in partnership with other landowners, which
would allow them all to have access to wastewater. Those negotiations are still in the works.
City staff stated they have not been involved in those discussions.
Chair Heintzmann opened the Public Hearing and closed it with no one coming forward.
Motion by Steve Dickey to approve, for discussion purposes. Second by Scott Allen.
Commissioners expressed concerns about the timing of this application and the lack of
infrastructure:to support it at this time.
Vote 2 - 2, with. Heintzmann and Tiland opposed. Tie vote.
Motion by Steve Dickey to table this application to the May 3rd regular meeting and for the
applicant to provide more specificity on the utilities and clarity of how the C-3 portion of the
development will work with the MF, providing buffer details and providing more information
on the density of the MF portion. Second by Tiland. Approved 4 - 0.

Chair Heintzmann opened the Public Hearing and closed it with no one coming forward.
Motion by Tiland, second by Dickey to approve the waiver because the granting of the
variance will not detrimental to the public health, safety or welfare or injurious to other
property in the area or to the City, that the granting of the variance would not substantially
conflict with the Comprehensive Plan, that the conditions that create the need for the variance
do not generally apply to other property in the vicinity and that the literal enforcement of
these regulations would result in unnecessary hardship for the applicant. Approved 4 - 0.
AW Discussion Items: Updates and Announcements (Sofia Nelson, Planning Director)
• Update from other Board and Commission meetings - Nelson explained the city council
will be reviewing the Commission bylaws at the next council meeting which would allow
alternate,; to serve in the absence of a regular commissioner, instead of only when quorum is
not met. Also being proposed to Council is an item which would address the shot clock,
allowing applicants to choose to work directly with staff on getting certain applications
through quicker, allowing comments to be addressed and corrected immediately instead of
waiting for specific submittal days and meeting postings. And minor plats would be
allowed to be approved administratively instead of having to go back through the
commission for minor changes.

• Reminder of the April 19, 2022, Planning and Zoning Commission meeting in Council
Chambers located at 510 W 9th St, starting at 6:00pm.
• Travis Baird introduced two new planners, Colleen Russell and Patrick Collins
• Sofia shared that Tadd Phillips, the current Human Resources Director will be serving as the
Interim Planning Director while she is on leave.
