AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS ADDING CHAPTER 2.120, TITLED "WATER
CAPITAL IMPROVEMENTS ADVISORY COMMITTEE" TO THE CODE OF
ORDINANCES OF THE CITY OF GEORGETOWN RELATING TO THE
ESTABLISHMENT OF A CAPITAL IMPROVEMENTS ADVISORY
COMMITTEE; REPEALING CONFLICTING ORDINANCES AND
RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, Section 395.058 of the Texas Local Government Code provides for the
appointment of a Capital Improvements Advisory Committee;
WHEREAS, pursuant to Section 2.14 of the City Charter, the City Council has the
power to establish boards, commissions and committees to assist in carrying out the duties
of the City Council and as otherwise required by State law;
WHEREAS, the City Council finds it necessary to add Chapter 2.120 of the Code of
Ordinances of the City of Georgetown in order to establish a Water Capital Improvements
Advisory Committee.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS THAT:
Section 1. The facts and recitations contained in the preamble of this ordinance are
hereby found and declared to be true and correct and are incorporated by reference herein
and expressly made a part hereof, as if copied verbatim.
Section 2. Chapter 2.120 is added to the Code of Ordinances as shown in Exhibit A
attached hereto.
Section 3. All ordinances or resolutions that are in conflict with the provisions of
this ordinance are, and the same are hereby, repealed and all other ordinances or
resolutions of the City not in conflict with the provisions of this ordinance shall remain in
full force and effect.
Section 4. If any provision of this ordinance, or application thereof, to any person
or circumstance, shall be held invalid, such invalidity shall not affect the other provisions,
or application thereof, of this ordinance which can be given effect without the invalid

provision or application, and to this end the provisions of this ordinance are hereby
declared to be severable.
Section 5. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This ordinance shall become effective and be in full force and effect in
accordance with the provisions of the City Charter of the City of Georgetown.
Section 6. The meeting at which this ordinance was approved was in all things
conducted in compliance with the Texas Open Meetings Act, Texas Government Code,
Chapter 551.

CHAPTER 2.120. — WATER CAPITAL
IMPROVEMENTS ADVISORY COMMITTEE
Sec. 2.120.010. Created; membership.
A. There is hereby created the "Water Capital Improvements Advisory Committee" of the City
(the "Committee"). This Chapter supplements the provisions of Code of Ordinances Chapter
2.36 City Commissions, Committees, and Boards.
B. The Committee shall consist of at least five members and shall generally consist of the
members of the Georgetown Water Utility Board. Notwithstanding the foregoing, not less
than forty percent of the membership of the Committee must be representatives of the real
estate, development, or building industries and if the impact is going to be applied to the
extraterritorial jurisdiction of the City, the membership must include a representative from that
area. If Georgetown Water Utility Board does not have enough representatives to meet the
above requirements, additional members shall be appointed in accordance with the Charter to
fulfill those requirements.
Sec. 2.120.020. Purpose; duties.
The Committee serves in an advisory capacity and is established to:
(1) Advise and assist the city council in adopting land use assumptions;
(2) Review the capital improvements plan and file written comments;
(3) Monitor and evaluate implementation of the capital improvements plan;
(4) File semiannual reports with respect to the progress of the capital improvements plan and
report to the city council any perceived inequities in implementing the plan or imposing the
impact fee; and
(5) Advise the city council of the need to update or revise the land use assumptions, capital
improvement plan, and impact fee.
Sec. 2.120.030. Meetings.
Notwithstanding Code of Ordinances Chapter 2.36 (City Commissions, Committees, and
Boards), the Committee shall be meet on at least a semi-annual basis and as needed to perform its
duties as provided in Section 2.120.020.
Sec. 2.120.040. Procedural Rules.
Code of Ordinance Chapters 2.24 and 2.36 are the procedural rules adopted by City Council
governing the Committee. No additional rules or bylaws are required.
