Questions were asked to determine what park improvements were in the greatest demand and to determine if there is support for a small sales tax increase to fund the park improvements. The following is a brief highlight of the findings of this survey. 1. What park improvements are in the greatest demand? The following graph shows what fraction of those who responded to the survey would vote for the tax increase (yes), against the tax increase (no), are undecided (uncertain) or gave no answer (NA). 30 20 WI1 you %de for fttaxi ncrease? no Yes uncertain NA VOTE As the above chart shows 63 percent of respondents indicated they would vote for a sales tax increase to fund park improvements, 33 percent indicated they would vote against and the remaining 4 percent were either uncertain or gave no response. Of the 1153 responses, 382 indicated that they planned to vote no, 724 indicated that they planned to vote yes, 27 were undecided and 20 did not answer the question. Public Hearin H Second Public Hearing regarding the annexation of approximately 80.3 acres in the Nicholas Porter and David Wright Surveys, located north of Williams Drive (RM2338) and south of Lakeway Drive/Clyde von Rosenberg and Ed Barry The Public Hearing was opened at 7:59 p.m. von Rosenberg noted that this was the second of the two required public hearings and explained the service plan. There were no comments from the Council. Mr. Ronald Parker stated that he either owned or controlled the majority of the 80 acres to be annexed and prefers not to be annexed. Wood noted that the first official reading and vote by the Council on this annexation ordinance would occur at the next Council Meeting on March 26. The hearing was closed at 8:03 p.m. Mayor, Council, City Manager, and staff comments and reports Curl told Council about the training workshop that she attended and told them she would provide copies of information she received regarding pending legislative issues. Wood told of having visited frequently with Senator Phil Gramm who assured that he would help to fund the MOKAN project in Central Texas. Citizens wishing to address the Council Former Councilmember Jane Voltz spoke to Council about considering a new sound system for the Council Chambers. She also asked Council to put a high piority on urban design issues and asked to be able to form a citizen committee regarding urban design. FF Consideration of authorizing the Mayor to execute an interlocal agreement with the Brazos River Authority (BRA) for Household Hazardous Waste Collection Day/Hartley Sappington Sappington told Council that this is an unusual gathering of entities working together to clean up waste in the area. Cities of Georgetown, Round Rock, Cedar Park, Williamson County, Brazos River Authority, Anderson Mill and Brushy Creek Municipal Utility Districts, and TNRCC will be participating. He explained that the City of Georgetown had budgeted $5,000 to contribute to the BRA for the implementation of this program, and that the bulk of the money would be coming from fines paid to TNRCC, plus an additional $75,000 in a grant from TNRCC and $50,000 from City Council Agenda/February 27, 1996 Page 4 of 5 Pages the various cities. Motion by Bain, second by Curl to approve the interlocal agreement. Approved 7-0. Wood announced that the next three items would be deferred to the March 12 Meeting. GG Consideration of authorizing the Mayor to execute a contract with CSW Communications, Inc. for the purchase and installation of an Interactive Utility Management System Fixed Wireless Network and SCADA System/Bob Hart This item was deferred to the March 12 Council Meeting. ITEM SUMMARY The Georgetown Municipal Code, under 4.28 Disposition of Excess Property, states that the City Council may declare any City property to be excess as recommended by the City Manager. The ordinance also states that the City Council shall determine the method of disposal of any excess property. These books were donated to the Georgetown Public Library, but are not needed for our collection due to age, subject matter, or duplication of books already owned. SPECIAL CONSIDERATIONS The Friends of the Georgetown Public Library is a nonprofit 501(c)(3) organization founded to "encourage greater use and support of the library and its services." One way the Friends supports the Library is through additional funding of equipment and programs for Library customers. The Friends hold an annual book sale to raise funds for its projects. The 300 books selected for transfer to the Friends include those with decorated bindings, older materials, special interest subjects, university student annuals and magazines. These materials are of primary interest to collectors. Florence, a Williamson County city, has a population of 930 people and a library that is operated mainly by volunteers. The Library is funded by the City and some state funds received through the Central Texas Library System. They welcome any donations and would benefit greatly from the books we do not need. We will donate any books that are left over from the Friend's book sale to the Florence Library. FINANCIAL IMPACT Undetermined additional -special programs, projects and equipment to be donated by the Friends of the Library. COMMENTS The recommendation of the staff (and the Library Advisory Board) is that the books be made available to another public Library and to the Friends of the Georgetown Public Library. It is standard practice among libraries to forward books to other libraries which can use the books and to allow associated nonprofit organizations to sell them as a fund raising activity. ITEM SUMMARY Bids were received to provide the City with computer and copier paper for a six-month period beginning March 1996. The staff recommendation is to award this bid to the low bidder for each line item, as designated on the attached bid tabulation. All paper on this bid is recycled with the exception of the colored paper for which there is not currently a recycled product available. Bids are solicited every six months for computer and copier paper at the request of the bidders. Price increases and decreases are passed down from the manufacturers frequently and bidding twice a year provides a chance for more bidders to bid firm prices for the contract period. Items on this bid are stocked in the City warehouse and are used by all City departments. SPECIAL CONSIDERATIONS none FINANCIAL IMPACT (cost of item, fund and division name, budgeted amt.) ITEM SUMMARY Steve Knebel, of Maxwell Locke & Ritter, P.C., Certified Public Accountants, will report on the independent audit of all accounts of the City as contained in the City's Comprehensive Annual Financial Report (CAFR) for the Fiscal Year Ended September 30, 1995. The Report to Management for the Year Ended September 30, 1995 and the results of the auditors' examination in compliance with the Single Audit Act will also be presented. All items from the prior year Report to Management have been resolved and there are no new comments noted. SPECIAL CONSIDERATIONS The auditors rendered a "clean" opinion on the City's financial statements. In other words, they were able during their audit to obtain reasonable assurance that the general purpose financial statements are free of material misstatements. No material weaknesses in internal control were noted. FINANCIAL IMPACT None. COMMENTS The CAFR will be submitted to the Government Finance Officers Association for consideration for the Certificate of Achievement for Excellence in Financial Reporting. The City of Georgetown has received this award for the last eight consecutive years. We believe our current report continues to conform to the program's requirements. Our consideration of the internal control structure would not necessarily disclose all matters in the internal control structure that might be material weaknesses under standards established by the American Institute of Certified Public Accountants. A material weakness is a condition in which the design or operation of the specific internal control structure elements does not reduce to a relatively low level the risk that errors or irregularities in amounts that would be material in relation to the general purpose financial statements being audited may occur and not be detected within a timely period by employees in the normal course of performing their assigned functions. We noted no matters involving the internal control structure and its operation that we consider to be material weaknesses as defined above. ITEM SUMMARY This action authorizes the Mayor to execute a contract with the County of Williamson whereby the City of Georgetown will provide rural fire protection services to the rural area immediately surrounding the City of Georgetown, or to any area within Williamson County when requested by another Fire Department. This agreement is for the 1996 calendar year and is renewed annually. SPECIAL CONSIDERATIONS Additional funding will need to be considered prior to approval of future service contracts, if current service levels are to be maintained. FINAN IAL IMPACT By executing the contract, the City of Georgetown will receive $58,881 from Williamson County for these services. An amount of $60,000 was budgeted as revenue within the adopted FY 95-96 General Fund Budget. Failure to approve the contract would result in $58,881 less revenue for the General Fund for 95-96. COMMENTS The small amount of County funding to provide rural fire protection will continue to be an issue of increasing concern as the fire district requires more service for a growing population. During the last calendar year, the Georgetown Fire Services responded to 370 calls for service in the County fire district. The total response for the department was 2,076 which means that 17 % of the total calls were outside the City. This represents an increase from previous years, and I believe the trend will continue. Currently the County provides $476,000 for rural fire protection that is divided among 16 fire departments. The way in which the money is divided is as follows: 1 .) 1 /3 of the money is divided equally among 16 fire departments. 2.) 1 /3 is based on the service area acreage. 3.) 1 /3 is based on the assessed value within each jurisdiction. Georgetown's revenue is less this year because Round Rock, Sam Bass Volunteer Fire Department, and Jollyville have a higher increase in assessed value due to recent growth, this increased the amount of County money they received and reduced the amount of money Georgetown and other departments received. Pursuant to its power to provide financial assistance for fire protection in and for Williamson County, and its duty to protect the public health and welfare, the County agrees to pay to the Department the sum of $ 58,881. , in two (2) payments, one on or before February 28 , 1996, and one on or before September 30 , 1996 , to defray the cost of equipment and labor required to provide the services described in Paragraph 2. 2. The Department agrees to provide fire protection services in any area in the County when requested by any other fire company, or when dispatched by the County, and shall expend all of the amount set forth in Paragraph 1 for only these purposes during the calendar year 1996. 3. It is understood by the City that the County cannot commit funds for any future fiscal year, and that this Agreement does not, and cannot, commit the County to renew or repeat this Agreement unless approved by future action of the Williamson County Commissioners' Court. 4. It is understood and agreed that the County as no power to control or supervise the manner and means chosen by the Department to carry out the services specified in Paragraph 2, and that the County shall have no liability for any intentional acts of the Department which are not related to the provision of said services. ITEM SUMMARY This ordinance will incorporate the annexations of Park Meadow West, First Baptist Church, Churchill Farms and surrounding area, a portion of Phase II of Sun City, and the proposed annexation of the Parker, Smith and Hogberg tracts. This ordinance proposes adding each respective tract into the adjacent City single -member district. Due to the limited 1990 census population included in each of the annexed tracts, no redrawing of existing district boundaries appears necessary at this time. Since none of these annexations are to be added to either of the districts that have the most significant minority population, the proposed plan will not dilute minority voting strength. In addition, since none of the additional tracts are being added to either the largest or smallest districts, the proposed plan will not increase the variance between district population sizes from the percentages that exist in the plan that is currently in place. The specific details on each district is included in your packet, as it was submitted to the Department of Justice for election pre -clearance. (This submission required to be filed at least 60 days prior to the election date.) If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. The City initiated this annexation in order to provide street improvements which can only be provided within the city limits, to improve traffic control in the northwest portion of the City. This property is a "donut hole" surrounded by the City limits. This property is mainly unimproved property that is currently used for agricultural purposes. There is currently 3 houses located on this property. The population at the time of the 1990 .census was 25 Non Hispanic White. The entire census block was not annexed exed and two additional houses are located outside the proposed annexed property. It was determined that the annexed property included three/fifths of the housing units in this census block, so three/fifths of the population which was all non -hispanic white in the 1990 census, has been included. This number was added to the total population for District 5 and included under the Non Hispanic White. This property will be added to the adjacent City single -member district, District 5. District 5 is not one of the City's . predominantly minority voting districts. This annexation is proposed to be completed on April 24, 1996 and we will send a copy of the annexation ordinance when adopted. I have talked with Steve Ortmannof Capital Metro. He indicated that their staff is preparing an interlocal agreement to convey the bus to the City. I am requesting the authority to execute the Agreement in order to expedite this process, with the understanding that the City will not expend more than $100 for the bus, and will not incur any liability or exposure greater than the simple acquisition of the bus. If you're not comfortable with this approach, an alternative would be to authorize staff to complete the negotiations and bring the agreement back to Council prior to execution.
