(Second Reading) ITEM SUMMARY This ordinance will incorporate the annexations/disannexation of the following properties into the adjacent voting districts. District 1 B & T Subdivision (6.950 acres) District 4 Georgetown Village Section 3-B (20.188 acres) Sun City Georgetown Phase 4-C, Neighborhood 24-C (37.934 acres) Sun City Georgetown Phase 4-D, Neighborhood 17-B (18.7463 acres) Fountainwood Estates, Phase 2-A t/b/k/a Fountainwood Plaza (18.62 acres) District 5 Embree Subdivision Disannexation (9.023 acres) Logan Ranch Section 1, Lot 63 t/b/k/a Logan Plateau (5.04 acres) Dedicated Investments, L.L.C. property along Northwest Blvd. (31.0964 acres District 7 Summercrest Subdivision (1.80 acres) This ordinance proposes adding each respective annexed tract to the adjacent City single - member district. No population was added by the annexations nor removed as a result of the disannexation. The proposed plan will not dilute minority voting strength. No population is being added to either the smallest or largest districts. Therefore, the variance between the two remains unchanged at 14.3%. NOTE: Due to the expense of producing the 24" x 36" maps for second reading, we have included smaller maps in the agenda packets. The full-scale map is on file with the City Secretary. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING THE CITY'S SINGLE -MEMBER DISTRICT PLAN TO INCLUDE ANNEXATIONS, AND A DISANNEXATION, WHICH HAVE BECOME EFFECTIVE SINCE THE MAY 6, 2000 GENERAL ELECTION; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, in Ordinance 91-30, the City Council adopted the City's current single - member district plan and amended that ordinance with Ordinance Nos. 95-11, 96-09, 97- 19, 98-13, 99-12 and 2000-11; WHEREAS, such plan was later approved by the United States Department of Justice to be used for selection of elected officials for the Mayoral and City Councilmember elections within the City of Georgetown; WHEREAS, the City has annexed additional property and disannexed a property adjacent to the City limits since the May 6, 2000 general election; WHEREAS, these annexations and disannexation require that the City amend its single -member district plan to incorporate the newly annexed properties into the City's single -member districts and to remove the disannexed property for election purposes; WHEREAS, each of the annexed tracts, as well as the disannexed tract, is immediately adjacent to an existing single -member district boundary line, necessitating that the boundary lines be redrawn; WHEREAS, the annexed tracts, as well as the disannexed tract, contained no voting population; WHEREAS, the approval of the U.S. Department of Justice is required to amend the City's single -member district plan, and such approval must be submitted well in advance of the City's election; WHEREAS, the City Council hereby determines that the addition of these annexed tracts to and the removal of the disannexed tract from the adjacent single -member districts and respective redrawing of district boundaries is in the best interest of the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby 2001 Revision to Single -Member District Plan, Ordinance No. Page 1 of 3 4L. finds that this ordinance implements Governmental Affairs Policy End 15.00 of the Century Plan - Policy Plan Element, which states: "A high level of cooperation and involvement exists among Georgetown's citizens and governmental organizations", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The following boundary revisions to the City's single -member district plan are hereby adopted: District 1 B & T Subdivision (6.950 acres). A portion of Census Tract 214.03, Block 303C, having no population, shall be added to District 1. District 4 Georgetown Village Section 3-B (20.188 acres). A portion of Census Tract 201.01, Block 201, having no population, shall be added to District 4. Sun City Georgetown Phase 4-C, Neighborhood 24-C (37.934 acres). A portion of Census Tract 201.01, Block 104, having no population shall be added to District 4. Sun City Georgetown Phase 4-D, Neighborhood 17-B (18.7463 acres). A portion of Census Tract 201.01, Block 104, having no population is being added to District 4. Fountainwood Estates, Phase 2-A t/b/k/a Fountainwood Plaza (18.62 acres). A portion of Census Tract 201.04 Block 131 D, having no population shall be added to District 4. District 5 Embree Subdivision Disannexation (9.023 acres). A portion of Census Tract 201.01, Block 107, having no population, shall be removed from District 5. Logan Ranch Section 1, Lot 63 t/b/k/a Logan Plateau (5.04 acres). A portion of Census Tract 201.01, Block 219, having no population, shall be added to District 5. Dedicated Investments, L.L.C. property along Northwest Blvd. (31.0964 acres). A portion of Census Tract 201.02, Block 302B, having no population, shall be added to District 5. District 7 Summercrest Subdivision (1.80 acres). A portion of Census Tract 214.01, Block 301 D, having no population, shall be added to District 7. SECTION 3. The map attached as Exhibit A is hereby adopted as the official single -member district boundary map, reflecting the changes in Census blocks specified in Section 2. The chart attached as Exhibit B identifies the population distributions for each district. 2001 Revision to Single -Member District Plan, Ordinance No. Page 2 of 3 0- SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown, or on the effective date of the annexation ordinance, whichever date is later.
