POINT OF BEGINNING at the northwesterly property line corner of the J. C. Labenski

COUNTY OF WILLIAMSON.
W11Eli.I:AS, the City of Georgetown, T xas, passed and adopted on the
day of December, 1962 an ordinance providing for water and sewer line extension,
and further providing that the said City of Georgetown may enter to contracts with
subdividers for refunds on improvements of water and sewer line made by them, and,
WHEREAS, Russell Parker and Irene W. Parker have at their expense installed
certain water and sewer mains in the Gabriel Heights Subdivision in the Northwest
portion of the City of Georgetown, Texas, and
W1EItEAS, the cost of installation of said wpter and sewer mains in Gabriel
Heights Subdivision to the City of Georgetown, T xas, was $20,572.80, and water
and sewer main consisting of 4 and 6 inch pipe and 6 and 8 inch pipe all according
to the map of plat thereof, showing the number of feet of pipe, and the size of the
pipe and area of installation, including the area served to each customer, which
plat is attached hereto and made a part hereof, and,
WHEREAS, the Russell Parker and Irene W. Parker have presented'to the City
Manager of Georgetown, Texas, in accordance with section 1, sub paragraph 5 of said
ordinance, the necessary information and figures regarding the installation of said
mains, and it is necessary and desired that the said city and said developers
enter into a contract for a refund to the developer for the cost of installation
of water and sewer mains in accordance with the terms of said ordinance.
NOW THEREFORE, in consideration of the premises and of the installation of
said water and sewer main by Russell Parker and wife Irene W. Parker in Gabriel
Heights Subdivision to the City of Georgetown, Texas, as shown on the map in detail
attached hereto „ which said installation was completed and accepted by the City of
Georgetown, on August 1, 1965, the City of Georgetown, acting by and through its
duly authorized officers and officials agrees as follows: that the city of Georgetown,
Texas, will refund and pay to the said Russell Parker and Irene W. Parker on August
1, 1966, and on the first day of August of each year thereafter for a period of
7 years, forty (40) percent of the revenue received from`the water and sewer connec-
tions in said Gabriel Heights Subdivision, unless and except that if 90 percent of
the original cost of said improvements is refunded prior to the end of said period
of seven (7) years no further refunds will be made.
Said City of Georgetown further agrees to furnish to said Parker's an itemized
account of the receipts from each water and sewer connection or customer for the
preceeding 12 month period, at the time of payment of said refund.
IN WITNESS whereof, the said Russell Parker, Irene W. Parker and duly authoriz-
ed officials of the City of Georgetown, Texas, have affixed their signatures to
duplicate copies hereof on this the 1st day of August, 1966.
