AResolution ofthe City Council of the City of Georgetown, Texas
Increasing the Number of Commissioners on the Board of the
Georgetown Housing Authority from Five to Seven; Including a
Severability Clause; Repealing Conflicting Ordinances and
Resolutions; and Providing an Effective Date.
WHEREAS, the Georgetown Housing Authority was created pursuant to Chapter
392 of the Texas Local Government Code; and
WHEREAS, Section 392.031 of the Texas Local Government Code provides that,
"The presiding officer of the governing body of a municipality shall appoint five, seven,
nine or 11 persons to serve as commissioners of the authority," and
WEERFAS, Section392.0331 of the Texas Local Government Code provides that if
the board of commissioners of a housing authority consists of five members, at least one
commissioner must be a tenant of a public housing project over which the authority has
jurisdiction; and that if the board consists of seven or more members, at least tvo
commissioners must be tenants; and
WHEREAS, Section 392.034 of the Texas Local Government Code provides that for
an authority with seven commissioners, three shaLbe desi;nated to serve one-year terms
and four shall be des' mated to serve two year terms; and
WHEREAS, the City Council hereby finds that it is in the public interest to increase
the number of commissioners on the board of the Georgetown Housing Authority from
five to seven, and to have two of the seven members be residents of a housing project over
which the Authority has jurisdiction, as required by state law,
NOW, THEREFORE, BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, THAT:
SECTION 1, The facts and recitations contained in the preamble of this resolution are
hereby found and declared to be true and correct.

SECTION 2, The number of commissioners that shall constitute the board of
commissioners of the Georgetown Housing authority shall beseven (7), The qualifications,
terms of office, and composition of the board of commissioners for the Georgetown
Housing Authority shall be consistent with all applicable federal ands state laws,
SECTION 3: All Ordinances and Resolutions, or parts of Ordinances and Resolutions that
are in conflict with this Resolution are hereby repealed, and no longer in effect,
SECTION 4: If any provisions of this Resolution or application thereof to any person or
circumstance shall be held invalid, such invalidity shall not affect the other provisions, or
applications thereof, of this Resolution which can be given effect without the invalid
provision or application and to this end the provisions of this Resolution are hereby
declared to be severable.
SECTION 5: The Mayor of Georgetown is hereby authorized to sign this Ordnance and
the City Secretary to attest, Tvs Orcinance shall become effective on the date of its
approval by the City Council,
