AmendmentsRESOLUTION NO. 0 ` 2-5Z 5 -5- ' f A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, PURSUANT TO THE CODE OF ORDINANCES OF GEORGETOWN, TEXAS, RECOMMENDING INITIATION OF AN EXECUTIVE AMENDMENT OF CHAPTERS 2, 3, AND 12 OF THE GEORGETOWN UNIFIED DEVELOPMENT CODE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, on March 11, 2003, the City Council of the City of Georgetown, Texas, adopted a set of comprehensive development regulations known as the Unified Development Code ("UDC") via Ordinance No. 2003-16, which codified various zoning and subdivision standards; and WHEREAS, the City adopted Ordinance No. 2019-50 on August 27, 2019, and amended said ordinance with Ordinance No. 2022-37 adopted on April 26, 2022, to relating to the approvals, processing, and requirements for plats and plans WHEREAS, several changes to the Texas Local Government Code have resulted from the sessions of the 88th Legislature which necessitate legislative revisions to address state statutes or revisions otherwise determined necessary by legal counsel; and WHEREAS, the City Council established a Unified Development Code Advisory Committee on November 12, 2013, to review proposed or requested amendments to the UDC other than executive amendments, which are those amendments that are nondiscretionary, mandatory, or legislative revisions to address state statutes or case laws, ratify published directors determinations, incorporate recently approved Council ordinances, process City Council designated emergency items, or address revisions otherwise determined necessary by legal counsel. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1: The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this resolution implements the City of Georgetown 2030 Comprehensive Plan. RESOLUTION NO. V Z!5'- Z.3 - 5- 4 PAGE I OF 2 ZONING USE REGULATIONS SECTION 2: The City Council finds that revisions to UDC Chapters 2, 3 and 12 are nondiscretionary, mandatory, or legislative in nature pursuant to UDC Section 3.05.030.A as this amendment: 1. Is necessary in order to address state statutes or case laws; or 4. Addresses revisions otherwise determined necessary by legal counsel. SECTION 3: City Council hereby designates amendments to the UDC relative to Chapter 2 Review Authority, Chapter 3 Applications and Permits, and Chapter 12 Pedestrian and Vehicle Circulation SECTION 4: The Mayor is hereby authorized to execute, and the City Secretary to attest this Resolution. SECTION 5: This resolution shall become effective immediately upon adoption. RESOLVED this 25 day of July, 2023.
