HomeMy WebLinkAboutRES 021324-5.C - Voting SystemsRESOLUTION NO. �Zt32�1-5� A RESOLUTION OF THE CITY COUNCIL OF GEORGETOWN, TEXAS, ALLOWING FOR THE USE OF UPDATED VOTING EQUIPMENT AS ALLOWED IN STATE LAW. WHEREAS, Section 61.012 of the Texas Election Code requires that the provision at least one accessible voting system in each polling place used in a Texas election on or after August 1, 2023, and requires that this system must comply with state and federal laws setting the requirements for voting systems that permit voters with physical disabilities to cast a secret ballot.; and WHEREAS, the Office of the Texas Secretary of State has certified that the ExpressVote® Universal Voting System Version 6.3.0.0 provided by Election Systems & Software (ES&S) is an accessible voting system that may legally be used in Texas elections. Early voting and election day voting, including provisional ballots will take place on the ExpressVote® Universal Voting System, ballot marking device, in conjunction with the DS200 and DS300 Digital® Precinct Scanner. The DS850 Digital® Central Count Scanner will be used to process all by mail ballots; and WHEREAS, Chapter 123 of the Texas Election Code authorize the acquisition of voting systems by local political subdivisions and further mandate certain minimum requirements for contracts relating to the acquisition of such voting systems; WHEREAS, the City of Georgetown has approved a Joint Election Agreement and Contract for Election Services with Williamson County, Texas pursuant to Chapter 31 and 271 of the Texas Election Code (the "Joint Election Agreement"). NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: Section 1. The facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 2. The City Council of the City of Georgetown hereby adopts the ExpressVote® Universal Voting System and DS200 and DS300 Digital® Precinct Scanner voting system pursuant to Section 123.001 of the Texas Elections Code. Section 3. Pursuant to the Joint Election Agreement, the City Council of the City of Georgetown hereby authorizes the Williamson County Elections Administrator, Bridgette Escobedo„ as the City's election officer to provide at least one ExpressVote® Universal Voting System and DS200 and DS300 Digital® Precinct Scanner which may be acquired by any legal means available to Williamson County, including but not limited to lease or Resolution No.: O 2 1.3 ;R q - 5- C- Page 1 of 2 Adopting Williamson County's New Voting Systems Date Adopted: February 13, 2024 rental from any other legal source, as authorized or required by Sections 123.032 and 123.035, Texas Election Code. Section 4. The Mayor of the City of Georgetown is authorized to execute and the City Secretary is authorized to attest to this Resolution on behalf of the City Council Section 5. This Resolution shall be effective immediately upon its approve by City Council.
