A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS ("GEORGETOWN") RELEASING
APPROXIMATELY 219.998 ACRES OF LAND FROM THE CITY OF
GEORGETOWN'S EXTRATERRITORIAL JURISDICTION ("ETJ"),
SAID LAND BEING GENERALLY LOCATED NORTH OF UNIVERSITY
BOULEVARD AND EAST OF FM 1460, WILLIAMSON COUNTY, TEXAS,
RESULTING IN A REDUCTION OF GEORGETOWN'S ETJ; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on January 4, 2024, the City of Georgetown, Texas, received a petition requesting
release from its ETJ of a 219.998 acre tract of land in the John McQueen Survey (the "Petition"), a
true and correct copy of such Petition being attached hereto as Exhibit A and incorporated herein
by reference; and
WHEREAS, pursuant to Subchapter D of Chapter 42 of Local Government Code, landowners or
residents may submit a petition seeking release of an area of land from the City's ETJ; and
WHEREAS, the City Secretary has reviewed the Petition and confirmed that it meets the
requirements of Subchapter D of Chapter 42 of the Local Government Code and the petition
requirements of Chapter 277 of the Election Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS:
SECTION 1. The City Council of the City of Georgetown, Texas ("City Council"), does hereby
find that the forgoing recitals are true and correct and adopts the recitals by this reference for all
purposes.
SECTION 2: To the extent required by state law, the City Council does hereby adjust the
boundaries and limits of the ETJ of the City of Georgetown, Texas, such that the ETJ of the City
of Georgetown, Texas, shall be and is hereby adjusted to release and remove the Area subject to
the Petition, as such Area is more particularly described and depicted in Exhibit B attached hereto
and incorporated herein by reference, from the ETJ of the City of Georgetown, Texas.
SECTION 3. The City Council is not consenting to this reduction of its ETJ except as required
by state law.
SECTION 4. This Resolution shall take effect immediately upon its passage.

TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS:
The undersigned (hereinafter collectively referred to as "Petitioner"), being the majority of the
persons who hold title to land(s) situated within the area hereinafter described, land(s) which represent
a total value of more than 50% of the value of all such area —as identified by the tax rolls of the
Williamson County Appraisal District —hereby respectfully petition the City of Georgetown Texas
(hereinafter called the "City"), for the removal of the area described in Exhibit A herein (the
"Property") from the extraterritorial jurisdiction (the "ETJ") of the City pursuant to Section 42.102 of
the Texas Local Government Code, as amended. In support of this Petition, Petitioner would
respectfully show:
I.
The Property is situated in Williamson County, Texas, and totals approximately 219.998 acres,
as described in Exhibit A, all of which are located within the extraterritorial jurisdiction of the City.
IT.
Petitioner has authority, pursuant to Section 42.102(b) of the Texas Local Government Code,
to file this Petition as the owner(s) of the majority in value of an area of land located in the City's ETJ.
Additionally, the Property is not subject to any of the exceptions described in Section 42.101, which
might disqualify the Property from removal.
This Petition is signed by a majority in value of the holders of title of land —as identified by the
tax rolls of the Williamson County Appraisal District —in the area described by this Petition and further
evidenced by the ownership affidavit attached hereto as Exhibit B.
IV.
This Petition has satisfied the signature requirements described by Sections 42.103 and
42.104(a) of the Texas Local Government Code and Chapter 277, Election Code, as all signatures were
collected not later than the 180th day after the date the first signature for the Petition was obtained.

V.
All signatures collected for this Petition are in writing, pursuant to Section 42.104(c) of the
Texas Local Government Code.
Pursuant to Section 42.105(a), Texas Local Government Code, this Petition shall be verified by
the City Secretary of the City or other person at the City responsible for verifying signatures.
VII.
Pursuant to Section 42.105(b), Texas Local Government Code, the City must notify the
residents or landowners of the Property of the results of the Petition, which notification requirement
may be satisfied by notifying the Petitioner in writing.
VIII.
Since Petitioner has obtained the signatures on this Petition (and met all other requirements),
pursuant to Section 42.104 of the Texas Local Government Code, the City shall immediately release
the Property from its ETJ.
CONCLUSION & PRAYER
WHEREFORE, PREMISES CONSIDERED, Petitioner prays that this Petition be filed with
the City Secretary of the City of Georgetown, Texas, and that, thereafter, the Property be removed from
the extraterritorial jurisdiction of the City, in the manner provided by law, including particularly
Sections 42.102-105 of the Texas Local Government Code, as amended; and that, after this Petition
has been granted, that it and the Petitioner's action thereon be filed of record and be recorded in the
Office of the City Secretary of Georgetown, Texas; and that Petitioner have such other order and relief
to which they may show itself to be justly entitled.
If the City Council has not released the Property from the ETJ by the later of the 45th day after
the date the City receives this Petition or the next meeting of the City Council that occurs after the 30th
day after the date the City receives this Petition, the Property shall be released by operation of law
pursuant to Chapter 42.105(d), Texas Local Government Code.

Property: Approximately 219.998 acres of land, more or less, located in Williamson
County, Texas, more fully described on Exhibit `B-1", attached hereto and
incorporated herein by reference.
To the best of Affiant's knowledge, Affiant swears individually and on behalf of Owner that as of the
date hereof the following statements are true and within the personal knowledge of Affiant:
l . My name is Luke Phillippi. I am over eighteen (18) years of age, and I have never been
convicted of a felony. I am of sound mind, capable of making this affidavit, and am fully competent
to testify to the matters stated herein. I have personal knowledge of the matters stated herein, and the
matters stated herein are true and correct.
2. As of the date of this Affidavit, I am Executive Vice President of EOP III Sub GP, LLC, a
Delaware limited liability company, as general partner of OP III ATX Georgetown 220, LP, a Delaware
limited partnership.
3. As Executive Vice President of EOP III Sub GP, LLC, a Delaware limited liability company,
as general partner of, I have express authority to make this affidavit on behalf of Owner.
4. Owner is supplying this affidavit in support of its Petition to remove all or a portion of the
Property from the City of Georgetown's Extra Territorial Jurisdiction ("ETJ") pursuant to Section
42.102 of the Texas Local Government Code, as amended.
5. Owner is the owner of the majority in value of the Property, as evidenced by the Williamson
County Central Appraisal District's real property valuation database for governmental property
assessment for the year 2023.
6. All or a portion of said Property consists of parcels of land within the ETJ.
7. No party has ever questioned or disputed Owner's ownership of the Property.
8. The Property is not subject to any pending lawsuits in any State or Federal Court.

9. To the best of Affiant's knowledge, the Property is not subject to any of the exceptions
described in Section 42.101, which might disqualify the Property from removal from the ETJ.
10. Owner has authority Pursuant to Section 42.102(b) as the owner of the majority of value of this
area of land, being the Property, all or a portion of which is located in the ETJ, to petition the City of
Georgetown to have the portions of the Property located within the ETJ be released from the ETJ.
11. Owner has not been declared bankrupt or insolvent, voluntarily or involuntarily, in any court.
12. To the best of Affiant's knowledge, all labor and materials used in construction of
improvements, repairs, or modifications to the Property have been paid for, and there are now no unpaid
bills for labor or material against the improvements or property upon which same are situated, and all
sums of money due for building, repairs or modifying the improvements have been fully paid and
satisfied.
13. All charges for assessments, improvements, and services furnished by any governmental entity,
including but not limited to paving or mowing, have been paid.
14. Owner has not allowed and knows of no violation of any covenants, conditions or restrictions
(subdivision, condominium, or governmental) affecting the Property.
15. All taxes, charges, dues, and other assessments payable in connection with the subject Property
have been paid through the current date.
16. The current petition for removal from the ETJ is not made for the purpose of hindering,
delaying, or defrauding any creditors, neighbors, governmental entities, or any other party.

THENCE departing the east boundary line of said 69.55-acre trac, with, in part, the south boundary line
of said Bell meadows Section One and, in part, the south boundary line of Bell Meadows Section Three,
a subdivision according to the plat recorded in Cabinet R, Slide 205 of said Plat Records, N 68"17'02" E
for a distance of 2172.76 feet to a %" iron rod with cap stamped "Pape -Dawson' set on a point in the
west boundary line of a Remnant Portion of a called 150 acre tract of land conveyed to Viola E.
Horbatsch and Marvin H. Domel, by instrument recorded in Cause No. 02-0495-CPI of the Probate
Records of Williamson County, Texas, said point being the southeast corner of said Bell Meadows
Section Three, same being the northeast corner of said 150.856-acre tract for the easternmost northeast
corner hereof;
THENCE with the west boundary line of said 150-acre tract, same being the east boundary line of said
150.856-acre tract, 5 21°30'52" E for a distance of 1432.82 feet to a TXDOT Type 11 monument found on a
point in the west right-of-way line of a the aforementioned SH 130 Tollway, said point being the southern
corner of the Remnant Portion of said 150-acre tract, for an angle point hereof;
THENCE the west right-of-way line of said SH 130 Tollway, same being the east boundary line of said
150.856-acre tract, the following two (2) courses and distances:
1. 5 14"03'13" E for a distance of 515.98 feet to a W' iron rod with Illegible cap found for an angle
point hereof, and
2. 5 21'05'50" E for a distance of 1119.19 feet to the POINT OF BEGINNING and containing 219.998
acres in the City of Georgetown, Williamson County Texas. Said tract being described in
accordance with a survey made on the ground prepared under Job No. 59009-21 by Pape -Dawson
Engineers, Inc.
