HomeMy WebLinkAboutMinutes_P&Z_12.05.2023Minutes of the Planning and Zoning Commission City of Georgetown, Texas Tuesday, December 5, 2023 The Georgetown Planning and Zoning Commission met on Tuesday, December 5, 2023 at 6:00 PM at Council and Court Building, 510 W. 9th Street. The following Members were in attendance: Present were: Doug Noble, Scott A Allen, Chere Heintzmann, Stephen F Dickey, Pierce P Macguire, Lance A Morgan, Shelley G G Rodocker, Alice L York Public Wishing to Address an Advisory Board On a subject that is posted on this agenda: Please fill out a speaker registra on form which can be found on the table at the entrance to the mee ng room. Clearly print your name and the le er of the item on which you wish to speak and present it to the Board Liaison prior to the start of the mee ng. You will be called forward to speak when the Board considers that item. Only persons who have delivered the speaker form prior to the mee ng being called to order may speak. Speakers will be allowed up to three minutes to speak. If you wish to speak for six minutes, it is permissible to use another requestor's granted me to speak. No more than six minutes for a speaker may be granted. The requestor gran ng me to another speaker must also submit a form and be present at the meeting. On a subiect not posted on the agenda: A request must be received by the Advisory Board or Commission Liaison prior to the day the agenda for this mee ng is posted. Each speaker will be given three minutes to address the Board or Commission members. No action can be taken at this meeting. Statutory Consent Agenda The Statutory Consent Agenda includes non -controversial and routine items that may be acted upon with one single vote. An item may be pulled from the Consent Agenda in order that it be discussed and acted upon individually as part of the Regular Session. 1.A Meeting Minutes Consideration and possible action to approve the minutes from the November 21st, 2023 regular meeting of the Planning & Zoning Commission -- Erica Metress, Planning Specialist Moved by Chere Heintzmann; seconded by Pierce P Macguire to Approve . Regular Session 2.A 2023-10-ANX Berry Creek Townhomes Consideration and possible action on an request for a Zoning Map Amendment to zone, upon annexation of 9.992 acres out of the William Roberts Survey Abstract No. 524 to the Low -Density Multifamily (MF-1) Zoning District for the property generally located at 3601 Shell Road (2023-10-ANX) -- Ryan Clark, AICP Senior Planner Ryan Clark presented the staff report. Chair Dickey asked if the 9.992 acres of the proposed property includes the extension on Shell Road. Clark acknowledged that the annexation would incorporate a section of Shell Road within the city limits. Chair Dickey inquired about the number units available on the site. Clark noted that the site is entitled to less than 140 units. Commissioner Allen referred to staff's review that the zoning change does not comply with the Comprehensive Plan and inquired about a zoning district that would comply. Clark elaborated that in the Low -Density Multi -Family (MF-1) zoning, applicants can propose a detached single-family rental which would fit the character of Mixed -Density Neighborhood, and can also propose a two story, garden -style apartment. Clark noted that residential single-family homes, two-family homes, and townhomes are more sought out zoning districts for Mixed -Density Neighborhoods. Clark noted that MF-1 zoning districts do not require internal public streets whereas residential single-family homes, two-family homes, and townhomes would essentially have a street network. Commissioner Allen asked if any of the alternatives would alleviate concerns regarding access on Shell Road or the private road. Clark acknowledged that this property must work with neighboring properties to receive access on Shell Stone Trail. Commissioner Heintzmann inquired about the completion of the City's installation of the downstream Berry Creek's interceptor that'll allow service to the development. David Munk, Senior Utility Engineer, approached the podium to address the Commission and noted that construction for the large interceptor will begin in March 2024 and may take 600 days to complete. Chair Dickey inquired about a new water line near the property in question. Munk confirmed that there would be a new water line in place and noted that access to water is not going to be an issue for the applicant. Aaron Trevizo, Civil Engineer for the project, approached the podium to address the Commission and acknowledged that the site is required to have two access points. Trevizo noted that Shell Road is meant to be an arterial road for the city and not pedestrian friendly. Trevizo established that the applicant will be dedicating 27 and a half feet of right away. Trevizo noted that they are working with the neighbor to submit a joint access easement, which would allow the shared driveway to be the second access point to the site. Trevizo established that the applicant is required to install left turn lanes, which will add to the plan of Shell Road, and allow for both access points from that road. Trevizo noted that the location of both access points will help the fire department because they would not have to rely on a private road such as Shell Stone Trail. Trevizo presented the site plan to the Commission. Trevizo established that the water line from American Elm Drive will be extended to the site and allow owners east of the site to tap into the water should they decide to annex into the City. Chair Dickey asked for the maximum height in MF-1. Trevizo acknowledged that the maximum height in MF-1 is 35 feet. Commissioner Allen asked if a PUD would specify the requirements on the property. Clark confirmed and noted that in the past, staff has seen limitations such as prohibition of stacking of units. Chair Dickey opened the public hearing. Robert Krebs, 3709 Shell Road, approached the podium to address the Commission and informed the Commissioners that he has lived at the announced address for 28 years. Krebs conveyed his understanding of low density which equates to 1 house on 5 acres with various wildlife roaming the property. Krebs noted that when rain falls the water goes to his property and pointed that half of the land of the property in question will be impervious to landfall. Krebs questioned if there is enough capacity in the ditch, northside of the development, to carry the rain. Krebs believed that there are deed restrictions that prohibit this type of development on the property. Krebs questioned whether the owners of property consulted with the neighbors to approve this change. Chair Dickey closed the public hearing. Moved by Scott A Allen; seconded by Alice L York to Deny. B Discussion Items Updates, Commissioner questions, and announcements -- Travis Baird, Assistant Planning Director Travis Baird, Assistant Planning Director, announced that the December 19th meeting is cancelled.
