Tuesday, January 2, 2024
The Georgetown Planning and Zoning Commission met on Tuesday, January 2, 2024 at 6:00 PM at
Council and Court Building, 510 W. 9th Street.

Public Wishing to Address an Advisory Board
On a subject that is posted on this agenda: Please fill out a speaker registra on form which can be found on the
table at the entrance to the mee ng room. Clearly print your name and the le er of the item on which you wish
to speak and present it to the Board Liaison prior to the start of the mee ng. You will be called forward to speak
when the Board considers that item. Only persons who have delivered the speaker form prior to the mee ng
being called to order may speak. Speakers will be allowed up to three minutes to speak. If you wish to speak for
six minutes, it is permissible to use another requestor's granted me to speak. No more than six minutes for a
speaker may be granted. The requestor gran ng me to another speaker must also submit a form and be present
at the meeting.
On a subject not posted on the agenda: A request must be received by the Advisory Board or Commission Liaison
prior to the day the agenda for this mee ng is posted. Each speaker will be given three minutes to address the
Board or Commission members. No action can be taken at this meeting.

1. Statutory Consent Agenda
The Statutory Consent Agenda includes non -controversial and routine items that may be acted upon
with one single vote. An item may be pulled from the Consent Agenda in order that it be discussed and
acted upon individually as part of the Regular Session.
1.A Meeting Minutes
Consideration and possible action to approve the minutes from the December 5th, 2023
regular meeting of the Planning & Zoning Commission -- Erica Metress, Planning
Specialist
Moved by Doug Noble; seconded by Chere Heintzmann to Approve.

2. Regular Session
2.A 2023-11-SUP - 605 E. University Suite 110
Public Hearing and Possible Recommendation on a request for a Special Use Permit for a
Multifamily, Attached Dwelling Unit in the (C-1) Local Commercial District for the property
addressed at 605 E. University Avenue Suite 110, bearing the legal description of
Academia East Condo, Building 605, Unit 110, 4.9% Common Area Interest (2023-11-
SUP) -- Maddison O'Kelley, Preservation and Redevelopment Manager
Maddison O'Kelley presented the staff report.
Commissioner Allen asked if the request will only apply to the specific unit in question.
O'Kelley confirmed that the request will only apply to the property addressed in the legal
description.
Lee McIntosh, applicant and owner, approached the podium to address the commission
and clarified that the property in question is 605 East University Suite 110.
Commissioner Heintzmann inquired whether the requested Special Use Permit would
solely pertain to Suite 110 and not entail rezoning the entire property. O'Kelley confirmed
that, yes, the Special Use Permit would solely pertain to Suite 110.
Commissioner Heintzmann sought clarification on whether the applicant is the property
owner, or if they sold the suite to someone who is now making the request. McIntosh
clarified that he is the owner of suite 110 along with 3 other units on the property. McIntosh
further explained that he is making the request with his mother in consideration, as she is
87 years old and unable to climb flights of stairs daily. McIntosh included that he intends to
have a caregiver reside with his mother in this suite. McIntosh commented that the request
would, also, bring the suite in compliance with federal and ADA guidelines for mixed use
condos which prefer a 51:49 percent of mix between residential and commercial.
Chair Dickey asked if the units on the second floor are owned or apartments. McIntosh
clarified that the units on the second floor are condos and individually owned.
Commissioner Heintzmann questioned if the commercial units were purchased or if
they were leased. McIntosh explained that almost all units were purchased.
Chair Dickey inquired about the discussion in 2016 about the commercial residential
mix. McIntosh explained that the original proposal for this project was a 3 story,
residential apartment. McIntosh acknowledged that the Council rejected the project with
a super majority vote and noted that an alternative was already prepared, which was the
multi -use development brought to the Commission.
Chair Dickey opened the public hearing.
Peter Dana, 1101 Walnut Street, approached the podium to address the Commission and
believed that this Special Use Permit may be a problem. Dana referred to the applicant's
Letter of Intent which stated that this project is to reinvest in the neighborhood and
revitalization of older buildings and commented that one ADA unit on the 1st floor would
not add to the neighborhood's affordable housing. Dana noted that this request is for the
applicant's relative and a caretaker. He believed that a one -bedroom apartment doesn't
seem suitable for the number of people that would occupy the space. Dana referred to the
applicant's Letter of Intent which stated that this Special Use Permit would provide for a
more diverse tendency and preservation of several historic structures. Dana believed that
the previous structure of a hospital building was not preserved, but demolished. Dana
highlighted the broken gate that kept the trash receptacle from view. Dana established that
he would like this request to be denied.
Chair Dickey closed the public hearing.
Moved by Doug Noble; seconded by Mike Tiland to Approve as presented.
Discussion between Chair Dickey, Commissioner Heintzmann, and Commissioner Allen
on the concern of this request prompting similar ones in the future.
O'Kelley reminded the Commission that they may move to place a condition of approval
that this Special Use Permit is limited to this unit.
Commissioner Noble inquired about the possible change of the exterior of the
structure.
Travis Baird, Assistant Planning Director, approached the podium to address the
commission and clarified that changes to the exterior of the structure would be completed
through the Site Development Plan and may be administratively approved if the changes
meet the code requirements for the zoning district of the property.
As a result of the discussion, Commissioner Noble clarified his original motion to approve
as presented to approve as presented with the condition that this approval is limited to the
property addressed at 605 East University Avenue Suite 110, bearing the legal description
of Academia East Condo, Building 605, Unit 110, 4.9% Common Area Interest.
Moved by Doug Noble; seconded by Mike Tiland to Approve the Special Use Permit for a
Multifamily, Attached Dwelling Unit in the Local Commercial District for the property
addressed at 605 East University Avenue Suit 110, bearing the legal description of
Academia East Condo, Building 605, Unit 110, 4.9% Common Area Interest.

Updates, Commissioner questions, and announcements -- Travis Baird, Assistant
Planning Director
Travis Baird, Assistant Planning Director, informed the Commission that the upcoming
meeting has a substantial agenda with numerous items.
