Grievance Procedure under
The Americans with Disabilities Act
This Grievance Procedure is established to meet the requirements of the Americans with
Disabilities Act of 1990 ("ADA"). It may be used by anyone who wishes to file a complaint
alleging discrimination on the basis of disability in the provision of services, activities, programs,
or benefits by the [name of public entity]. The [e.g. State, City, County, Town]'s Personnel
Policy governs employment-related complaints of disability discrimination.
The complaint should be in writing and contain information about the alleged discrimination
such as name, address, phone number of complainant and location, date, and description of the
problem. Alternative means of filing complaints, such as personal interviews or a tape recording
of the complaint, will be made available for persons with disabilities upon request.
The complaint should be submitted by the grievant and/or his/her designee as soon as possible
but no later than 60 calendar days after the alleged violation to:

Within 15 calendar days after receipt of the complaint, [ADA Coordinator's
name] or [his/her] designee will meet with the complainant to discuss the complaint and the
possible resolutions. Within 15 calendar days of the meeting, [ADA Coordinator's
name] or [his/her] designee will respond in writing, and where appropriate, in a format
accessible to the complainant, such as large print, Braille, or audio tape. The response will
explain the position of the [name of public entity] and offer options for substantive resolution of
the complaint.
If the response by [ADA Coordinator's name] or [his/her] designee does not satisfactorily
resolve the issue, the complainant and/or his/her designee may appeal the decision within 15
calendar days after receipt of the response to the[City Manager/County Commissioner/ other
appropriate high-level official] or [his/her] designee.
Within 15 calendar days after receipt of the appeal, the [City Manager/County Commissioner/
other appropriate high-level official] or [his/her] designee will meet with the complainant to
discuss the complaint and possible resolutions. Within 15 calendar days after the meeting,
the [City Manager/County Commissioner/ other appropriate high-level
official] or [his/her] designee will respond in writing, and, where appropriate, in a format
accessible to the complainant, with a final resolution of the complaint.
All written complaints received by [name of ADA Coordinator] or [his/her] designee, appeals
to the [City Manager/County Commissioner/ other appropriate high-level
official] or [his/her] designee, and responses from these two offices will be retained by
the [public entity] for at least three years.

The Geo rgetown Commission on Aging has invited the ADA Board Chair to attend their June 20th b o ard
and p ro vide an overview of the ADA Board.
The Geo rgetown Commission on Aging advis es the City Co uncil o n the needs and s tatus o f senio rs in the
entire City, rec ommend ing ways in which tho s e need s may be met. The Co mmis s io n d etermines and
as s es s es exis ting res ources in the City whic h may be utilized by senio rs to meet their need s . They will
evaluate and as s es s p ro p o s ed programs , grants and other governmental activities which may impac t
s eniors. The C o mmis s io n will enc o urage, promote, as s is t and s afeguard the rights and abilities of o ld er
ad ults throughout the c o mmunity to maintain maximum health, well-being and ind ep endence.

Wednesday, April 13, 2016 at 6:01 PM
The Board may, at any time recess the Regular Session to convene in Executive
Session at the request of the Chair, a Board Member, The City Manager, Assistant
City Manager, General Manager of Utilities, City Council Member, or legal
counsel for any purpose authorized by the Open Meetings Act, Texas
Government Code Chapter 551, and are subject to action in the Regular Session
that follows

C. Discussion of effective communication requirements under Title II and the City’s
policies and procedures including provision of auxiliary aides. - Nat Waggoner,

Waggoner reviewed with the board the requirements under Title II and the
City’s Policies and Procedures including auxiliary aides.

Open discussion was held on items D, E, & F. Some of the discussion were on
ways to improve progress reporting, project planning, programming and policies
& procedures.

G. Review and possible action to approve the minutes from the Regular ADA Board
meeting held March 16, 2016. – Jana Kern – ADA Board Liaison
Mills stated that Items F & G of the March minutes are for Vice Chair and that
Item G should be for Secretary. Kern stated that she will correct the minutes and
that the Board can approve the minutes as amended. Motion by Juan Risco
second by Mills to approve the minutes as amended. Approved 6-0-1
(Sypniewski)
Adjournment
Motion by Mills second by H’Luz to adjourn meeting. Approved 6-0-1 (Sypniewski).
