conducted, to include options for public comments and how the public may address the

Legislative Regular Agenda
C. Consideration and possible action to approve the minutes of the May 12, 2021 regular meetings of
the Unified Development Code Advisory Committee -- Mirna Garcia, Management Analyst
Motion by Wanke to approve the minutes from the May 12, 2021 meeting. Second by Robinson.
Approved. (5-0)
D. Public Hearing and possible action on a proposed Text Amendment to the Unified Development
Code (UDC) relating to the Tree Preservation and Landscaping standards specifically as it pertains
to tree preservation, removal and mitigation, streetyard, gateway and parking landscape
standards, and screening and water conservation requirements (UDC General Amendment No. 20-
03) – Ethan Harwell, Senior Planner and Steve McKeown, Landscape Planner
Staff reviewed over the amendment process and calendar. Staff also reviewed over the updates to the
Tree Preservation, Removal and Mitigation along with Street yards, Gateways, Parking, Screening
and Water Conservation.
Staff reviewed and discussed with the Committee over additional direction by City Council
including:
• Consideration of trees smaller than 6-inches in diameter as credit trees for tree mitigation.
Proposed Terms:
1. Trees smaller than 6 inches, but no smaller than 3 inches at 4.5 feet above ground, may be counted
as on-site credit provided the following standards are met:
a. Trees shall meet the locational requirements (i.e. undisturbed areas, not around an existing
PT or HT, not planned for future phase of development, not expected to be impacted by
utilities, should not affect sight triangles, etc.);
b. Trees shall be in good health and within or near a tree stand;
c. Trees full Critical Root Zone shall not be impacted from construction; and
d. Trees may be counted at a reduced mitigation ratio of 0.5:1 inch ratio.
e. Must be a shade tree to receive credit
• Consideration of trees planted in the residential lots as credit trees for the purpose of tree
mitigation.
Proposed Terms:
1. Allow new trees planted on residential lots to be used for mitigation when the following
conditions are met:
a. New tree must be a minimum 3-inch caliper
b. Plant out common areas to fullest extent first.
c. Only trees planted above the minimum landscape requirements shall be given credit
d. Give credit at a 0.5:1 ratio
e. 15-foot minimum spacing
f. May only be used on property subject to a Residential Building Permit
It was stated that the proposed terms and redlines are good except language needs to be changed on
how the 3 inch trees are measured.

Staff reviewed the process of the Public Outreach. Staff received public responses stating, “too many
trees are being destroyed during site prep” and “to remove any trees at all is unacceptable”.
Chair Steven’s opened the Public Hearing. No one came forward. The Public Hearing was closed.
Motion by Wanke to approve the proposed amendments to the Unified Development Code (UDC)
related to tree preservation and landscape standards. Second by Ortega. Approved. 5-0

IT E M S UMMARY:
T he C ity of G eorgetown has seen signific ant growth and change during 2021. T here are multiples items on
which an update to the UDC Advis ory C ommittee would be appropriate and beneficial:
2020/21 UD C Annual Review:
Due to the ongoing C O VI D pandemic, the 2020 Annual UDC R eview was extended into the 2021. T here
were a series of items that were c onsidered for update, split into two phas es . Many of thes e updates were
completed whic h inc luded:
Tree P reservation and Mitigation C ode updates , inc luding s ignificant changes in the way c redits could be
calc ulated in residential s ubdivis ions through the replac ement of trees onsite in lot loc ations not previous ly
allowed.
More effective definition of c ertain gateway s tandards , inc luding the Highway G ateway O verlay
requirement, defining the area c learly as a dis tance from one of the applic able highway rights -of-way.
Water C ons ervation efforts through the allowanc e of artific ial turf on res idential lots .
Additionally, as pects of the language in C hapter 10 were modified through an executive amendment to
conform with rec ent c ourt rulings regarding regulation of signs and s peech.
T he items in the s econd phas e have been held back for various reasons . T hese inc lude:
F urther updates to sign regulations , inc luding language regarding the installation of digital signs. T his has
been referred bac k to s taff for examination as part of the wider UDC Diagnos tic .
Definition of, and regulations regarding, group homes are under examination by s taff for a potential
exec utive amendment to ensure c onformance of the UDC with F ederal law regarding fair housing
s tandards and prac tic es .\
S treet c ros s -s ections, particularly how they are meas ured for purpos es of compliance with the fire code,
have been referred back to P lanning s taff for further disc ussion with the F ire Mars hall. R ecent dis cus s ions
have yielded promising res ults that a s olution to this issue may be achievable without the need of an update
to the UDC . F urther information will be provided to the c ommittee as it becomes available.
UD C Diagnostic
T he UDC Diagnos tic is planned to be a holis tic review of the UDC with applic ation of the knowledge and
experience gained through the development process s inc e the las t major examination of the UDC in 2017.
T he Diagnostic will involve the retention of a cons ultant to provide stakeholder engagement, s pecific

recommendations and feedbac k, and general guidanc e through the process of developing a comprehensive
update of the UDC . T he C ity has taken its firs t s teps towards initiation of the UDC Diagnostic in the form
of a meeting between the C ity C ouncil and P lanning & Zoning C ommission in S eptember. T he purpos e of
this meeting was to foster an open dialogue and exc hange of ideas regarding the c hallenges facing the C ity
in the c urrent development environment both struc turally through its code and from without, through the
various pressures and c omplexities introduced by the various projects c oming to the C ity. F ollowing steps
will inc lude s coping and hiring of a cons ultant, s takeholder engagement, the is s uance of findings , and
pursuit of a final code update. T his process is expected to begin in earnest early next year and to take
approximately two years to c omplete.
Condo Regime Examination
T he UDC Diagnos tic is expec ted to provide overall res olution to a number of c omplex is s ues the C ity
faces at the intersec tion of its current c ode and the evolved development environment. However, the
res olution of c onflic ts which are being encountered in the development of C ondominium projec ts is
cons idered espec ially important and time s ensitive, and a s maller examination and update has begun.
C ondo projects have become s ignificantly more attractive to the wider market of home buyers in the past
s everal years. W hile these projects c an repres ent real convenienc es for buyers and owners, their unique
s tructure is not currently well s upported by the C ity’s UDC . F rees e and Nic hols has been retained to
provide guidanc e and rec ommendations on updates whic h may provide for greater flexibility in the c ode to
addres s and support condo projec ts. P rimary areas of concern include zoning issues , utility c onflic ts,
s etbac k is s ues, ownership issues as relate to the issuanc e of building permits for post-purc hase
improvements, and utility s ervic e c onflic ts.
T he c onsultant has already carried out initial s takeholder interviews , inc luding with C ity S taff, and will now
begin engaging those s takeholders more direc tly seeking further ins ight into the is s ues s eeking res olution.
C ity C ounc il has direc ted this item be processed as an executive amendment to the UDC .
2022 UD C Annual Review
T he 2022 UDC Annual R eview (22 AR ) will occ ur along with the C ondo R eview, UDC Diagnos tic , and
any executive amendments . O ver the next two months, S taff will review the exis ting lis t of potential
updates for thos e whic h are most time sens itive and appropriate. In early 2022, potential updates will be
pres ented to the C ommittee for review and c omment. T his will initiate the proc es s whic h will inc lude
s eeking public submittals , input from C ounc il and P &Z, and the eventual pursuit of spec ific code
amendments. T hos e amendments would be expected to go before C ouncil for approval 3Q /4Q 2022.

Condo Regime Executive Amendment-Update
•City has retained Freese & Nichols to provide guidance on UDC amendments specific to single-family Condo developments.
•Consultant met multiple stakeholders during October including:
•Planning
•Systems Engineering
•Buildings & Inspections
•Multiple Area Developers
•Consultant will be working with staff into next year to determine recommendations for code changes to resolve conflicts between these types of developments and UDC standards for design standards, utility infrastructure and extensions, right-of-way requirements, building permits, etc.
