The Board, appointed by the Mayor and the City Council, makes recommendations to the City Council on affordable housing matters. A. Welcome to guests. Stuart Shaw and Casey Bump, both with Bonner Carrington Legislative Regular Agenda Doering thanked Bills for all her hard work on the last three Housing Tax Credits presented to City Council; Brennan for her clear and concise definition of Public Housing and Workforce Housing to City Council; Glasco for staying connected with Council member Brainard; Mann for staying connected with Council member Hesser; Martin and Baxter for their continued steadfast support on Affordable Housing endeavor. B. Consideration and possible action to approve the minutes from the January 14, 2016 regular meeting. Motion by Brennan to approve the minutes from the January 14, 2016 Housing Advisory Board meeting. Second by Glasco. Approved 6-0. Doering explained Bills will provide a brief overview and Board will discuss both Item C and Item D together before Board members take action. C. Consideration and possible action to recommend approval a resolution of support and a two times resolution for Georgetown Village Senior Residential LP to apply for Housing Tax Credits for the construction of 180 units to be known as the Mariposa Apartment Homes at Georgetown Village, located on the east side of Shell Road, north of Sycamore Street. Staff responded there are no codes on what type of materials have to be used in finishing materials. Doering asked staff what codes exist relative to the filtering of hard water. Staff responded we do not have any requirements. Brian Ortego is in favor of the projects and believes it meets the criteria of Georgetown Village Concept Plan and it will be a positive interest. Bill Weber President and CEO of Green Builders, Inc. developer of Georgetown Village stated he is available to answer any questions regarding Georgetown Village Concept Plan. Bills provided a brief overview of the 126 income-restricted and 54 market rate unit apartment complex. Bills explained the apartment complex will consist of 1 and 2 bedroom units. Staff is not recommending approval. Bills explained the site is located on Shell Road, which is a two-lane undivided road, partially in the county. There are no drainage improvements for the road and there are no sidewalk on Shell Road for pedestrian traffic. Bills stated both projects are not currently in the city limits and will have to undergo the Annexation, Comprehensive Plan Amendment, and Rezoning process before receiving any site development approval. Applicant, Stuart Shaw CEO of Bonner Carrington gave a brief presentation describing their project and provided handouts. Discussion between board and applicant regarding monitoring illegal and drug activities, hiring process for managers, maintenance plan, waiting list, and what they do to promote the community. Discussion between board, applicant and staff regarding sidewalks, retail, employment, trees, traffic. In Texas, there is an average of 0.0088 tax c red it units p er person. In Geo rgeto wn, we have 0.024 units p er person, which means we have 2.77 times the average amount o f s tatewid e tax credit units . If the city d o es no t p as s the res o lutio n, the applic ation c anno t b e sub mitted. Resolution of Local Jurisdiction Support This is a s coring c riteria fo r the p ro jects . Bills , Hous ing Co o rd inato r ATTACHMENTS: Description Type Low-Income Hous ing Tax Credit program information Cover Memo Page 22 of 27 Page 1 of 2 Low-Income Housing Tax Credit (LIHTC) Program Summary The Low-Income Housing Tax Credit Program (LIHTC) is funded through the U.S. Treasury Department and is overseen by the Internal Revenue Service (IRS). The program was created under the Tax Reform Act of 1986 that gives incentives for the utilization of private equity in the development of affordable housing. The tax credits provide a dollar-for-dollar reduction of a taxpayer’s federal income tax, which is more attractive than a tax deduction, which only provides a reduction in taxable income. Due to specific rules in the tax code for individual use of tax credits, almost all investors in LIHTC projects are corporations. The program is administered at the state level by the Texas Department of Housing and Community Affairs (TDHCA), which receives a fixed allocation of credits annual, based on the state population. The state must prepare a Qualified Allocation Plan (QAP), which determines the process by which to review applications and award credits. This allows each the state to set its own priorities and address specific state housing goals. Credits are award under either the 9% Competitive Program or the 4% Program that is available throughout the year. The 4% credits are funded through tax-exempt bonds. In Texas, the state uses a Regional Allocation Formula (RAF) that allocates 9% credits for new construction between 13 regions, with rural and urban subcategories. There is also a set-aside category that existing at-risk affordable housing developments (Section 8, USDA, etc.) compete in separately. The annual QAP is under review in the fall and the final QAP is published in mid-December. Complete applications must be submitted by the end of February. For the 4% credits, the Notice of Fund Availability is published in October, and eligible projects are funded until the funds are expended. Eligible Grantees Private for-profit and nonprofit multifamily housing developers. Two Times Rule One of the regulations in the QAP under the Housing De-Concentration Factors requires applications for projects in a jurisdiction with more than twice the state average per capita of tax credit units must include a resolution of support from the elected body supporting the project and acknowledging the two times status. The City of Georgetown has created a review process for potential applicants (http://housing.georgetown.org/housing-tax-credit-resolution-of-support/). The developer makes the request to the Housing Advisory Board, which reviews the project and makes a recommendation to the City Council for approval or denial of the project. Eligible Renters Low-income tenants can be charged a maximum rent of 30% of the maximum eligible income, which is 60% of the area's median income adjusted for household size as determined by HUD. There are no limits on the rents that can be charged to tenants who are not low income but live in the same project. Most projects have set-asides at the 60%, 50% and 30% thresholds. For 2015, the chart below shows the maximum incomes for eligible tenants. Comprehensive Plan elements are scheduled for review every five years and the housing supply and demand projections within the plan go through 2017, so the demographic analysis will need to be updated. The official review will begin in 2017/18, but in preparation, the Housing Advisory Board can focus on two key areas that will provide more information for inclusion into the Housing Element update. Explore the feasibility new Housing Programs (estimated cost: $35,000-$50,000) The Housing Advisory Board has reviewed, at a broad level, different housing programs that the city could implement to expand the supply of affordable housing and maintain that supply over the long-term. Examples of potential programs include: • Housing Trust Fund • Community Land Trust • Impact fee waivers/reductions • Local Bond Issue • Policies for inclusion of affordable housing for special developments requiring city approval (I.e. MUDs, PIDs, PUDs, TIRZ) With the help of a consultant, the board can examine the feasibility of various programs, providing the city with an analysis of the fiscal impact to the city, possible funding sources, and examine any conflicts with state and federal regulations. Gather input from Georgetown residents (estimated cost: $5,000) Board members feel that surveying and gathering input from current residents of Georgetown was lacking in the original plan. Over the next year, board members, along with staff, can hold a series of public meetings in different forums to gain more insight into housing needs. The focus will be on three areas that have specific housing concerns, new households (millennials), workforce households, and senior households. • Hold four(4) public meetings within various neighborhoods. o To encourage broad participation, childcare and dinner will be provided. Additionally, other departments, such as Code Enforcement and Fire Services, will make presentations on neighborhood safety. In the discussion, residents will be able to voice their concerns and provide feedback to the board on housing and neighborhood needs. • Meet with service providers (Caring Place, Habitat for Humanity, Georgetown Project) o The board will meet with the organizations that are already serving workforce and senior households. They can provide feedback from their perspective and discuss collaborating with the board to hold public forums at their events or have a board member available on a weekly basis to talk to customers.
