Consideration and possible action to approve the minutes from the December 9, 2021 and the January 13, 2022 regular meetings of the Historic and Architectural Review Commission. - Mirna Garcia, Program Manager Motion to approve by Commissioner Hyde. Public Hearing and Possible Action on a request for a Certificate of Appropriateness (COA) for a new fence, railing or wall that is inconsistent with the overlay district's characteristics and applicable guidelines at the property located at 1307 S. Myrtle Street, bearing the legal description 0.13-acre in the Clement Stubblefield Survey, Abstract No. 558, also being known as the southwest part of Block B, Hughes Second Addition, an unrecorded subdivision. (2021-73- COA) –Nat Waggoner, Asst. Planning Dir. - Long Range Staff report by Waggoner. This item was considered at the January 13, 2022 meeting of the Historic and Architectural Review Commission (HARC). At that meeting a public hearing was held and the HARC approved a motion to postpone the item to the January 27, 2022 meeting in Page 7 of 39 Historic and Architectural Review Commission Page 2 of 2 Meeting: January 27, 2022 order for the applicant to clarify their request. The fence is proposed to be constructed of 8 horizontal wood pickets, 72 inches in length spaced 1 and 3 inches apart for a total height of 6’. The proposed spacing of the horizontal pickets provides 21% transparency. The fence is proposed to align with the front or southwest corner of the house and enclose the s ide street and rear yards, approximately 14’ from the curb line of 14th Street at the south/east property pin. The applicant addressed the commission and further explained his request. Chair Walton opened and closed the public hearing as no one signed up to speak. Motion to deny Item C (2021-73-COA) by Commissioner Nunn. Second by Commissioner Morales. Motion passes 4-0 to deny request. D. Updates, Commissioner questions, and comments. – Sofia Nelson, Planning Director Waggoner provided an update regarding the neighborhood small area plans. Requested Changes: The applicant is requesting HARC approval of a 8’x 12’ (96 square-foot), storage building with an 8’ tall shed roof with composite shingles. The siding is 3/8’ engineered wood siding. Justification for Requests: The application is seeking approval of an accessory building to the rear of the property for the purpose of storing theater materials. The accessory structure is located on Rock Street, which is the secondary or side street-facing façade. The Rock Street façade of the main structure is approximately 90 feet in length and approximately three stories tall. Technical Review: The proposed shed meets the material, color, and massing requirements of Chapter 2.5 of the Design Guidelines. DESIGN GUIDELINE COMPLIANCE Staff has determined that the proposed project complies with 4 of the 4 applicable Historic District Design Guidelines in Chapter 2 as detailed below in the Applicable Design Guidelines section below. APPLICABLE DESIGN GUIDELINES The following guidelines are applicable to the proposed scope of work in accordance with the adopted Historic District Design Guidelines: GUIDELINES FINDINGS CHAPTER TWO – DOWNTOWN AREA TWO 2.5.E Roofs Complies Accessory building has a shed roof with a 1/12’ pitch. E.1 In Urban Commercial block faces the roofs can be flat with parapets or pitched. 2.5.F Exterior Building Materials Building materials should contribute to the visual continuity of the area. They should appear similar to those seen traditionally to establish a sense of visual continuity. This is especially true for buildings with high or medium significance. Buildings with low significance can have some flexibility as long as there is a compatibility of scale, texture and color with traditional materials. Complies The accessory structure uses engineered wood as the primary siding with is compatible in scale and texture of the primary structure and is a durable product. 2.5.I Additions Complies Accessory building is located at the rear of the building 4’ from the southern property line and 8’ from the side (eastern) property line. I.1 Two distinct types of additions are considered to be appropriate: ground-level or roof-top. a. Such an addition should be to the rear or side of a building. This will have the least impact on the character of a building, but there may be limited opportunities to do this. I.2 An addition shall be compatible in scale, materials, and character with the main building. Complies The accessory building is subordinate to the main structure in overall size and height. The primary structure is approximately 14K sq. ft and 3 stories in height. The accessory building is 96 sq. ft. and less than 1 story in height. a. An addition shall relate to the building in mass, scale, and form. It should be designed to remain subordinate to the main structure. CRITERIA FOR APPROVAL In accordance with Section 3.13.030 of the Unified Development Code, HARC must consider the following criteria. Staff has determined that the applicant has met 7 out of 8 of these criteria. SECTION 3.13.030 CRITERIA FINDINGS 1. The application is complete and the information contained within the application is correct and sufficient enough to allow adequate review and final action; Complies Staff reviewed the application and deemed it complete. 2. Compliance with applicable design standards of this Code; Complies Proposed project complies with applicable UDC criteria. 3. Compliance with the Secretary of the Interior's Standards for the Treatment of Historic Properties to the most extent practicable; Complies Proposed project complies with applicable SOI Standards, which include: 9. New additions, exterior alterations, or related new construction shall not destroy historic materials that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity of the property and its environment. 10. Compliance with the adopted Historic District Design Guidelines, as may be amended from time to time, specific to the applicable Historic Overlay District; Complies Proposed project complies with applicable Design Guidelines. 5. The general historic, cultural, and architectural integrity of the building, structure or site is preserved; Complies Proposed project is compatible with the style of the building, is located fully to the rear of the main structure and is easily removed in the future. 6. New buildings or additions are designed to be compatible with surrounding properties in the applicable historic overlay district; Complies The proposed back porch design and materials are compatible with surrounding properties in the Old Town Overlay District 7. The overall character of the applicable historic overlay district is protected; and Complies The proposed back porch addition will have minimal visibility and impact on the character of the Old Town Overlay District and is compatible with the overall character 8. The Master Sign Plan is in keeping with the adopted Historic District Design Guidelines and character of the historic overlay district. Not Applicable No signs are proposed. STAFF RECOMMENDATION Based on the findings listed above, staff recommends APPROVAL. As required by the Unified Development Code, 2 signs were posted on-site. In the Historic Overlay District. The shed is located behind the DSPC (south side) on the rear driveway approximately 70’ off Rock Street. The north wall of the shed is adjacent to the DSPC. The south wall is 4’ off the property line fence. The east wall is approximately 25’ off the property line. The west wall is at the end of drive way 70’ off Rock Street. The shed is built on a base of 2” x6” joists, 3” above the driveway, covered by ¾” tongue and grove plywood. The walls are 2” x 4” on 24” spacing. The walls are 3/8”” Smart Side Siding” The roof joists are 2” x 8” x 10’ on 24” spacing covered by 7/16” OSB. This is covered 15 lb. felt and asphalt 3-tab shingles. There are no windows. The door is made of the same material as the siding. The trim, is 1” x 4” real trim. The soffit & facia are 1/2” exterior plywood. There is no signage or windows on the shed. The shed is painted with Exterior Bear “Ashen Tan”, which closely matches the color of the stone of the DSPC. The trim and soffit are exterior Bear “bright white.” The project meets UDC Section 3.13.020.B 1. The application is complete & correct to allow adequate review. 2.
