Capital Improvement Projects – November 2018
Garey Park – The Garey House is complete and had its first event on September 9th. The park is
substantially complete with punch list items being completed. The contractor continues to work on
punch list items.
Wildlife Viewing
San Gabriel Park Phase II– Phase II demolition is complete with exception of the Gazebo. Lower Park
Road has been closed to the public and is being worked to prepare for new parking and road. Pavilion
bases are being set and readied for concrete. The project is on schedule.

Columbarium – The Columbarium project began the last week of August. The stone facade and niches
have been completed. Work has begun to prepare for flatwork.
Niche Installation Facade completion and flatwork preparation
Trail Reconstruction – 2018 phase II reconstruction of the San Gabriel River Trail is scheduled to be
completed this summer. Staff is assessing current conditions for ADA compliance. The project is being
considered as an addition to the Phase II San Gabriel project. No change.
2019 CIP Projects
VFW Park Parking Lot – Staff will present a change order to the existing San Gabriel Phase II contract to
complete the additional parking lot at VFW Park. Schedule is pending parks board recommendation and
council approval.
Berry Creek Neighborhood Park – Staff will be scheduling public input meeting with residents to gather
input for future development of the park.
Kelly Park – Renovations through the Capital Repair and Replacement Fund. Public input will be
gathered prior to construction.
84 Lumber Park - Staff will start the public input process to gather information for design.

ITEM SUMMARY:
The Parks and Rec reation Ordinanc e was las t amended in 2012. The rec ent d evelopment and annexatio n
o f Garey Park has fac ilitated the need to amend the o rd inance to inc lude ac tivities within the p ark. This
change has als o provid ed the o p p o rtunity to review o ther areas o f the o rd inanc e where amendment will be
b enefic ial.
The p ro p o s ed revis ions to the current ordinanc e p ro vide greater c larification, flexibility and eas e of
ad ministration fo r s taff in managing p o licies and regulatio ns to mo re quickly res pond to issues and
concerns . Revis io ns inc lude:
1. Estab lis hment of p ark hours for p ublic us e. Currently, d awn to dus k c reates d ifficulty in
enforc ement s inc e there is no c lear determination of the definition of dawn o r dus k.
2. Clarific atio ns o n p ro hibited prac tic es to p ro vide b etter define authorized activities within City p arks .
Staff with the as s is tanc e of the Legal Department has reviewed the p ro p o s ed amendments and compared
to o ther munic ipalities to develo p the recommendatio ns.
This item was reviewed and was unanimous ly approved for recommend atio n to Counc il by the Parks and
Rec reation Ad vis ory Board at their meeting held o n Octo b er 11, 2018.
City Counc il ap p ro ved the first reading o n Oc tober 23, 2018 and the s econd read ing is s ched uled fo r
Novemb er 13, 2018.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, AMENDING CHAPTER 12.20 ENTITLED
“PARKS AND RECRETIONAL FACILITIES” OF THE CODE OF
ORDINANCES OF THE CITY OF GEORGETOWN TEXAS;
REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS;
INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Georgetown (“City Council”) recognizes
the importance of maintaining safe parks and recreational facilities for the general public to
enjoy; and
WHEREAS, the City recently developed and annexed Garey Park into the City of
Georgetown, which requires changes to the Chapter 12.20 to address Garey Park; and
WHEREAS, additional changes to Chapter 12.20 will provide greater clarification,
flexibility, and ease of administration in managing the City Parks; and
WHEREAS, the City Council has determined that it is in the best interest of the City
of Georgetown to amend Chapter 12.20 entitled Parks and Recreational Facilities.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, THAT;
SECTION 1. The facts and recitations contained in the preamble of this ordinance are
hereby found and declared to be true and correct, and are incorporated by reference herein
and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that
this ordinance complies with the Vision Statement of the City of Georgetown 2030
Comprehensive Plan.
SECTION 2. Chapter 12.20 of the Code of Ordinances of the City of Georgetown,
Texas is hereby amended in its entirety and shall provide as shown in EXHIBIT A.
SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.
SECTION 4. If any provision of this ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance which can be given effect without the invalid provision
or application, and to this end the provisions of this ordinance are hereby declared to be
severable.

SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This Ordinance shall become effective and be in full force and effect in

EXHIBIT A
CHAPTER 12.20. - PARKS AND RECREATIONAL FACILITIES
Sec. 12.20.010. - Definitions.
"City park" means any property in the City designated as a park, playground, recreational
facility, swimming pool or hike and bike path, and shall include buildings, parking lots and
driveways in such areas.
"Director” means the director of the City’s Parks and Recreation Department or
designee.
“Reserved Facilities” means an area of a City park which may be reserved for the
exclusive use of the reserving party and includes, but is not limited to, indoor and outdoor
facilities, pavilions, meeting rooms, gathering areas, classes, athletic fields and their adjacent
or support areas and facilities.
"U.S. Army Corps of Engineers Park Land" means any property within the City's
jurisdictional limits owned by the United States Army Corps of Engineers.
Sec. 12.20.020. - Fees and regulations for City parks.
The City Council authorizes the Director to establish usage fees, rental rates, and policies
and regulations governing the use of City parks. The Director shall provide the City Council
with an annual updated fee schedule for the City parks with a summary of changes adopted
during the previous year.
Sec. 12.20.025. – Compliance with law is condition of use of City parks.
Any person may use City parks for any lawful purpose; provided however, the use of
City parks shall be subject to compliance with all applicable provisions of this Code, state
and federal law, and the rules and regulations promulgated pursuant to Section 12.20.020.
Sec. 12.20.030. - Park Hours—Generally
A. City parks shall be open to members of the public between the hours of 5 a.m. and 10
p.m. unless other public use or hours have been posted for such City park or facility, a
lease or rental agreement exists allowing after hours use, or a permit has been issued
by the Director authorizing after hours use pursuant to rules and regulations
established in accordance with Section 12.20.020 of this Chapter.

B. It shall be unlawful for any person to remain within any City park or facility outside
of the hours designated or permitted for its use who fails to leave immediately after
being requested to do so.
Sec. 12.20.040. - Closure of City parks.
The Director may declare any City park, or part of any City park, closed to the general
public at any time and for any interval of time, either temporarily or at regular or stated
intervals.
Sec. 12.20.050. - Prohibited practices.
A. Golf Driving Range. It shall be unlawful to drive, pitch, hit or strike a golf ball in a
City park
B. Hunting, Bow Fishing. It shall be unlawful to hunt, or bow fish within City park
boundaries.
C. Glass Bottles. No person shall use or possess any glass beverage bottle in City parks.
This shall not apply to Garey House or wine and liquor bottles used in the Community
Center.
D. Cliff Jumping, or Diving. It shall be unlawful for any person to dive or jump from any
cliff or rock face in a City park. It shall be unlawful to knowingly, recklessly, or with
criminal negligence, cause any person to dive, jump or fall from any cliff or rock face
in a City park.
E. Commercial Business Activities. It shall be unlawful to conduct any commercial or
business activities of any kind for which any participation or admission fee is charged
or any revenue is otherwise derived in a City park unless otherwise authorized by
agreement with the City or by permit.
F. Animals. Except in the off-leash areas designated pursuant to Section 12.20.070, it
shall be unlawful to permit any dog to be in any City park, unless such dog is on a
leash no longer than six-feet. Other than dogs, animals are not allowed at any time
within City Parks except in authorized areas or as allowed by a permit issued by the
Director. Except as provided above, it shall be unlawful for any person to bring,
harbor, or release any other animal in City parks.
G. Reserved facilities. It shall be unlawful for any unauthorized person to enter a
reserved facility or are during the period of time the facility is reserved or to remain or
return to a reserved facility after being given notice to leave.

H. Motor Vehicles. It shall be unlawful for any person to operate, drive, or ride any
motor vehicles within a City park on a surface other than a road, street or parking lot.
This provision is not applicable to city motor vehicles, emergency vehicles, or motor
vehicles that have received a permit authorizing its operation.
I. Parking. It shall be unlawful for a person to park a motor vehicle, other than a city-
owned vehicle, within a City park at any place not designated as a parking area or
otherwise authorized by permit.
J. Disruption of Authorized Activity. It shall be unlawful for any person to knowingly
disrupt an authorized activity conducted in a City park and it shall be unlawful for any
person to remain in an area of a City park if the person’s behavior is disruptive and
the person is instructed to leave the property by a representative of Parks and
Recreation.
Sec. 12.20.060. - Special rules for U.S. Army Corps of Engineers Park Land.
A. The rules and regulations found in Title 36 United States Code "Parks, Forests, and
Public Property," Chapter III U.S. Army Corps of Engineers, Part 327 "Rules and
Regulations Governing Public Use of Water Resources Development Projects
Administered by the Chief of Engineers," as the same may be amended from time to
time, are hereby adopted and incorporated herein by reference for all purposes and are
applicable to the U.S. Army Corps of Engineers Park Land.
B. City personnel shall have the authority to enforce the rules and regulations adopted by
reference in Subsection A. of this Section on U.S. Army Corps of Engineers Park Land.
Sec. 12.20.070. - Off-leash dog recreation areas.
A. Off-leash dog recreation areas shall be established by the City Council in consultation
with the City's Parks and Recreation Board, and due consideration shall be given to
operational and animal regulation and care issues, including but not limited to:
1. Security measures to assure that the unleashed dogs remain contained within the dog
recreation area;
2. Control of noise and other potential nuisances that might affect nearby land uses;
3. Parasite control;
4. Feces control within the dog recreation area and feces runoff from the dog recreation
area; and
5. Provisions for dogs that do not participate in compliance with the applicable
regulations.

B. Dogs with two or more documented aggressive incidents in the off-leash dog recreation
areas shall be banned from off-leash dog recreation areas. If an owner takes a dog or
allows someone else to take a banned dog to an off-lease recreation area after receiving
notice of two or more aggressive incidents, the owner shall be in violation of this
provision.
1. Aggressive incidents are defined as a display of menacing or threatening behavior
including but not limited to a bite causing a wound, pierce or cut of a person or
another dog.
Sec. 12.20.080. - Violation—Penalty.
Any person violating any provision of this Chapter is deemed guilty of a misdemeanor,
and upon conviction thereof, shall be punished by a fine in accordance with the provisions of
Section 1.08.010. Each and every violation shall constitute a separate offense.

ITEM SUMMARY:
The o riginal c ontrac t fo r S an Gab riel Park – Phas e 2 c o nstruc tion with Ritter-Botkin P rime Co nstruc tion
was ap p ro ved on May 22, 2018 in the amount o f $3,619,690.90.
Maglin Site Furniture s up p lied the s ite furnis hings for San Gabriel Park – Phas e 1 and is spec ified for
Phas e 2. However, the furnishings were not inc lud ed in the o riginal c o ntrac t with Ritter-Botkin P rime
Cons tructio n. Adding thes e to the contrac t will ens ure continuity o f produc t as well as p ro vide efficiencies
in installation.
The o riginal VF W P ark p lans cons is ted o f a 144 s pac e parking lot. Ho wever, d ue to fund ing limitations 53
s p aces were removed from the original cons truc tion. Funding was allo cated in the F Y2019 Parks General
Capital Bud get to c omplete the ad d itional sp ac es and inc luding within Ritter-Botkin P rime Co nstruc tion
contrac t will allow this to b e c o mp leted economic ally and timely.
The Williamso n County Sherriff ’s Posse leas e has expired and they have pro vided a letter o f intent s tating
their plans to relo c ate to Jarrell. Additio nally, they have provid ed a s ched ule in whic h they will fully vacate
the rodeo arena by the end o f No vember. The p o rtion of the arena that are left from the S heriff ’s Po s s e
will b e removed. T he area will then be leveled and revegetated to allo w for o p en green spac e that c an b e
utilized for rec reation ac tivities and general p ark us e until San Gabriel Park Phas e 3 begins in 2020.
The d etailed c hanged o rd er will be p res ented at the meeting.

The meeting was called to order by Jim Hougnon at 6:00 pm.

C Parks and Recreation staff member introduction and presentation - Kimberly Garrett,
Parks and Recreation Director
Kimberly Garrett introduced Kerbie Dodd, Group Sales Coordinator for Garey House and she
started with the City prior to opening to start marketing and booking the Garey House. She
was working at an events venue prior to starting with the City that was similar as it was rural
and had similar guest counts. Kerbie Dodd started with the Garey House from the ground up
working on the website, social media and establishing pricing and contracts. She handles the
day to day for the house and the City has hired 3 temporary staff members that assist for
weddings as well. August 30th was the first event and we have now had 5 weddings and a
couple corporate and social events and up to a total of 40 booked weddings through May of
2020. 18 of those are this fall, through the end of 2018. It was asked if we are still offering the
discount. Kerbie Dodd stated the discount stopped the start of the fiscal year. There was an
open house on September 30th and the discounted pricing was offered there. It was a special
incentive if they signed on that day and new pricing started October 1st. There were 8 weddings
booked on the open house day. There were 200 that RSVP’d for that event. There were 72
brides out of the 200. There are scheduled, once a month open houses. There will be a vendor
open house every 3 – 4 months. In February, staff will be doing the Georgetown Bridal Show.
It was asked if there were any events booked other than weddings. She stated there was a team
building event and a couple of different board events. There have also been a few rehearsal
dinners and social parties. It was asked how the projections for revenue look. Kimberly Garrett
stated $144,000 was brought in and it was projected to bring in $225,000. She stated this was
good because we didn’t start charging admission until July 1st and then the weddings.
Originally, the park was to open in April. Eric Nuner stated that the opening and the charging
were pushed back. He stated we are getting much more in line with the numbers. Kimberly
Garrett explained that the accounting system actually gives us the money when the event

actually happens. It holds the money in an accounts receivable fund then when the event
happens it goes into the Garey Park revenue account. Kimberly Garrett stated she was pleased
with the number and in next year’s budget the revenue is set at $500,000. She stated the rentals
of the pavilions had done really well also. Kerbie Dodd stated that staff is starting to talk about
larger events where all the pavilions, the equestrian area and the meadow will book for events.
Staff with the gate house, Kerbie Dodd and Melissa Trahan-Pecorino will work jointly on these
events. It was asked about different programs being planned at Garey Park such as yoga.
Kerbie Dodd stated there are events scheduled and are starting with Yoga. Kimberly Garett
stated there will be a variety of programming for a variety of user. She stated the bird blind is
going in. Eric Nuner stated the Master Gardener’s statewide convention is this year in October
and they have 700 members. The blind will be complete prior to October 26th. There is also a
stargazing event in October. It was asked what Kerbie’s education background was. She went
to Tarleton State University and majored in public relations– event management and double
minored in business. Kerbie Dodd stated that part of her major was working events and they
had about 200 hours of working events. She stated they put on bridal shows. It was asked if it
is selling itself and Kerbie Dodd said some; but it does take a little of imagination because of the
style of the house and all the different spaces. She stated you have to paint the picture for them
more so than in other venues. It was asked about the photography at Garey House. Kerbie
Dodd explained there are 3 levels; professional photographer where they are charging someone
for their services or using the facility to promote their business they can do a free session in the
park areas, they can do a $50 session on the house grounds and a $75 session where they have a
site manager present where they can get inside and outside of the house. Entry fees are also
charged and it is recommended that they carpool. If they booked a wedding with Garey House
they get a one hour session free of charge. Kimberly Garrett stated a lot of parks have this and
it is becoming more common; it is private gain on a public space. Kerbie Dodd stated they have
to request the session so we know to expect them so there are no conflicts with other bookings.
It was asked about the usage of the facility outdoor vs. indoor events. Kerbie Dodd stated that 9
out of 10 want their ceremony at the terrace space under the pergola and as far as cocktails,
reception and dancing it is split depending on the guest count. It was asked how much
competition is in the area and if we see it growing. Kerbie Dodd stated she definitely sees it
growing. She stated that one thing that is unique about Garey Park is that currently in
Georgetown there are only a few venues like the Community Center and Chamber building
where it is not quite on the same level as the view and outdoor location. Most of the venues
that are established accommodate 200 – 300. She stated we are in our own ballgame in the
smaller venue and because we are smaller our prices are smaller too. That has been an
attraction and we are not competing with the other venues in Georgetown as they are in the
$6,000 - $8,000 range for the 300 – 400 people. It was asked if we advertise. Kerbie Dodd stated
we advertise online with Wedding Wire and the other is The Knot. We advertise in The Knot
magazine and Austin Wedding Day. The plan to advertise is to do a little print and a little
online. We also participate in the bridal show. It was asked if we set the hours for when the
event ends. Kerbie Dodd stated we let the renter choose the 10 hours between 8 am – midnight.

D Update from the Friends of Georgetown Parks and Recreation - Danelle Houck, Parks
and Recreation Advisory Boardmember
Danelle Houck stated there are ongoing plans for the Daddy Daughter Dance on Saturday,
October 27th from 7 pm – 9 pm. They are looking for volunteers. It was asked if the Friends of
Georgetown Parks and Recreation could attend a meeting so they can meet the board.
Kimberly Garrett stated that was a good idea and we will work to get the two boards together.
E Project Updates and Staff Report - Eric Nuner, Assistant Director of Parks and
Recreation
Eric Nuner reviewed the project update with the board. He stated the San Gabriel Park
Renovation is going well even with the recent flood. The columbarium is moving along.
Kimberly Garrett presented the fees to City Council and all went well with that. They wanted
to see a target finance balance as far as the fund to generate enough money for maintenance.
We will look into applying the new fees January 1, 2019. Eric Nuner stated they are still
evaluating the trail reconstruction. The parking lot at VFW is something that has been added to
the CIP budget and hope to do a change order with the existing San Gabriel construction
contract. Berry Creek Park, Kelly Park and 84 Lumber Park will either be renovated or
constructed this year. There will be public input on those 3 parks; there will be meetings with
these neighborhoods to get an idea what they are interested in.

F Consideration and possible action to recommend approval of a BuyBoard purchase of
playground equipment from GameTime of Fort Payne, Alabama, in the amount of
$161,298.93 for phase two of San Gabriel Park renovations. - Eric Nuner, Assistant Director of
Parks and Recreation
Eric Nuner stated this is the same vendor as the Phase 1 playground. He presented one of the
renderings of a playground. The purchase is through a purchasing cooperative. This has been
presented to legal to review the quotes and bids; they have given it approval. This is through
the capital improvement project budget. Eric Nuner showed some of the design features of the
playground.

G Consideration and possible action to recommend amending Chapter 12.20 of the City
of Georgetown Code of Ordinances, entitled Parks and Recreational Facilities. - Eric Nuner,
Assistant Director of Parks and Recreation
Eric Nuner stated the last ordinance was updated in 2012 and since that time there have been
quite a few changes such as the Garey Park opening. As of Tuesday, Garey Park was annexed
into the city limits. Now there is a current ordinance that is enforceable and Georgetown PD

can now patrol. Staff has been working with the legal department, animal control, and police.
Eric Nuner stated the primary thing was updating park hours. Currently, the park hours are
dawn to dusk with certain areas different hours. Legal stated it is best to set specific hours. As
there is no definition of dawn to dusk and PD could not enforce. Staff has set hours 5 am - 10
pm. If it is an authorized activity, permit or lease if you go beyond that is fine. We also have
the flexibility to set more stringent hours if they are posted. He stated as long as the hours are
posted a certain time then PD can enforce. There was a question about alcohol. Eric Nuner
stated we don't restrict alcohol in the parks but we do restrict glass beverage bottles with the
exception of Garey House. There was also discussion about smoking. Eric Nuner stated there
is a city ordinance that states you can restrict smoking in a city park if it is posted. Eric Nuner
stated some of the restrictions are park rules and are not by ordinance. Kimberly Garrett stated
that in this ordinance it gives the department the authority to set administrative rules. Eric
Nuner stated we are not going to come up with every rule nor do we want to come up with
every rule. We try to minimize it and we don’t want to see signs everywhere either.
