ITEM SUMMARY: The Gattis Tract is a 113.16 acre tract in the Southeast area of Georgetown and is proposing 365 units. The parkland requirement is 7.30 acres. They are proposing to dedicate two tracts of land to satisfy the requirement. One tract is centrally located and is 2.18 acres. The other tract is linear and is 11.6 acres. The total parkland dedicated would be 13.78 acres. The 11.6 acre tract has the ability to link with previously dedicated parkland in La Conterra. The developer is also proposing a private amenity center at the front of the property. The proposed park locations provide residents several options and are dispersed throughout the neighborhood. This tract is a regular subdivision and would just be dedicating land, no improvements. In addition, it was requested that the lots that are adjacent to the park have metal see through fences for safety and to not create a closed private area. Action is needed on the proposed parkland dedication. ITEM SUMMARY: Cole Estates is located on Hwy 29 east of Georgetown. It is in the ETJ, not the city limits. They are proposing 208 units which is 4.16 acres of parkland. This development is along the South San Gabriel River. The proposal is to provide parkland along the river which would include the flood plain and an area outside the floodplain. This is desirable for future trail connectivity. This subdivision is a traditional subdivision so land dedication would satisfy the requirement. There are adjacent MUD developments that will be building future. The land proposed is not adjacent to the first phase so there would need to be fiscal surety provided to the City to insure paved street access to the parkland at some point. In addition, there would be an easement created to allow for maintenance. Action is needed on the proposed item. ITEM SUMMARY: Renovations to VFW Park were identified as a need through the Parks Capital Improvement Plan (CIP) in 2013/14. Being over 30 years old, this park has only had minor renovations over the years. There is a great potential to have a tournament style girls softball complex in Georgetown thus increasing sports tourism through this renovation. Renovations include lighting, restroom and concession, parking, and field redesign. Sealed bids were received for the construction contract on February 2, 2016 at 2:00pm. Staff is currently evaluating these bids and will present to the board at the meeting for recommendation. This item will then be forwarded to City Council for their approval at the February 23th meeting. FINANCIAL IMPACT: Funds for this project will be paid for out of the 2008 Park Bonds that were issued in May 2013. ITEM SUMMARY: Through the Buy Board, the City will contract with Musco Lighting for the materials and installation of ballfield lighting for three (3) 200’ youth softball fields at VFW Park. McMasters Athletic Complex has Musco Lighting and the addition of VFW to the current system of operation will provide continuity of services for the operation and light monitoring system. FINANCIAL IMPACT: This item will be funded from the parkland dedication fund. ITEM SUMMARY: Chapter 42 of the Texas Human Resource Code is established to regulate certain facilities, homes, and agencies that provide child care services. The purpose of this chapter is to protect children who are cared for in child care facilities by establishing statewide minimum safety standards and by regulating the facilities through a licensing program. The Department of Family and Protective Services (DFPS) is the agency tasked with enforcement of this law. Subchapter C. Sec 42.041, (b), (14) exempts: “Elementary-age (ages 5-13) recreation programs operated by a municipality provided the governing body of the municipality annually adopts standards of care by ordinance after a public hearing for such programs, that such standards are provided to the parents of each program participant, and that the ordinances shall include, at a minimum, staffing ratios, minimum staff qualifications, minimum facility, health, and safety standards, and mechanisms for monitoring and enforcing the adopted local standards; and further provided that parents be informed that the program is not licensed by the state and the program may not be advertised as a child-care facility.” This ordinance establishes the standards of care requirements set forth by Chapter 42 of the Texas Human Resource Code after a public hearing. The standards are intended to be minimum standards by which the Georgetown Parks and Recreation Department will operate its youth recreation programs. These programs are recreation in nature and are not child care programs. The Georgetown Parks and Recreation Department previously developed similar department minimum standards for recreation programs. Therefore, the minimum standards set forth in Exhibit A will create no additional staffing or financial burden to the City. Additionally, it will not impact the effected recreation program fees. This ordinance was first adopted in 2015. It expires one year after its effective date and must be submitted to City Council for re-adoption no later than April 1st of each year. Sec. 8.40.010. - Definitions. A. “Camp Program Staff” means a person responsible for the direct care or supervision of participants, including volunteers and contractors. The term excludes a person whose primary duties include administration, clerical support, or facility maintenance. B. “Department” means the Parks and Recreation Department. C. “Director” means the director of the Parks and Recreation Department. D. “Designee” means a person appointed by the director to act on the director's behalf. E. “Facility” means a building or improvement operated or used by the department in conducting a recreational program. F. “Participant” means a child age 5 to 13 years old that is enrolled in a recreational program and is under the supervision of department staff. G. “Recreational Program or Program” means a fee-based children's program or activity offered and supervised by the department that requires a participant to enroll or register to participate. H. “Staff” means a person who is employed by the department to work in a recreational program. I. “Parent” means legal guardian of a participant. Sec. 8.40.020. - Purpose. The purpose of the standards of care established in this chapter is to exempt City of Georgetown after-school and summer recreation programs from state licensing requirements. The standards of care set forth in this chapter are intended to be the minimum standards by which the Georgetown Parks and Recreation Department will operate its youth recreation programs which are recreational in nature and not designated as child care programs. Sec. 8.40.030. - Participant and Camp Program Staff Ratios. A. Camp programs shall have no greater than a 10/1 ratio of participant to camp program staff for children 0-4 years of age. B. Camp programs shall have no greater than a 15/1 ratio of participant to camp program staff for children 5-9 years of age. Page 15 of 23 Page 2 of 4 C. Camp programs shall have no greater than a 17/1 ratio of participants to camp program staff for children 10-13 years of age. D. Each participant should have a program employee who is responsible for him or her and who is aware of details of the participant's habits, interests, and any special problems as identified by the participant's parents during the registration process. Sec. 8.40.040. - Minimum Camp Program Staff Qualifications. A. Camp program staff must be at least 16 years of age. B. At least 50% of camp program staff must possess certification from a nationally recognized body in 1. First Aid 2. Community CPR or equivalent C. Camp program staff must complete a camp program staff orientation including but not limited to: 1. An overview of the City of Georgetown’s Standards of Care; and 2. Policies including discipline, guidance, and the release of participants; and 3. An overview of symptoms of child abuse, neglect, and sexual abuse and the responsibility of reporting these; and 4. The procedures to follow in handling emergencies including but are not limited to: fire, explosion, tornado, toxic fumes, volatile persons, and severe injury or illness of a child or adult; and 5. The use and locations of fire extinguishers and first aid equipment. Sec. 8.40.050. - Employment Restrictions A. Criminal background checks will be conducted on prospective camp program staff. The following convictions, including deferred adjudication and pretrial diversions, regardless of when the conviction occurred will render applicants ineligible for participation with Georgetown Parks and Recreation Camp Programs: 1. Any drug distribution activity, including misdemeanor or felony 2. Rape 3. Aggravated Assault 4. Child Abuse or Molestation 5. Murder 6. Kidnapping 7. Or any other felony or crime involving moral turpitude, which involves acts of physical violence B. The following convictions within 10 years from the date of application for employment will render applicants ineligible for participation with Georgetown Parks and Recreation Camp Programs: 1. Any drug related activity, including misdemeanor or felony 2. Assault Page 16 of 23 Page 3 of 4 3. Any other felony or crime involving moral turpitude which does not involve acts of physical violence Sec. 8.40.060. - Minimum Building Standards. A. The facility and equipment used do not present any known fire, health, or safety hazards and are kept free of accumulations of objectionable debris. B. The facility shall be subject to an annual safety inspection. C. The facility shall reasonably be kept free of insects, rodents, and stray animals. D. Facility buildings shall maintain clearly marked emergency exits. E. A disaster and evacuation procedure shall be posted at the facility. F. First-aid kits and infection control kits shall be available at the facility and taken to other locations at which the participants are engaged in program activities. G. First-aid guidelines shall be on file and available at the facility. H. The facility shall have a sufficient number of restrooms maintained in good repair and equipped for independent use by children and designed to permit staff supervision as needed. Sec. 8.40.070. - Minimum Health and Safety Standards. A. A participant who is ill or injured shall be supervised until the participant is released to a parent or other authorized person. B. A participant whose illness or medical condition requires a degree of supervision by staff that would compromise the health or safety of the other participants shall be kept separate from the other participants until the participant is removed from the facility. C. A participant whose illness or medical condition prevents the participant from comfortably participating in program activities or places other participants at risk may not be admitted or readmitted to the facility for the duration of the illness or condition. D. A staff member may not administer medication to a participant without a written parental medication authorization. Staff may not knowingly administer medication that is not in its original container or that is past the expiration date on the container. E. A staff member may not administer an amount of medication that is inconsistent with the prescribed dosage and parental direction. A staff member shall return the unused medication to the parent on the last program day. F. Medication should be kept in a secured location that is not accessible by participants. Page 17 of 23 Page 4 of 4 G. A staff member shall maintain a medication and first aid log. Sec. 8.40.080. - Mechanisms for Installing and Enforcing Standards. The director or designee shall monitor the camp programs for performance. Compliance with these standards will be a factor in rating the performance of the youth program. Sec. 8.40.090. - Review. This Chapter will expire one year after its effective date. Sec. 8.40.100. - Recommendation for Amendment or Re-Adoption. No later than April 1 of each year the director or designee shall recommend to the City Council adoption of the local standards of care. WHEREAS, the City's Parks and Recreation Department has determined that certain minimum standards of care are necessary to health, safety, and welfare of individuals participating in youth recreation programs; and WHEREAS, the State of Texas Human Resources Code Chapter 42 exempts certain after-school and summer recreation programs from state licensing requirements as identified in Subsection 42.041(14) stating “an elementary-age (ages 5-13) recreation program operated by a municipality provided the governing body of the municipality annually adopts standards of care by ordinance after a public hearing for such programs, that such standards are provided to the parents of each program participant, and that the ordinances shall include, at a minimum, staffing ratios, minimum staff qualifications, minimum facility, health, and safety standards, and mechanisms for monitoring and enforcing the adopted local standards; and further provided that parents be informed that the program is not licensed by the state and the program may not be advertised as a child-care facility;” and WHEREAS, the City Council, at a meeting on February 23, 2016, held a public hearing prior to adopting Chapter 8.40 of the Code of Ordinances regarding Standards of Care for Youth Recreation Programs; and WHEREAS, the City Council of the City of Georgetown finds it to be in the best interest of the citizens of Georgetown to adopt Chapter 8.40 of the Code of Ordinances regarding Standards of Care for Youth Recreation Programs. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GEORGETOWN, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. SECTION 3. Chapter 8.40 of the Code of Ordinance of the City of Georgetown is hereby amended in its entirety and shall provide as show in Exhibit “A.” SECTION 4. All ordinances and parts of ordinances that are in conflict with this ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective in accordance with the provisions of state law and the City Charter of the City of Georgetown. College Street, Georgetown, TX 78626. Regular Session – To begin no earlier than 6:00 pm. Parks and Recreation Board may, at any time, recess the Regular Session to convene an Executive Session at the request of the Robert Johnson for any purpose authorized by the Open Meetings Act, Texas Government Code Chapter 551.) Regular Session A Call to Order The meeting was called to order by Robert Johnson at 6:00 pm. B Roll Call Robert Johnson, Keith Fruge, Katherine Kainer, Glen Holzer, Bob Palko Absent: Chuck Bridges and Jason Shurley absent Staff: Kimberly Garrett, Eric Nuner, Jill Kellum C Introduction of David Morgan, City Manager David Morgan was unable to attend the meeting. D Project updates for Garey Park, Westside Park, San Gabriel bank stabilization, San Gabriel Park improvements, VFW Park, Williams Drive Pool, Parkland Dedication, Emerald Springs Park, and staffing updates Kimberly Garrett presented the project updates to the board. E Update from the Friends of Georgetown Parks and Recreation Kimberly Garrett stated they did not meet in January. They will meet February 1st. The sand table has not been installed but will be installed soon. F Update on the parks projects presentation at the January 12th City Council Meeting Kimberly Garrett explained that staff presented the parks projects to the council at the January 12th meeting. On January 26th, staff will take back the 1st amendment on the MOU for Mr. Garey. They also discussed the Williams Drive Pool renovation and the San Gabriel Bank Stabilization which both passed on consent agenda. Legislative Regular Agenda G Discussion and possible action on approving the parkland dedication proposal for Kasper MUD Kimberly Garrett had Mark Baker with SEC Planning present information. Mark Baker with SEC Planning, Chris Kasper, owner of property and Sophia Nelson, Planning Director for the City of Georgetown were present to answer questions. Kasper MUD is a proposed MUD development in the Southwest part of Georgetown. They are proposing 775 units which equates to 15.5 acres of parkland. They are proposing Page 21 of 23 to set aside and dedicate 22.5 acres. As part of a MUD, they must go above and beyond the parkland dedication requirements in the UDC. They are proposing an 8 foot wide concrete trail throughout the property with improved linear parks. This trail could potentially connect up to future development in the area. In addition, there will be a playground open to the public adjacent to the amenity center which is centrally located in the subdivision. The MUD/HOA will maintain the parks and trails. This development is in close proximity to Woodhull MUD aka Saddlecreek MUD. The Parks Board approved the parkland for this development in February 2015. Motion made by Bob Palko, second by Keith Fruge to approve the parkland dedication proposal for Kasper MUD as presented. Approved 4 – 1 (Glenn Holzer) H Presentation, discussion and staff direction on proposed updates to the Parkland Dedication Ordinance Kimberly Garrett stated staff has been working with the Planning Department on revising the Parkland Dedication Ordinance. The revisions come from work the Parks and Recreation Board subcommittee did, as well as suggestions from the planners and staff. The Parkland Dedication Ordinance was last revised in 2003 when the Unified Development Code was created. Topics for proposed changes include: •Allow partial credit for private parks •Increase Fee in Lieu of land dedication •Implement a parkland improvement fee or the option to make improvements •Reduce the number of zones •Make changes to the allowable credit for floodplain •Address parks in the ETJ as private parks •Create incentive for commercial development to dedicate parkland •Require developer to build regional trail as detailed on trails master plan •Address phasing and how it relates to parks not dedicated in the first phase •Decrease land requirement from 1 acre for 50 units to 1 acre for 75 units Staff will also present proposed changes to the UDC Advisory Board on January 19th. Staff is drafting language to address these issues and will bring proposed changes to the board for review in the upcoming months.
