The main purpose of the meeting was to make introductions and go over the schedule for the project. The schematic design was completed in March 2015 and presented to City Council. The next step in the process will be to work on Design Development and then move into Construction Plans. Currently the City Council has a placeholder in the budget to sell $3M of the 2008 Park Bonds related to Garey Park construction in the Spring of 2016. Halff has begun development of the traffic impact study to determine the traffic impacts of the park to the surrounding area. Westside Park – The Geological Assessment for Westside Park has been completed. The master plan is scheduled to be presented to the Parks Board in October and to the City Council in late October. San Gabriel Bank Stabilization – The project is currently waiting for clearance from the Texas Historical Commission due to the historic wall along the river. Once the clearance is received from the THC, the project can be bid out and construction can begin. No change is status. San Gabriel Park – Approval of a task order to RVi for services to prepare design plans for phase one of the San Gabriel Park improvements will be presented to Parks Board in September. The San Gabriel Park Master Plan was very well received by the City Council during the June 23, 2015 meeting. The proposed 2015/2016 budget includes the sale of $1.7 million in bonds for the project. There is $1M in bond funds in the current budget to begin the design. VFW Park – Construction plans are being finalized for the redevelopment of VFW Park. Bidding is scheduled to begin in October. Approval of a construction contract is anticipated to be brought to parks board in November with construction scheduled to start in December. The improvements to 2nd Street are currently underway. Village Parks – Construction on Madrone Park and Rowan Park in the Georgetown Village are almost complete. The parks staff is currently completing the installation of the playgrounds. Williams Drive Pool – Construction plans are almost finalized. Bidding will be in October with the construction contract coming to Parks Board in November. Parkland Dedication Ordinance Update – Staff has been working with the Planning Staff on updating the ordinance based on the recommendations from the subcommittee. No change in status. San Gabriel Park Pedestrian Bridge Repair – Staff has begun fabrication the decking. Decking is anticipated to be installed the week of Labor Day with concrete being completed the following week. Emerald Springs Park – Renovations are underway to improve ADA accessibility to the park. Two new play structures are being installed as well. Completion is anticipated for November. Page 9 of 29 Staffing Updates – Addison Elliott accepted the Special Events and Marketing Coordinator and begins on September 8. Staff is currently interviewing for the selection of the recreation supervisor, aquatic supervisor, and recreation maintenance specialist. ITEM SUMMARY: The master plan for San Gabriel Park was completed by RVi in June 2015. In order not to impact the entire park at one time, improvements are proposed in phases. This scope includes the schematic design for both phase one and two of the park. Also included is a topographic survey of the park and geotechnical investigations. Phase one design and construction is estimated to be complete by Fall of 2017. Improvements to San Gabriel Park were included in the 2008 parks bond. FINANCIAL IMPACT: Funds for this project are included in the 2014/2015 budget with proceeds from the 2008 Park Bonds that were sold in May 2013. SCOPE OF SERVICES 1.1 RVi proposes to provide professional design services for San Gabriel Park Improvements. RVi prepared the San Gabriel Park Master Plan, completed in July 2015, which will serve as a basis for this project. The plan included a phased implementation plan showing park improvements divided into four phases. The scope for this proposal will include schematic design for Phases 1 and 2 and full design services (design development, construction documents and construction observation) for Phase 1 improvements. The attached exhibit shows the approximate limits of each phase. The park improvements will include entry monumentation, roadway and parking improvements, picnic and barbeque pavilions, trails and trailheads, children’s play areas, restoration of the existing springs, restrooms, signage, open spaces and landscaping. 1.2 The City has a project budget for planning, design and construction of $2,700,000. 1.3 The Consultant will hire the services of the following sub consultants in the performance of this contract and the feel for the sub consultants: Kasberg, Patrick & Associates – Civil Engineers Clayton & Little Architects Cambrian Environmental Jaster – Quintanilla & Associates – Structural Engineers AYS Engineering, LLC - MEP Engineers EWM – Irrigation Inland Geodetics – Surveying Terracon – Geotech 1.4 The City will determine the limits for the Phase 1 improvements at the completion of the Schematic Design Phase. Phase 1 improvements will be designed, permitted and constructed as a single phase. 2. BASIC SERVICES The Consultant shall provide, for the Basic Fee plus reimbursable expenses, services described in the following phases. 2.1 SCHEMATIC DESIGN SERVICES 1. Compile and review site data and conduct site visits to collect pertinent knowledge of the land, its condition and context. b. The Schematic Design may include initial plan, section and elevation drawings, illustrating the general scope, scale and relationship of the landscape architectural elements. A maximum of three design iterations are included. c. The following site and landscape improvements will be considered in the Schematic Design: Picnic Pavilions – 3 sizes; Barbeque Pavilion; Restrooms – 2 sizes; Children’s play areas; Restoration of springs; Roads, parking and service areas; Pedestrian circulation; Grading and drainage; Stormwater convergence alignments; Stormwater quality elements; Preservation of existing trees, drainage ways and other features to be left undisturbed; Site signage and graphics; Exterior planting: trees, shrubs, groundcover accent planting, lawns; Irrigation; Special paving materials for vehicles and pedestrians; Site furnishings 2. At Client’s direction, coordinate with other City Departments concerning property boundaries, mechanical equipment and utilities in relation to project components. 3. Define regulatory requirements to complete the project. 4. Develop stormwater calculations for the project. 5. Prepare an opinion of probable cost for the construction based on the approved schematic design and other selections made by Client. Consultant may include escalation factors and contingencies. 6. Present schematic design to Parks Board and incorporate comments. 7. Present Schematic Design to City Council. Review schematic design and opinion of probable costs with Client and identify limits of Phase 1 for the Project. Obtain Client approval and authorization to proceed with Phase 1. 9. Meetings for this phase are limited to six. 2.2 DESIGN DEVELOPMENT SERVICES 1. Based on the Schematic Design approved by the Client, Consultant will prepare Design Development Drawings for the Phase 1 of the Project. a. The Design Development Drawings shall include plans, sections, elevations and typical details to fix and describe the size and character of the components approved by the Client for further design. b. The Design Development Drawings will establish major materials and finishes, coordination with mechanical, plumbing and electrical systems. c. The Design Development Drawings and all subsequent phases shall be limited to those components approved by the Client in the Schematic Design phase. 2. At Client’s request, prepare refined studies of all items, detailing the architectural design in terms of size, appearance and materials. 3. Prepare an opinion of probable cost for the construction based on the Design Development Drawings. Consultant may include escalation factors and contingencies. 4. Regulatory Agency Preliminary Review for structures: Presentation to design development documents to local fire building code review authorities. Provide response to comments. 5. Review design development drawings and opinion of probable cost with the Client for approval and authorization to proceed. 6. Meetings for this phase are limited to four. 2.3 CONSTRUCTION DOCUMENT SERVICES 1. Based on the Design Development Drawings approved by the Client, prepare Construction Documents for the project components. The Construction Documents shall include: a. Specifications that identify the materials, equipment, workmanship and quality standards (or performance criteria), for components. c. Provide BIM Revit model with a level detail (LOD) for architectural elements similar to LOD300. Mechanical, Electrical, Plumbing and Structural elements are not included as a part of the architectural model and are outside this scope of work. d. Prepare overall demolition plan identifying the existing elements located in the park that will be removed. e. Prepare erosion control layout plan detailing location of erosion control elements and types of erosion controls to be utilized. f. Develop design for proposed stormwater quality elements based off the existing impervious cover versus proposed impervious cover and design for stormwater conveyance. g. Prepare plan and profile for proposed street improvements horizontally and vertically. h. Prepare irrigation plan for establishment of proposed plantings. Development of alternative water source for irrigation system will be an additional service. i. Engineering Construction Documents will include design of power, lighting, waste, water and vent to accommodate architectural layout. No HVAC design is anticipated for this project. 2. Prepare an opinion of probable cost based on the Construction Documents. Consultant may include escalation factors and contingencies. Opinions of cost are based on the experience and judgment of Consultant and are merely opinions. Consultant does not warrant that actual costs will not vary from those opinions because, among other things, Consultant has no control over market conditions. 3. Review the construction documents and opinion of probable cost with the Client for approval and authorization to proceed. 2.4 REGULATORY SERVICES 1. WPAP Plan – Prepare WPAP plan for the Edwards Aquifer Recharge Zone and submit proposed plan to TCEQ for approval. b. City of Georgetown Permitting – Prepare required documentation to obtain permits from the City of Georgetown including up to three meetings with the City’s Adaptive Management Working Group. It is anticipated that permitting will be through the City of Georgetown process. Should USFW or USACE permitting be required it will be additional services. c. Submit to TDLR Registered Accessibility reviewer for review and respond to comments. d. Review THC requirements and submit information required. Additional studies or investigations if required will be additional services. 2. As requested by Client, and as is reasonably necessary to assist Client in responding to permitting issues, participate in the permitting process with respect to the project design, including: a. Evaluate and respond to governmental staff review and comments; b. Confer with governmental authorities with regard to project components to verify interpretation of ordinances, statutes and regulations; c. Attend public hearings to address issues; d. Review with the Client design modifications requested by applicable governmental authorities as they apply to project components, and at Client’s direction, modify the design accordingly for re-submission; e. Meet with government authorities following permitting, and review construction procedures for landscape components. 3. Anything in this Agreement to the contrary notwithstanding, Client agrees that Consultant’s services in relation to any and all accessibility standards, guidelines and requirements set forth by local, state and/or federal authority are strictly limited to: 1) submitting the construction documents to the appropriate governmental authority (or its authorized agent) as required for review and approval prior to construction; and 2) modifying those portions of the construction documents that are specifically identified by such governmental authority (or its agent) during the pre-construction review as being in need of correction. If requested, the Consultant, following the Client’s approval of the Construction Documents, will assist the Client in obtaining bids and in awarding contracts for construction for the Project. 2. The services that may be provided in this phase include: a. Attending pre-bid conference; b. Assisting the Client in qualifying bidders; c. Issuing bidding documents; d. Preparing addenda to the Construction Documents; e. Attending bid opening; f. Evaluating bids; g. Assisting in preparing a Construction Contract Agreement between the Client and contractor; h. Distributing required sets of Contract Documents. 2.6 CONSTRUCTION OBSERVATION PHASE SERVICES 1. Consultant shall, as part of the Basic Services, visit the site at Client’s request to observe particular portions of the work identified by the Client and to answer questions from the Client as to whether those identified portions are, in general being performed in accordance with the Construction Documents. Consultant may also visit the site periodically to determine whether the completed construction portions of the work is in general conformance with the aesthetic intent of the Construction Documents. The Consultant will not be required to make exhaustive or continuous on-site observations to check the quality or quantity of the work. The total number of all such Client-requested, and periodic, visits included in the basic services is 20. 2. Perform the following services as they relate to project components: a. Attend pre-construction conference; b. Respond to Requests for Information; c. Assist Client in preparing work descriptions for Change Orders; e. Assist Client in reviewing applications for payment from contractor; f. Assist Client in preparing progress memoranda. 3. Assist Client in conducting a Final Observation of the Project to determine, in general, whether the items contained on the punchlist have been completed or corrected and are in general conformance with the aesthetic intent of the Construction Documents. 4. The Construction Observation Phase will terminate when final payment to the contractor is due, or in the absence of a final Certificate for Payment, sixty days after the Date of Substantial Completion of the Work, whichever occurs first. 3. SURVEYS 1. Surveying – The project will consist of providing topographic surveys for Phase I and Phase II of the project. The total acreage of survey is estimated to be approximately 80 acres. The survey will include tying down all existing park elements, existing tree identification, spring locations, drainage channels/ways, edge of bank for the north side of the San Gabriel River, East Morrow Street, and other elements located within these boundaries. The survey will identify existing utilities and identify the existing contours in order to perform the engineering design. 2. Geotechnical – This element shall consist of performing bored and testing on the material to develop a pavement design for East Morrow Street and the proposed parking lots. Bores will also be performed near the restroom facility in order to develop a proposed foundation design for the facility. 4. ADDITIONAL SERVICES All services requested by the Client that are not listed in Article 2 of this Agreement are considered Additional Services. Additional Services are not included in the Basic Fee, and shall be paid for by the Client as set forth in Article 5.2 of this Agreement. 4.1 Additional Services include, without limitation, the following: 1. Revisions to drawings previously provided by Consultant due to: changes in the Project’s scope, budget or schedule; instructions that are inconsistent with written approvals or instructions previously given; or enactment or revision of codes, laws, or regulations subsequent to the preparation of such documents; 2. Public or other presentations beyond those described in Basic Services; 4. Site visits in excess of the quantity of visits stipulated in Construction Phase Services and/or providing prolonged administration of construction contract should the construction contract time be exceeded by more than sixty (60) days through no fault of the Consultant; 5. Additional site visits following the Final Observation; 6. Consultation and other services, including site visits and construction warranty matters, following issuance of the final Certificate for Payment to the contractor, or in the absence of such certificate, more than sixty (60) days after the Date of Substantial Completion of the work; 7. Review and processing of permits, approvals and ordinances with agencies or municipalities having regulatory controls over the development not described in Basic Services; 8. Preparation of information required by this Agreement to be provided by the Client; 9. Providing services to investigate existing conditions and to make measured drawings hereof, or to verify the accuracy of drawings or other information, including survey information, furnished by the Client; 10. Preparing drawings, specifications, supporting data and providing other services in connection with change orders to the extent that the adjustment in the basic compensation resulting from the adjusted construction costs is not commensurate with the services required of the Consultant, providing such change orders are required by causes not solely within the control of the Consultant; 11. Providing consultation concerning replacement of any work damaged by vandalism or other cause during construction and furnishing services as may be required in connection with the replacement of such work; 12. Providing services made necessary by the default of the contractor, or by major defects or deficiencies in the work of the contractor; 13. LEED or Sustainable SITES application, research, documentation, and certification services; 5. INFORMATION TO BE PROVIDED BY CLIENT 5.1 Client shall provide, in a timely manner, all criteria and full information regarding Client’s Page 20 of 29 Project Name Date: Page: 9 of 12 C:\Program Files (x86)\neevia.com\docConverterPro\temp\NVDC\B3E5429A-DFDD-4111-AEF4- 23696317944B\PDFConvert.16876.1.Professional_Service_Agreement_(Design)_Part_I.doc requirements for, and limitations on, the Project, including without limitation: 1. Legal description and to-scale boundary survey of the property; 2. All deed restrictions and covenants; 3. Environmental analysis and surveys, including endangered species presence and/or habitat and known City of Georgetown environmental features; 4. CAD files, as appropriate and available, in an AutoCAD format to be mutually determined; 5. Existing or pending municipal, county, state and federal permits or approvals, and other pertinent information as required during the process; 6. Financial/economic information setting forth the budget limitations for the Project; and 6. COMPENSATION 6.1 BASIC SERVICES The Client shall compensate the Consultant as follows: Consultant’s compensation shall include the lump sum of $461,691.00 dollars for Basic Services (the “Basic Fee”), plus the total for surveys for a lump sum of $94,735.00 and the total for Additional Services performed on an hourly basis at the rates set forth in Section 6.4, plus reimbursable expenses as set forth in Section 6.5. Consultant’s total compensation for Basic Services shall be allocated among the various phases of the Project as set forth below, and will be billed monthly based on percent of work complete for each phase of the Project, along with Additional Services and reimbursable expenses incurred during the billing period. The amounts indicated do not include amounts resulting from substantial change in scope of the Project or services. Fees for Additional Services will be included as a separate item on the monthly billing statement. 6.3 INVOICING AND PAYMENT Consultant will invoice Client monthly for Basic Services and Additional Services performed, and for reimbursable expenses incurred in accordance with the Terms and Conditions of this Agreement. Amounts invoiced are due and payable thirty days following the date of the invoice, at the office of RVi, 712 Congress Avenue, Suite 300, Austin, Texas 78701. Amounts remaining unpaid sixty days following the date of the invoice shall bear interest at the rate of 12.0% per annum, or at the maximum legal rate allowable, which shall be calculated from the date of the invoice. In no event shall Consultant’s failure to bill monthly constitute default under the Terms and Conditions of this Agreement. Consultant retains the right to halt work pending receipt of any overdue payments, and the right to withhold delivery of final work product if Client does not comply with the payment terms above. Client shall pay all costs and expenses, including without limitation, reasonable attorney’s fees and expenses incurred by RVi in connection with the collection of overdue accounts of Client. 6.4 HOURLY RATES The following hourly rates shall apply to the fees described herein and any additional services requested of the Consultant. Regular Session A. Call to Order The meeting was called to order by Robert Johnson at 6:04 pm. B. Roll Call Robert Johnson, Keith Fruge, Katherine Kainer, Jason Shurley, Chuck Bridges, Robert Palko, Glenn Holzer C. Update from the Friends of Georgetown Parks and Recreation Kimberly Garrett stated the Friends of Georgetown Parks and Recreation will have a planning meeting on August 31st and their annual meeting will be on September 28th. The annual meeting will be at 7 pm at the Parks and Recreation Administration Community Room. They are also working with the Parks and Recreation Department on obtaining the sand table. D. Update on Downtown Boards Quarterly Meeting. Kimberly Garrett and Keith Fruge attended the quarterly downtown boards meeting. The downtown related board chairs and staff meet to discuss items related to downtown. Boards included in the discussion are Arts and Culture, Mainstreet, CVB, HARC, Parks and Recreation, Library and other non-profits in the downtown. This item is to update the board on the collaborations of all these different groups. The parking lot across from the library is beginning construction and will have 150 spaces. There have been 2 public meetings. The next downtown boards quarterly meeting will be in October. E. Project Updates for Garey Park, Westside Park, San Gabriel Bank Stabilization, San Gabriel Park Master Plan, VFW Park, Village Parks, Williams Drive Pool, Parkland Dedication, Intern Final Report and Staffing Updates Garey Park – A kick-off meeting was held on Thursday, August 6, 2015, with staff and the Halff Associates Team. The main purpose of the meeting was to make introductions and go over the schedule for the project. The schematic design was completed in March 2015 and presented to City Council. The next step in the process will be to work on Design Development and then move into Construction Plans. Currently the City Council has a placeholder in the budget to sell $3M of the 2008 Park Bonds related to Garey Park construction in the Spring of 2016. Page 27 of 29 Westside Park – The Geological Assessment for Westside Park has been completed. The master plan is scheduled to be presented to the Parks Board in September and to the City Council in October. The native plant society recently held a field trip to Westside Park. Once the clearance is received from the THC, the project can be bid out and construction can begin. San Gabriel Park Master Plan – Staff is currently working RVi on a scope of services to prepare design plans for phase one of the San Gabriel Park improvements. The San Gabriel Park Master Plan was very well received by the City Council during the June 23, 2015 meeting. The proposed 2015/2016 budget includes the sale of $1.7 million in bonds for the project. There is $1M in bond funds in the current budget to begin the design. VFW Park – Construction plans are being finalized for the redevelopment of VFW Park. Bidding will be in September. Construction is scheduled to start in November. The improvements to 2nd Street are currently underway. Village Parks – Construction on Madrone Park and Rowan Park in the Georgetown Village are almost complete. The parks staff is currently completing the installation of the playgrounds. Williams Drive Pool – Construction plans are almost finalized. Bidding will be in September with the construction contract coming to Parks Board in October. Parkland Dedication Ordinance Update – Staff has been working with the Planning Staff on updating the ordinance based on the recommendations from the subcommittee. Intern Final Report – Melodie Coleman, our summer intern, completed her internship on Friday, August 7th with the Pirate Party. She created a website as part of her final project. http://colemanmelodie.weebly.com/ Staffing Updates – Parks and Recreation has had some staffing changes. Robert Gaylor was promoted to Recreation Superintendent, Glenn Moss is now the Athletic Supervisor, Stephanie Darimont has resigned to take a job with the American Red Cross, staff is interviewing for the Special Events and Marketing Coordinator and Dave Melaas started in July as the Project Manager for Parks and Recreation. Additional – Walk across bridge will begin construction the end of August. The Boy Scouts cleaned the debris by the walk across bridge. Legislative Regular Agenda F. Consideration and possible action to recommend approval of interlocal agreements with GISD and local charter schools for recreational programming. In order for one local government to contract with another local government for service, an interlocal agreement must be in place. The Parks and Recreation Department works with GISD and various charter schools in the area. Under the agreements, the City will charge for service provided. Generally services include tennis instruction, facility rentals, memberships, camps and outdoor programming. These agreements will be forwarded to City Council for approval.
