College Street, Georgetown, TX 78626. Regular Session (This Regular Session may, at any time, be recessed to convene an Executive Session for any purpose authorized by the Open Meetings Act, Texas Government Code 551.) A Call to Order Scott Macmurdo called the meeting to order at 4:37 pm. B Roll Call Scott Macmurdo, Katherine Kainer Absent: Jim Hougnon Staff: Kimberly Garrett, Jill Kellum C Discussion on proposed changes to the UDC regarding Parkland Dedication. Kimberly Garrett stated Sophia Nelson, Planning Director, will work with her on this project. Sophia Nelson said that the UDC committee also questioned the floodplain and private park issue and they asked how they would enforce it. Sophia Nelson also recommended to Kimberly Garrett to get some feedback from the City Manager and Assistant City Managers before going too far in this process. The City Managers and department heads meet every other week with and the next meeting is April 2nd. On April 14th Kimberly Garrett can update the parks board on the direction of the City manager’s office. Sophia Nelson also suggested going to the City Council workshop on May 8th and they can provide direction. We will present the recommendations from the UDC and City Manager’s office. Kimberly Garrett stated with the fees in lieu of land she is re-reading other city’s ordinances and looking at justification for fees and she suggested using the cost per acreage of land and using the appraisal district value of land. Katherine Kainer said that would then have to be used in the same zone. Kimberly Garrett stated a 3 acre park cost $250,000 to develop. Scott Macmurdo stated there could be a different formula for under 3 acres and one for over 3 acres. Kimberly Garrett stated it could be presented to council with either they pay the development fee or develop the park. Kimberly Garrett stated she has been researching private credit or private parks. She stated some require an HOA to come up with rigorous documentation that there will be a funding source available for development. Scott Macmurdo asked what the advantages to private parks Page 12 of 14 are. Kimberly Garrett stated if they build the park they are responsible for maintaining and capital replacement and staff to take care of it. She stated some developers are wanting to do this and sometime we have a private park in a public park; which Kimberly Garrett stated that is not a good resource for the developer or the city. Scott Macmurdo stated residential areas that are spurring the development of new parkland should then return the revenue to run those parks. Kimberly Garrett then stated how much of that property tax revenue do they want to give to maintain the park. Scott Macmurdo questions the following: • If we give partial credit do we end up with less parkland • Access to private parks; do they have the ability to restrict access to the public • Unintended consequences; other loopholes that could be exploited through other areas of code • HOA ongoing maintenance; if bankruptcy • What counts as a park? Katherine Kainer stated she likes the different levels of credit based on what the development provides. Scott Macmurdo stated that then we determine what goes in the park and what we value. Kimberly Garrett stated we are getting a lot of drainage easements and not necessarily floodplain. She stated we give a lot of credit along the San Gabriel River. Currently, the language states we will accept as partial credit and on the forks of the San Gabriel River you could get partial fulfillment and if not on SG River you could get 50% credit. This language is vague and needs to be clarified. Scott Macmurdo stated that whatever land they give needs to be suitable for park development. Scott Macmurdo stated that if the property is already in the trail masterplan we should automatically get that land. What he is proposing is that there would be an automatic easement if on the trail masterplan. He is trying to avoid a developer holding the land hostage to use as a bargaining chip. Katherine Kainer stated not to get credit for floodplain or drainage issue. Kimberly Garrett stated it can be presented as part of the water quality ordinance and the trail masterplan because if the developer cannot build on the land neither can the city so they should not get credit for it. Kimberly Garrett stated in the updated ordinance there will be cross references to the current city ordinances. Kimberly Garrett talked about the zones and the money being spent in the nearest zone in the community or regional park. There was also discussion about taking parkland in the ETJ and how with the new annexation law those properties may never be in the city limits. Scott Macmurdo stated there needs to be a link in the code for legacy spending vs. new spending. Katherine Kainer asked can we use legacy money from one area to the next. Scott Macmurdo wanted clarity around if the developers have the right to do a fee in lieu just because they want to or is the fee in lieu only at the discretion of the Parks and Recreation Director. Kimberly Garrett stated there needs to be some guideline on this.
