ACTIVITY
•House State Affairs and House Energy Resources met jointly on February 25th and
26th to discuss the following:
–Consider the factors that led to statewide electrical blackouts during the recent
unprecedented weather event; the response by industry, suppliers, and grid
operators; and changes necessary to avoid future power interruptions.
–Invited testimony only
•House State Affairs held an organizational hearing on March 4th with only invited
testimony
–The Public Utility Commission, Office of Public Utility Council, Texas Facilities
Commission, Sunset Commission, and Texas Dept. of Information Resources
were invited to testify
–The hearing primarily focused on PUC oversight

ACTIVITY
•Senate Business & Commerce met on February 25th and 26th to discuss the
following:
–Examine extreme weather condition preparedness and circumstances that led
to the power outages as directed by Electric Reliability Council of Texas
(ERCOT). The committee will also review generator preparedness and
performance, utility outage practices, natural gas supply, and the reliability of
renewable generation, as well as overall ERCOT system resilience.
–Invited testimony only
•Senate Business & Commerce met on March 4th to discuss the following:
–Examine the financial impacts to the electric grid and market participants
resulting from the extreme cold weather outages over February 14, 2021 to
February 19, 2021.

•Senate redistricting committee has met a dozen times. House redistricting has not yet
met.
•Senate Finance and House Appropriations began meeting in February
•Senate State Affairs and new Senate Local Government committee both held
organization meetings yesterday, March 8th
•House Urban Affairs will meet on March 10th to discuss municipal water supply
challenges experienced during the recent winter storm
–The Texas Department of Housing and Community Affairs and Municipal Water
Utilities will be invited to testify on the Impact of Winter Storm Uri
•House State Affairs will meet on March 11th to consider HB 3, which is intended to map
out what the state's response would look like in a future pandemic

•This Friday, March 12th is the deadline for the unrestricted filing of
bills and joint resolutions (other than local bills, emergency
appropriations and emergency matters submitted by the governor)
•To date, over 4,500 bills have been filed by the Legislature
•Focused Advocacy is actively tracking 1,586+ bills

•Chair DeAnn Walker resigned (new chair: Commissioner Arthur D’Andrea)
•PUC IMM recommendations:
1.For operating days February 15 through February 20, reprice all day-ahead ancillary
services (AS) clearing prices to cap them at the System-Wide Offer Cap (SWCAP) of
$9,000 per MWh -REJECTED 3/3/21
2.For operating days February 14 through February 19, invoke the "failure to provide"
settlement treatment for all AS that were not provided in real time.-ADOPTED 3/3/21
3.Direct ERCOT to correct the real-time prices from 0:00 February 18 to 09:00 February
19, to remove the inappropriate pricing intervention that occurred during that time
period.-REJECTED 3/5/21
•On March 8th, Lt. Gov. Patrick issued a press release calling on both the PUC and ERCOT to
follow the IMM recommendations and correct the $16B pricing error
