(PFP-2017-003) Juan Enriquez, Planner and Sofia Nelson, Planning Director Motion by Marler, second by Bargainer to approve the consent agenda items, minus item C. Approved 7 – 0. Legislative Regular Agenda G. Public Hearing and possible action on a request for a Special Use Permit to allow an automotive sales facility located at 6801 S. IH-35 and within the General Commercial (C-3) District, to be known as Echo Park. (SUP-2017-004) Nathan Jones-Meyer, Planner Jones-Meyer presented the staff report. Based on the findings and the Future Land Use Plan designations for this property, staff recommends denial of the Permit. Karen Wunsch presented the applicant’s case. Commissioners debated the issue and offered comments. Marler is concerned that the 2030 plan is out of date. Jones-Meyer responded that staff was reviewing the entire tract of land and reviewed appropriate land uses for the entire property, feeling that permitting more auto sales in that area would keep other uses away. Others stated they could see a dealership in this area that is so close to the other dealerships along IH 35. Nelson commented that the comprehensive plan supports an employment center in this area, and looking to the guidance of the development review committee, several other uses were more preferable than auto sales. Brashear commented that the city once had auto sales businesses downtown and worked to move them out to the IH 35 corridor. Looking at the surrounding uses of this tract, he supports this land use and feels it is adaptable and reusable. Chair opened the public hearing. Larry Kokel spoke for the Kelley foundation, the land owners that sold property to Subaru, Ford, Lincoln and Mazda in that area and states that those business have provided a good employment base. He supports the Special Use Permit. Dale Illig, President of the Kelley Foundation, spoke about the funding and grants that the foundation has given within the community. He stated they are looking for a balance between property rights and business rights and asks commissioners for support of the project. Chair Schroeder closed the public hearing with no further speakers coming forth. Motion by Marler, second by Fuller, to recommend to City Council approval of the Special Use Permit for 6801 S. IH-35. Approved 7 – 0. H. Public Hearing and possible action on a Replat of a Final Plat for 0.99 acres of Osgood Subdivision Lot 2, located at 401 W. 17th Street. (FP-2016-036, Osgood Subdivision) Juan Enriquez, Planner Enriquez presented the case. The applicant is requesting to subdivide the property in to 5 lots. There were not public comments and staff recommends approval. Chair Schroeder opened the Public Hearing and with no speakers coming forth, closed the hearing. Page 5 of 31 P&Z Minutes Page 3 of 3 July 18, 2017 Motion by Bargainer, second by Fuller to approve the replat application for 401 W. 17th Street. Approved 7 – 0. I. She would also be presenting a workshop at the next Council meeting on mobile food vendors and looking for direction on possible changes to the UDC. • Nelson introduced the new staff for Planning: Chris Yanez is the new Assistant Director. Nat Waggoner and Andreina Davila are the new Planning Managers. A new Housing Coordinator and Historic Planner would be coming soon. • Update on the Georgetown Transportation Advisory Board (GTAB) meetings. Garcia, PE Property Owner(s): EVC Georgetown LP Contact: David Myer Overview of Applicant’s Request The applicant has requested to rezone the site from Residential Single-Family (RS), Agriculture (Ag), and Multi-family District (MF-2) to a Planned Unit Development with a General Commercial (C-3) base zoning. Site Information Location: This property is located at the southwest corner of Hwy 29 and Wolf Ranch Parkway. Physical Characteristics: The property is relatively flat with a very dense tree covered lot. Surrounding Properties: Location Zoning Future Land Use Existing Use North C-1 Regional Commercial Highway 29 and retail development South MF-2 Regional Commercial and High Density Residential Multi-family development currently under construction East C-3 Regional Commercial Wolf Ranch Parkway and Wolf Ranch Development West MF-2 Regional Commercial and High Density Residential Multi-family development currently under construction Page 8 of 31 Planning Department Staff Report Natural Grocers Page 2 of 4 2030 Comprehensive Plan Future Land Use: The 2030 Plan provides for a Regional Commercial node extending from I-35 on both the east and westsides of the highway along Hway 29. This category applies to large concentrations of commercial uses that serve or draw a regional market, such as major shopping centers, stand- alone big-box retail, tourist attractions and supporting accommodations, and automobile- oriented commercial uses that rely on convenient access from major transportation routes and highway interchanges. Such properties are often configured in a manner or located in areas that may not be suitable for the introduction of mixed-uses. Transportation This property has direct frontage on Wolf Ranch Parkway and Highway 29. Access to the property will be limited to Wolf Ranch Pkway. Additionally, a cross access eament and driveway have been provided to connect the multi-family deveopment, currently under construction adjacent to this development, to Wolf Ranch Parkway. Page 9 of 31 Planning Department Staff Report Natural Grocers Page 3 of 4 Utilities The City of Georgetown will provide water, wastewater and electric services at this location. Proposed Zoning District The proposed PUD will allow for the following: • Land use predictability- a list of permitted uses have been included in the PUD to allow for improved land use protections on a key commercial/retail intersection. • Improved Architectural Standards- the developer will meet all commercial design requirements of the UDC and has committed to follow the design requirements of Wolf Ranch (to include materials and masonry finishes consistent with those of the wolf ranch development). • Signage- the applicant is requesting a 1.3 ratio of sign area to building frontage along the front of the building. This is an increase to the 1.0 ratio of sign area to building frontage required of the UDC. • Tree Removal- the applicant is requesting to remove trees consistent with the tree protection and mitigation plan provided for in the PUD. • Reduction of a parking setback on the west side of the site- The applicant is requesting a reduction in the parking setback from 15’ to 5’ Staff Analysis UDC Section 3.06.030 establishes the following criteria for zoning changes: The application is complete and the information contained within the application is sufficient and correct enough to allow adequate review and final action This application was reviewed by staff and deemed to be complete. The zoning change is consistent with the Comprehensive Plan The proposed zoning change is consistent with the Future Land Use of the 2030 Comprehensive Plan and the Plan’s Goal of preserving and emphasizing land ideally suited for retail development. The zoning change promotes the health, safety or general welfare of the City and the safe orderly, and healthful development of the City The zoning change allows for the development of a key corner at the intersection of two major roadways. As the area around Wolf Ranch Parkway and Hwy 29 develops it is quickly becoming the center of the city. As this area develops property must be reserved for the development of goods and services to serve both the new residential developments as well as the region. The zoning change is compatible with the present zoning and conforming uses of nearby property and with the character of the The proposed rezoning is compatible with the surrounding zoning districts and comprehensive plan. Page 10 of 31 Planning Department Staff Report Natural Grocers Page 4 of 4 neighborhood The property to be rezoned is suitable for uses permitted by the District that would be applied by the proposed amendment. The uses allowed in the PUD are suitable for the areas, adjacent uses, and consistent with the comprehensive plan. Staff Recommendation Staff recommends approval of the PUD with the condition that the signage for the development meet the requirements of the UDC. Staff has reviewed the signage requirements for all developments located on both sides of Hwy 29. Each of the developments has met the signage requirements of the UDC. Additionally, there does not appear to be topographical or site specific conditions that would require the increase in sign areas. Public Comments Staff has received no public comments regarding this case.
