HomeMy WebLinkAboutMIN 07.09.2024 CC-W&RMinutes of the City Council City of Georgetown, Texas Tuesday, July 9, 2024 The Georgetown City Council met on Tuesday, July 9, 2024, at 12:00 PM at Council and Court Building, 510 W. 9th Street. The City of Georgetown is committed to compliance with the Americans with Disabilities Act (ADA). The following Members were in attendance: Josh Schroeder, Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, and Ben Stewart. 1. Policy Development and Discussion - Workshop Mayor Schroeder called the meeting to order at 12.72 P.M. 1.A FY2025 City of Georgetown Budget and Tax Rate Workshop Overview, discussion, and feedback regarding the FY2025 City of Georgetown Budget and Tax Rate -- David Morgan, City Manager In addition to City Manager David Morgan, Assistant City Managers Laurie Brewer, Nick Woolery, and Wayne Nero, Chief Financial Officer Leigh Wallace, Assistant Finance Director Nathan Parras, Elaine Wilson Assistant Finance Director, Eric Johnson Public Works Director, Kim McAuliffe Downtown and Tourism Director provided input on the presentation and helped answer questions. Morgan began the presentation and reviewed the following: presentation purpose; budget context and pressures; development of the FY2025 budget as the fastest growing City of our size with a highly competitive job market, aligning services fees for cost recovery, and lower growth in property and sales tax; budget development workshops with Council so far this calendar year; budget themes from FY2024 to FY2025 of maintaining service levels, addressing full year impact of new positions, and maintaining core services; maintaining service levels in permitting, inspections, municipal court, and public safety; public safety increase in calls for service and vehicle crashes; water utility growth related population increase; growth management including staffing for support areas that feel pressure, smart metering for water, and increased project costs for CIP projects; current studies and initiatives; recruitment and retention related to compensation and benefits; proposed paternity leave policy including policy considerations, duration of leave, eligibility, and leave usage; and FLSA over time calculation including how the calculations have evolved over time, current issues, potential impact of change, benefit of simplifying the calculation, rationale for reverting to FLSA minimum standard for overtime calculation, and implementation target date of January 2025. He then reviewed: budget focus and planning; preliminary budget; budget revenue assumptions for keeping a property tax rate of $0.374; budget revenue assumptions for sales tax; budget revenue assumptions for other revenue with PILOT (payment in lieu of taxes) and planning and permitting; budget component including expenses; budget assumptions for general fund and joint services; budget assumptions for Electric Utility; budget assumptions for Water Utility; summary of new staffing by fund; tax backed CIP (Capital Improvement Plan) projects; budget workbook layout and review; and government budget and accounting refresher. Mayor Schroeder called for a break at 1:02 p.m. and resumed the meeting at 1:14 p.m. Brewer, Woolery, and Nero presented and reviewed General Fund revenue, FY2024 expense variances, and FY2025 base budget expense variances; and Solid Waste FY2024 revenue and expense variances and FY202S revenue and expense variances. These items were reviewed at the Cost Center level. Morgan presented and reviewed Electric Fund FY2024 revenue and expenses, FY2025 revenue and expenses, and CIP. Mayor Schroeder called for a break at 2:03 p.m. and resumed the meeting at 2:15 p.m. Brewer, Woolery, and Nero presented and reviewed Water Fund FY2024 revenue and expenses; FY2025 revenue and expense variances, and CIP; Airport Fund FY2024 revenue and expense variances, FY2025 revenue and expense variances; Stormwater Fund FY2024 revenue variances, RY2025 revenue and expense variances, and CIP; Joint Services Fund revenues, FY2024 expense variances, and FY2025 expense variances; Tourism Fund FY2024 Revenue and expenses, and FY2024 revenue projections and FY2025; Fleet Fund FY2024 revenue projections and FY2025 and service level requests; IT Fund FY2024 revenue and expense projections, FY2025 revenue and expense, and IT fund service level requests; Facilities Fund FY2024 revenue and expense projections, FY2025 revenue and expense, and tax backed CIP projects; GEDCO Fund FY2024 revenue and expense projections and FY2025 revenue and expense; GTEC Fund FY2024 revenue and expense projections, FY2025 revenue and expense, and CIP projects; Downtown TIRZ (Tax Increment Reinvestment Zone) Fund FY2024 and FY2025 revenues and expenses; Tree Fund overview and policy update; Carey Park fund and improvements; Council discretionary fund; FY2025 budget changes in development; FY2025 proposed budget calendar; public outreach; CIP and taxable debt; and next steps The following topics were discussed throughout the presentation by Council and staff: how the change will be shared with all employees; general growth across all sectors; growth rates in sales tax over time; increases being based on projections of growth in population and sales tax; security at library provided during peak hours; over hiring in public safety and financial impacts; Crash investigation software and hardware needed by PD; no ongoing expenses are being matched with one time revenue sources; setting of the GVPID (Georgetown Village Public Improvement District) budget establishment; handling of reporting of Garey Park and EMS items being broken out and combined in different areas of the budget; possibly keeping Strategic Partnerships funding at current rate and not increasing to allow funding for other needs; short term rental revenue and implementation of tracking; potential usage and partnerships with Grace Heritage Center across the street for the Arts Center; equipment leases for Poppy Festival; cell tower service for future festivals; funding for Christmas lights on the Square; tracking of hotels versus homes for short term rentals; funding for Economic Development incentive agreements; grant funding for projects; incentivizing the right things through Water Conservation efforts; future workshop discussions for tree fund spending; and what the tree fund money can be used for. Mayor Schroeder recessed into Executive Session at 4:29 p.m. 2. Executive Session In compliance with the Open Meetings Act, Chapter 551, Texas Government Code, Vernon's Codes, Annotated, the items listed below will be discussed in closed session and are subject to action in the regular session. 2.A Executive Session 07.09.2024 Sec. 551.071: Consultation with Attorney Advice from attorney about pending or contemplated litigation and other matters on which the attorney has a duty to advise the City Council, including agenda items. - Litigation Update - GISD ILA Sec. 551.072: Deliberations about Real Property - Property owned by Southwestern and located near the intersection of SW Blvd and Hwy 29 - Deliberations regarding the acquisition of easement rights from portions of a property owned by Benjamin and Brenda Broussard at 1110 Southlake Ranch Rd., Georgetown TX 78628. - Deliberations regarding a potential settlement and dismissal of a condemnation action as part of the acquisition of a portion of a property commonly known as 1603 NW Boulevard in Georgetown TX 78628. 3. Regular Session - This portion of the meeting will begin no earlier than 6:00 pm. Mayor Schroeder called the meeting to order at 6:03 p.m. 3.A Call to Order 07.09.2024 Pledge of Allegiance Comments from the Mayor - National Park Month Proclamation Announcements Action Out of Executive Session Moved by Kevin Pitts; seconded by Jake French to Approve the authorization of the City of Georgetown to settle the acquisition of the Right -of -Way and easement rights across portions of certain property in Georgetown, TX 78628 and owned by 1603 Northwest LLC, WCAD Parcel ID R040384; and further move to authorize the City Manager to negotiate the final terms of acquisition and consideration and to execute all necessary documents to acquire the aforementioned property rights in accordance with the terms discussed in Executive Session for the "Rivery Boulevard Extension Project". Motion Approved: 6- 0 Voting For: Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, Ben Stewa rt Voting Against: None When this motion was taken up for action Councilmember Parr was not on the dais. Moved by Kevin Pitts; seconded by Jake French to Approve the authorization of the City of Georgetown to settle the acquisition of the water line easement rights across portions of certain property in Georgetown TX 78628 and owned by Benjamin and Brenda Broussard, WCAD Parcel ID R432222; and further move to authorize the City Manager to negotiate the final terms of acquisition and consideration and to execute all necessary documents to acquire the aforementioned easement rights in accordance with the terms and discussed in Executive Session for the "South Lake Water Treated Transmission Line Project, Package 4". Motion Approved: 7- 0 Voting For: Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, and Ben Stewart Voting Against: None 4. Public Wishing to Address Council On a subject that is posted on this agenda: Please fill out a speaker registration form which can be found on the table at the entrance to the Council Chamber. Clearly print your name and the letter of the item on which you wish to speak and present it to the City Secretary on the dais, prior to the start of the meeting. You will be called forward to speak when the Council considers that item. Only persons who have delivered the speaker form prior to the meeting being called to order may speak. Speakers will be allowed up to three minutes to speak. If you wish to speak for six minutes, it is permissible to use another requestor's granted time to speak. No more than six minutes for a speaker may be granted. The requestor granting time to another speaker must also submit a form and be present at the meeting. On a subject not posted on the agenda: An individual may address the Council at a regular City Council meeting by contacting the City Secretary no later than noon on the Wednesday prior to the Tuesday meeting, with the individual's name and a brief description of the subject to be addressed. Only those persons who have submitted a timely request will be allowed to speak. Speakers will be given up to three minutes to address the City Council. Statutory Consent Agenda The Statutory Consent Agenda includes non -controversial and routine items which may be acted upon with one single vote. An item may be pulled from the Consent Agenda in order to be discussed and acted upon individually as part of the Regular Agenda. Legislative Regular Agenda 6.A Second Reading - 2024-1-ANX - 6200 Williams Drive Second Reading of an Ordinance on a request for a Zoning Map Amendment to zone, upon annexation, a 22.03 acre tract in the Frederick Foy Survey, Abstract No. 229, as the General Commercial (C-3) zoning district, for the property generally located at 6200 Williams Drive, including the annexation of 8.810 acres of Right -of - Way on Williams Drive (2024-1-ANX) -- Sofia Nelson, CNU-A, Planning Director Baird presented and noted that this was on the Regular Legislative Agenda because it did not receive unanimous approval at first reading. He reviewed the Aerial Map and previous Council action on first reading. Baird read the Ordinance caption. General discussion clarifying previous vote on the item. Mayor opened the floor to public comments. Kathleen Baker addressed the Council regarding deed issues with Wellspring Church related to the use of the property. Jimmy Pike addressed the Council regarding deed issues with Wellspring Church. Moved by Ben Stewart; seconded by Shawn Hood to Approve as presented. Motion Approved: 7- 0 Voting For: Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, and Ben Stewart Voting Against: None 6.B First Reading - 2024-8-REZ - 400 CR 152 Public Hearing and First Reading of an Ordinance on a request for a Zoning Map Amendment to rezone 1.96 acres of land out of the John Berry Survey, Abstract No. 51, from the Agriculture (AG) zoning district to the Townhome (TH) zoning district, for the property located at 400 County Road 152, Georgetown, Texas. (2024-8-REZ) - - Travis Baird, Assistant Planning Director - Current Planning Baird presented and reviewed the Aerial Map; Future Land Use/Overall Transportation Plan Map; Zoning Map; Mixed Density Neighborhood (MDN) zoning designation ; explanation; Townhouse (TH) zoning designation explanation; how the application complies with all aspects of the approval criteria for UDC Section 3.06.030; comprehensive plan guidance; map of nearby uses; and cross -sections of 6-lane major arterial, 4-lane major collector, and 4-lane minor arterial. He added that public notifications sent and to date staff has received one comment in opposition, and at their June 2nd meeting, the Planning & Zoning Commission recommended approval of the request with a 5-2 vote. Baird read the Ordinance caption. General discussion among Council and staff regarding how each unit will sit on its own property; max build out would be 42 units, but likely less; and how theapplicant is seeking approximately 22 units. Mayor Schroeder opened and closed the public hearing at 6:24 p.m. as there were no speakers. Moved by Jake French; seconded by Ron Garland to Approve as presented. Motion Approved: 7- 0 Voting For: Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, and Ben Stewart Voting Against: None 6.0 First Reading - Civil Service Strength of Force - Fire Department First Reading of an Ordinance authorizing a change to the Civil Service classifications and number of positions for all City of Georgetown Fire Fighters and Police Officers pursuant to Chapter 143 of the Texas Local Government Code -- John Sullivan, Fire Chief Sullivan presented and reviewed the classification of positions to move and how it would result in no changes to the total authorizations for the Fire or Police Departments. Sullivan read the Ordinance caption. Moved by Kevin Pitts; seconded by Amanda Parr to Approve as presented.
