Section 418.108(b) of the Texas Government Code provides that such a declaration of disaster may not be continued for a period of more than seven days exception with the consent of the City Council. At this time, the conditions necessitating the disaster declaration will continue to exist for a period of more than seven days. The attached Resolution would ratify the Mayor ’s local disaster declaration and extend it until March 23, 2021 unless ended before then by the Mayor or further City Council action. F I NANC I AL I MPAC T: n/a S UBMI T T ED BY: R LD for J ack Daly, Community Services Director AT TAC HMENT S : Description R esolution Extending Disasater Dec laration 02.2021 Page 3 of 5 Resolution No. Page 1 of 2 Subject: Ratifying and Continuation of Local Disaster Declaration Date Approved RESOLUTION NO. _____________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, RATIFYING THE DISASTER DECLARATION SIGNED BY THE MAYOR ON FEBRUARY 14, 2021 AND CONSENTING TO ITS CONTINUATION THROUGH MARCH 23, 2021; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, on February 14, 2021, Mayor Josh Schroeder, acting in accordance with authority granted to him under Section 418.108(a) of the Texas Government Code and the City’s Home Rule Charter, declared a local state of disaster for the City due to severe winter weather conditions resulting in imminent threat of widespread and severe damage, injury, and/or loss of life and property; WHEREAS, Section 418.108(b) of the Texas Government Code provides that such a declaration of disaster may not be continued for a period of more than seven days exception with the consent of the governing body of the political subdivision; WHEREAS, the imminent threat of widespread and sever damage, injury and/or loss of life and property necessitating the disaster declaration will continue to exist for a period of more than seven days; and WHEREAS, the City Council supports the disaster declaration signed by Mayor Josh Schroeder on February 14, 2021 and consents to its continuation for a period of more than seven days. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS: SECTION 1. The facts and recitations contained in the preamble of this Resolution are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. SECTION 2. The City Council hereby ratifies the disaster declaration signed by Mayor Josh Schroeder on February 14, 2021, and consents to its continuation through Page 4 of 5 Resolution No. Page 2 of 2 Subject: Ratifying and Continuation of Local Disaster Declaration Date Approved March 23, 2021, or until such time as it is terminated by the Mayor provided that the Mayor give City Council seventy-two hours notice of the proposed termination.. SECTION 3. The Mayor is authorized to sign this Resolution and the City Secretary to attest. SECTION 4.
