FINANCIAL IMPACT: N/A SUBMITTED BY: Wayne Nero, Chief of Police Cover Memo Item # A City of Georgetown, Texas November 25, 2014 SUBJECT: Presentation by Alvin Lankford with the Williamson Central Appraisal District on the issues related to uniform property tax appraisals -- Micki Rundell, Chief Financial Officer ITEM SUMMARY: Alvin Lankford, Chief Appraiser with the Williamson Central Appraisal District (WCAD) will present an overview of proposed legislative changes regarding Uniform Property Tax Appraisals. This presentation will focus on the lack of full sales disclosure information currently available to appraisal districts in Texas and the related impacts on assessed valuation. Alvin will also discuss the issues regarding liability for attorney fees in commercial protests, which currently are assessed to appraisal districts. Currently, the State of Texas does not mandate sales disclosure, but due to residential real estate websites that share much of this information, residential values are fairly representative of actual market conditions. Yet, at the same time, WCAD has very limited access to commercial and high end residential property sales and market information, and thus, those related properties are often undervalued and pay less than their fair share of property taxes. Various professional associations, including tax assessors and appraisal districts are working with legislators in support of changes to the State Tax Code to allow for full disclosure and require sharing attorney’s fees fairly among parties. Earlier this fall, Joe Pondrum, a member of the General Government and Finance Advisory Board and a former Williamson County Deputy Tax Assessor Collector, brought this issue to GGAF for discussion. Staff was directed to work with WCAD and others to bring this issue to City Council for a Resolution of Support that can accompany the legislation necessary to amend the Tax Code and address these concerns. A formal “Resolution of Support” is currently being developed by these organizations, but was not completed in time for inclusion at this agenda. The Resolution will be included for consideration and action on the December 9 Council Agenda. The final Resolution is also scheduled to be reviewed by GGAF at their December 3 meeting. A draft of the proposed legislation is attached.
