Workshop review of the City of Georgetown's Americans with Disabilities (ADA) Transition Plan -- Dave
Hall, Building Official and Bridget Chapman, City Attorney
ITEM SUMMARY:
The Americans with Disabilities Act (ADA) was enacted on July 26, 1990 and provides comprehensive
rights and protections for individuals with disabilities in the areas of employment, public accommodations,
state and local government services, and telecommunications. The ADA covers individuals with physical or
mental impairments that substantially limit a major life activity, persons with a record of such impairment,
and persons regarded or perceived as having such impairment. The law was designed to ensure that persons
of all abilities have equality of opportunity, economic self-sufficiency, full participation in American life,
and independent living.
To ensure that the fundamental goal of the ADA is met, Title II of the ADA requires state and local
governments to make their programs and services accessible to persons with disabilities. This requirement
extends not only to physical access at government facilities, programs, and events, but also to policy changes
that governmental entities must make to ensure that all people with disabilities can take part in, and benefit
from, the programs and services of the state and local governments. In addition, governmental entities must
ensure effective communication, including the provision of necessary auxiliary aids and services so that
individuals with disabilities can participate in civic life.
Title II requires city governments to ensure that each of its programs, services and activities, when viewed in
their entirety, are accessible to people with disabilities. This emphasis on access to programs, as opposed to
access to buildings or facilities, distinguishes the requirements for public entities from those for private
places of public accommodation. In providing access, city governments are not required to take any action
that would result in a fundamental alteration to the nature of any program, service or activity or that would
result in undue financial and administrative burdens. If an action would result in such an alteration or such
burdens, the City must take any other action it can to ensure that people with disabilities receive the benefits
and services of the program or activity.
In 1992, the City Council passed Resolution No. 920035 establishing a policy regarding non-discrimination
of individuals with disabilities and appointing an Advisory Task Force. In April 2011, Council appointed an
ADA Coordinator and an ADA Advisory Task Force to develop a Transition Plan to address City
compliance with the ADA and report back to Council. The City's ADA Coordinator is Dave Hall. The
current members of the ADA Advisory Task Force are: Stephanie Blanck, Dawn Jennings , Chris Spence and
Dr. Gayle Tunamie.
The ADA Advisory Task Force has approved an ADA Transition Plan that includes the following
recommendations:
FEASIBILITY STUDY. The City should conduct a feasibility study to obtain an analysis and evaluation for
proposed projects to determine if the projects are technically feasible and to provide an estimated cost for
project prioritization and budgeting. The Feasibility Study will provide recommendations for implementation
of the ADA Transition Plan, including prioritization of projects, scheduling and integration of those projects
into the City CIP and City Budget. The Feasibility Study has been included in the scope of services for the
2014 Sidewalk Study proposal. Once the Feasibility Study is complete it will be presented to the ADA
Advisory Committee for review and recommendation to the City Council.
ADA ADVISORY COMMITTEE. The City should establish an ADA Advisory Committee. Membership on
the Committee should include the ADA Coordinator and representatives of the following City departments:
transportation, systems engineering, parks and recreation, facilities, communication, and legal. Citizen
representatives should also be members of the Committee, including individuals with ADA mobility
limitations, as well as the sight and hearing impaired. The ADA Advisory Committee would inform the City

Council concerning Title II issues applicable to the City and provide ongoing recommendations concerning
implementation and amendment of the ADA Transition Plan as necessary for compliance with the ADA. The
ADA Advisory Committee would also allow for regular public participation from citizens and other
interested persons, including individuals with disabilities or organizations representing individuals with
disabilities.
DATA ORGANIZATION. Data should be collected and organized in a form to be included in the City's
Asset Management System or other database to organize project data, including inspections and construction.
WEB PAGE. The City has created an ADA page on the City's website located at ada.georgetown.org. City
Staff should work with the ADA Advisory Committee to develop the ADA page as an effective and
meaningful resource for City residents with disabilities.
FINANCIAL IMPACT:
Funding of the Feasibility Study will be considered by the City Council with the 2014 Sidewalk Study
proposal, currently anticipated in April 2014.

ITEM SUMMARY:
Background:
On October 8, 2013, staff presented to City Council with information regarding current trends of multifamily
housing and how these are affected by the 2030 Plan and the Unified Development Code (UDC). City
Council directed staff to make changes to the zoning districts that allow multifamily development by-right
and create a multifamily information report by which to consider future multifamily rezonings.
Summary of possible changes to the UDC:
Allow apartments in C-1 and C-3, only upon Council approval of a Special Use Permit (SUP)
Create criteria for approval of SUP for apartments
Review Multifamily (MF) zoning district standards and consider creation of two districts; MF-1 and
MF-2 that differ based on density and/or scale
Review and amend multifamily-related definitions, such as townhomes, apartments, assisted living,
etc., as appropriate for clarity and accommodation of new development types
Potential for high-density/multifamily information map:
Staff can consider the creation of a baseline multifamily map to present to Council with the existing
conditions and entitlement situations in an area where new high-density development is proposed. Included
in this map would be the following information:
Existing apartments and high density developments, including number of existing units and number of
bedrooms
Existing multifamily entitlements, such as Multifamily (MF) zoning, Planned Unit Developments,
development agreements with multifamily uses, and conditional or special uses within other zoning
districts that allow multifamily uses
School locations
Some of this information is already available in map files, but detailed information apartment unit
breakdowns and past PUD and conditional zoning entitlements will require staff time for research and
entering data into a usable format.
Direction:
Unified Development Code amendments must be reviewed by the Unified Development Code Advisory
Committee, unless the City Council instructs staff to process them as priority amendments that can return to
Council on a quicker timetable with only reviwe by the Planning & Zoning Commission. Staff is requesting
direction from City Council if the changes described above are desired by Council and if so, then to
recommend which process to vet these amendments.
