A - Call to Order- Special Session to begin no earlier than 4:00 PM B Second Reading of an Ordinance pertaining to an Industrial District Agreement with Texas Crushed Stone Company and Georgetown Railroad Company -- Paul E. Brandenburg, City Manager and Mark Sokolow, City Attorney C Consideration and possible action to approve a Resolution pertaining to the request for a water quality permit from the Williamson County Municipal Utility District No. 19 who desire to discharge treated wastewater into Sowes Branch of the North Fork of the San Gabriel River, the city’s opposition thereto, the city’s request for a public meeting, and a contested case hearing and coordination with the city of Liberty Hill and other public entities that may similarly oppose thereto, and declaring an effective date -- Jim Briggs, Assistant City Manager Executive Session In compliance with the Open Meetings Act, Chapter 551, Government Code, Vernon's Texas Codes, Annotated, the items listed below will be discussed in closed session and are subject to action in the regular session. Brandenburg, City Manager and Mark Sokolow, City Attorney ITEM SUMMARY: The parties have successfully negotiated an Industrial District Agreement which provides for the Southwest Bypass. Section 5.13 of the Agreement indicates that the Agreement needs to be adopted by an Ordinance. Please see attached for the Ordinance and Exhibit A (the Industrial District Agreement -signed version) FINANCIAL IMPACT: The finance department can discuss the potential costs of the Southwest Bypass as it pertains to the city participation. The Industrial District Agreement does not provide any revenues for the City. WHEREAS, the City deems it in the public interests to enter into an Industrial District Agreement with Texas Crushed Stone (“TCS”) and Georgetown Railroad Company (“GRR”) in substantially the same form as attached hereto as Exhibit “A” and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: Section 1. Open Meetings Act. The meeting at which this ordinance was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 2. Findings. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section 3. Conflicts That in the event of any conflict between the Industrial District Agreement and any City ordinances, resolutions or policies, the Industrial District Agreement shall control. Section 4. That the City Council approves the Industrial District Agreement and the Mayor is authorized to execute the Industrial District Agreement in substantially the same form as attached hereto as Exhibit “A”, and Section 5. Severability. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest.
