A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETO WN, TEXAS ("GEORGETOWN") RELEASING
APPROXIMATELY 66.66 ACRES OF LAND FROM THE CITY OF
GEORGETO'WN'S EXTRATERRITORIAL JURISDICTION ("ETJ"),
SAID LAND ]BEING GENERALLY LOCATED NORTH OF UNIVERSITY
BOULEVARD AND WEST OF STATE HIGHWAY 130, WILLIAMSON
COUNTY, TEXAS, RESULTING IN A REDUCTION OF
GEORGETO'WN'S ETJ; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on August 29, 2024, the City of Georgetown, Texas, received a petition requesting
release from its ETJ of"an approximately 66.66-acre tract of land in the Samuel Nimmo Survey (the
"Petition"), a true and correct copy of such Petition being attached hereto as Exhibit A and
incorporated herein by reference; and
WHEREAS, pursuant to Subchapter D of Chapter 42 of Local Government Code, landowners or
residents may submit a petition seeking release of an area of land from the City's ETJ; and
WHEREAS, the City Secretary has reviewed the Petition and confirmed that it meets the
requirements of Subchapter D of Chapter 42 of the Local Government Code and the petition
requirements of Chapter 277 of the Election Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS:
SECTION 1. The City Council of the City of Georgetown, Texas ("City Council"), does hereby
find that the forgoing recitals are true and correct and adopts the recitals by this reference for all
purposes.
SECTION I To the extent required by state law, the City Council does hereby adjust the
boundaries and limits of the ETJ of the City of Georgetown, Texas, such that the ETJ of the City
of Georgetown, Texas, shall be and is hereby adjusted to release and remove the Area subject to
the Petition, as such Area is more particularly described and depicted in Exhibit B attached hereto
and incorporated herein by reference, from the ETJ of the City of Georgetown, Texas.
SECTION 3. The City Council is not consenting to this reduction of its ETJ except as required
by state law.
SECTION 4. This Resolution shall take effect immediately upon its passage.

EXTRATERRITORIAL JURISDICTION

TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF
GEORGETOWN, T:XAS:
DEBRA KAY BRIGGS (the "Petitioner"), acting pursuant to the provisions of
Subchapter D, Chapter 42, Texas Local Government Code,to-ether with all amendments
and additions then!to, respectfully petitions this Honorable City Council to release the
66.66 acres of land described by metes and bounds in Exhibit A and shown on the map
attached as Exhibit B (the "Land"), attached hereto and incorporated herein for all
purposes, from the extraterritorial jurisdiction of the City of Georgetown, Texas (the
"City"), and in support of this petition the Petitioner represents, covenants, and agrees as
follows:

The Petitioner holds fee simple title to the Land, and hereby represents that it owns
a majority in value of the Land to be released from the extraterritorial jurisdiction of the
City as indicated by the certificate of ownership provided by the Williai7lson Central
Appraisal District, attached hereto as Exhibit C.
II.
The Petitioner represents that the Land is not located within five (5) miles of the
boundary of a milii ary base, as defined by Section 43.0117 of the Texas Local Government
Code, at which an active training program is conducted.
The Petitioner represents that the Land has not been voluntarily annexed into the
extraterritorial jurisdiction of a municipality that is located in a county (a) in which the
population grew tly more than fifty percent (50%) from the previous federal deceruual
census in the federal decennial census conducted in 2020; and (b) that has a population
of greater than 24C,000.

The Petiticner represents that the Land is not within the portion of the
extraterritorial jurisdiction of a municipality with a population of more than 1.4 million

that is (a) ivithin 15 riles of the boundary of a military base, as defined by Section 43.0117
of the Texas Local Government Code, at which an active training program is conducted;
and (b) in a county with a population of more than two million.

The Petitioner represents that the Land is not in an area designated as an industrial
district under Section 42.044 of the Texas Local Government Code.
VI.
The Petitioner represents that the Land is not in an area subject to a strategic
partnership agreem 2nt entered into under Section 43.0751 of the Texas Local Government
Code.
WHEREFORE, the undersigned respectfully prays that tliis petition be heard and
its
granted in all res netts and that the City inunediately release the Land from .
extraterritorial jurisdiction, as required by Section 42.105(c) of the Texas Local
Government Code, as it exists today and from an)- future expansions of the Cit�r's
extraterritorial jurisdiction whether by annexation or pursuant to Section 42.021 of the
Texas Local Government Code. If the City fails to release the Land from its extraterritorial
Jurisdiction by the later of forty-five (45) days from the date it receives this petition or the
next meeting of the City's governing body that occurs after the 30th day after the date the
City receives this petition, the Land shall be released from the City's extraterritorial
jurisdiction by operation of laws.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, DESIGNATING ONE MAILING
ADDRESS AND ONE ELECTRONIC MAILING ADDRESS FOR
PURPOSES OF RECEIVING PUBLIC INFORMATION
REQUESTS.
WHEREAS, the City Council recognize the need to effectively receive and legally
disseminate information about the affairs of government and the official acts of public officials
and employees; and
WHEREAS, pursuant to Government Code Section 552.234, a governmental body that
posts the designated mailing address and electronic mailing address on its internet website is not
required to respond to written requests for public information unless the request is received at one
of those addresses, by hand delivery, or by an approved alternate delivery method; and
WHEREAS, the City Council adopted Resolution 111219-C pursuant to Government
Code Section 552.234 to designate an electronic mailing address and mailing address to receive
public information requests; and
WHEREAS, the City of Georgetown has recently updated its website and electronic
mailing addresses which requires an update to the address to receive requests.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN TEXAS:
Section 1. The meeting at which this resolution was approved was conducted in
compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
Section 2. The facts and recitations contained in the preamble of this Resolution are hereby
found and declared to be true and correct and are incorporated by reference herein and expressly
made a part hereof, as if copied verbatim.
