The City of Georgetown is committed to compliance with the Americans with Disabilities Act (ADA). The following Members were in attendance: Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, Ben Stewart, and Josh Schroeder. Revised Agenda This agenda was revised at approximately 5:40 p.m. on Friday, September 9, 2024, to add 3 items to the Statutory Consent portion of the agenda. 1. Policy Development and Discussion - Workshop This portion of the meeting will begin at 2:00 p.m. Mayor Schroeder called the meeting to order at 2:00 p.m. 1.A Downtown & Tourism Short -Term Rental Program Presentation and discussion regarding the City's Short -Term Rental Program -- Kim McAuliffe, Downtown & Tourism Director, and Rachel White, Tourism Coordinator McAuliffe presented and reviewed the need for regulation and previous Council direction and staff follow-up. White presented and reviewed program development, short-term rental permit registration, example listing, registration portal, and complaints and enforcement. McAuliffe resumed the presentation and reviewed program implementation, financial impact of program, and measuring program success. General discussion among staff, including Skye Masson, City Attorney and Council regarding the following: use of accessory dwelling units for Short term rentals; use of addresses when considering; time limits for short term rentals; listen to recording; how establishment of this program does not establish a use under the UDC; sales tax associated with the program; must register even if only renting out a home for one weekend; liability of property owners; possible future amendments to the ordinance; need to monitor if increase number of short term rentals leads to increased calls for service for Fire and PD assistance; if short term rental could be added as a type of use to the UDC; and complaint process and process for pulling permits. 1.13 Annual Ethics Review Presentation and annual Ethics review -- Skye Masson, City Attorney's Office Masson presented and reviewed Texas Open Meeting Act (TOMA) Government Code Chapter 551; TOMA definitions; emails, notice of meetings via agendas, open sessions, public comments, emergencies, Closed (Executive) Session requirements, Closed Session and statutory authority under TOMA; Texas Public Information Action (TPIA) Texas Government Code Chapter 552; response to open records requests under TPIA; conflicts of interest definitions, substantial interest, and penalties under state law; City Ethics Ordinance Chapter 2.20 application, declaration of policy, purposes, what is not allowed, gifts, conflicts of interest, family and household members, conflict of interest and rule necessity, how conflicts of interest are handled, and ethics complaint procedures; and resources. General discussion among Council and staff regarding how the state laws can impact the Council's ability to communicate with members of the public; key of intent related to violations of the law; meetings with third parties; and key of communication between Council members and constituent. 1.0 Jarrell CCN Transfer Presentation and discussion regarding a City of Jarrell CNN transfer -- Chelsea Solomon, Director of Water Utility Wes Wright, Systems Engineering Director presented and reviewed prior CCN transfers and requests, project specifics, considerations, and questions and next steps. General discussion among Council and staff regarding Council's general support for releasing the CCN to Jarrell. 1.D City Website Update Presentation and discussion regarding the City's recent website update and changes -- Aly Van Dyke, Communications and Public Engagement (CAPE) Director Van Dkye reviewed the process that lead to the new website and then provided a brief overview of the new city website https://www.georgetowntexas.gov/. Council provided feedback and suggestions on the website. Mayor called for a break at 3.32 p.m. and resumed the meeting at 3.47 p.m. 1.E Fire Department Master Plan Update Presentation and discussion regarding the Georgetown Fire Department Master Plan Update -- John Sullivan, Fire Chief Sullivan presented and reviewed background; need; service area; ESD 8; Emergency System demand; people versus jobs versus 9-1-1 demand; population and growth projections; housing projections; population projections; demand zones; call for service (CFS) projections; calls for services; call concurrency; community feedback; executive summary; strategic initiatives; strategic goals; 10- year plan; strategic initiatives definitions; initiatives for ambulances, travel time, fire stations, accreditation, expand staffing, expanding FLS, EMS leadership; goals related to fire stations, life safety, community risk; revenue projections; budget projections; ESD8 revenue projections with and without SUT; ESD8 budget projections with and without SUT; and fire station projections. General discussion among Council and staff regarding future growth projections and how the fire departments handles multiple incidents at once. Mayor Schroeder recessed into Executive Session at 4.28 p.m. 2. Mayor Schroeder called the meeting to order at 6:18 p.m. 3.A Call to Order 09.10.2024 Pledge of Allegiance Recognitions - Communications and Public Engagement Awards Action Out of Executive Session Moved by Kevin Pitts; seconded by Ben Stewart to Approve the authorization of the City of Georgetown to settle the acquisition of new Temporary Construction Easements rights across portions of certain properties in Georgetown TX 78628 and owned by the following property owners: John B. Saragusa, WCAD Parcels ID R039047 & R039086; Martha Ann Edwards, Truste, WCAD Parcels ID R038985 & R038971; Joe L. Lykes, WCAD Parcels ID R038941, R040486 & R362112 as part of the "Berry Creek Wastewater Interceptor Project"; and I further move to authorize the City Manager to negotiate the final terms of acquisition and consideration and to execute all necessary documents to acquire the aforementioned easement rights in accordance with the terms discussed in executive session for the Berry Creek Wastewater Interceptor Project. Public Wishing to Address Council On a subject that is posted on this agenda: Please fill out a speaker registration form which can be found on the table at the entrance to the Council Chamber. Clearly print your name and the letter of the item on which you wish to speak and present it to the City Secretary on the dais, prior to the start of the meeting. You will be called forward to speak when the Council considers that item. Only persons who have delivered the speaker form prior to the meeting being called to order may speak. Speakers will be allowed up to three minutes to speak. If you wish to speak for six minutes, it is permissible to use another requestor's granted time to speak. No more than six minutes for a speaker may be granted. The requestor granting time to another speaker must also submit a form and be present at the meeting. Statutory Consent Agenda The Statutory Consent Agenda includes non -controversial and routine items which may be acted upon with one single vote. An item may be pulled from the Consent Agenda in order to be discussed and acted upon individually as part of the Regular Agenda. Prior to voting on the Consent Agenda Councilmember French recused himself and left the dais due to a conflict with Item S.AB.
