Consideration and possible action to approve Task Order No. CDM -09-007 with Camp Dresser &
McKee, Inc. (CDM), of Austin, Texas, for professional services related to the design and construction of a Lake
Water Treatment Plant Expansion (LWTP) Filter #10 and Sun City Pump No. 4 for $183,000.00. – Thomas R.

ITEM SUMMARY:
The utility needs to expedite the expansion of the LWTP Filter #10 and Sun City Pump No. 4 for
emergency health and safety reason in order to provide sustainable potable water supply, maintain fire
protection and provide some back up for the ground water supply by the summer of 2010.
This task order provides for the regulatory, design, bidding, and construction phases of LWTP
Expansion Filter #10.and Sun City Pump No. 4 to be located at the Lake Georgetown LWTP site. The
expansion of the LWTP and Sun City Pump No. 4 is needed for potable water supply, fire protection and
provide back up the ground water supply. All of these improvements were envisioned by the 2008 Master
Plan. The additional treatment and pumping capacity is needed to provide for water plant production
efficiency and for improved peak demand performance. For several years system has exceed treatment
capacity on occasion. This project will be able to be completed by summer 2010 using emergency
procurement process and construction manager at risk (CMR) contracting methods, currently we are
negotiating with a local construction firth that has previous done work on the LWTP.
CDM is the best -qualified firm to perform this work due to their knowledge of the LWTP and their
work on the master plan of the facility. The attached task order outlines the scope and costs for CDM to
perform the necessary regulatory, design, bidding, and construction phases, for the LWTP Expansion Filter
#10 and Sun City Pump No. 4.
GUS BOARD RECOMMENDATION:
This item was unanimously recommended by the GUS Board for Council approval at the August 18,
2009, GUS Board meeting.
STAFF RECOMMENDATION:
Staff recommends approval of Task Order No. CDM -09-007 with Camp Dresser & McKee, Inc. (CDM),
of Austin, Texas, for professional services related design and construction of a LWTP Filter #10 and Sun City
Pump No. 4 for $183,000.00.
FINANCIAL IMPACT:
See attached CIP Budgetary & Financial Analysis Sheet.
Local Government Code Section 252.022 allows for the emergency procurement.

General Description of Services or Project:
Design, Bidding/Negotiation and General Services during Construction for the addition of a tenth
filter at the existing Lake Georgetown Water Treatment Plant and the addition of a fourth high
service pump at the Sun City Pump Station located at the Lake Georgetown Water Treatment
Plant.
City Provided Information or Work: The City shall provide the following services or perform
the following work (describe):

1. Designate a person to act as City's representative with respect to the services to be
performed or furnished by the Professional. This representative will have authority to transmit
instructions, receive information, interpret and define City's policies and decisions with respect to
Professional's services.
2. Provide all criteria and full information as to City's requirements for the project, including
objectives and constraints, space, capacity and performance requirements, flexibility and
expandability, and furnish copies of all design and construction standards which City will require
to be included in the Project Drawings and Specifications.
3. Assist Professional by placing all available information pertinent to the Project, including
previous reports and any other data relative to the design or construction of the Project at the
Professional's disposal.
4. Furnish to Professional, as requested for performance of basic services or as required by the
Contract Documents, the following:
a. Data prepared by or services of others, including without limitation explorations and tests
of subsurface conditions at or contiguous to the site, drawings of physical conditions in or relating
to existing surface of subsurface structures at or contiguous to the site,

b. The services of an independent testing laboratory to perform all inspections, test and
approvals of samples, materials and equipment
C. Environmental assessments, audits, investigations and impact statements, and other
relevant environmental or cultural studies as to the Project, the site and adjacent areas;
d. Arrange for access to and make all provisions for Professional to enter upon public and
private property as required for Professional to perform services under this Task Order,
e. Examine all alternate solutions, studies, reports, sketches, proposals and other documents
presented by Professional;
f. Provide such accounting, bond and financial advisory, independent cost estimating and
insurance counseling services and such legal services as City may require or Professional may
reasonably request with regard to legal issues pertaining to the Project
g. Provide labor and safety equipment to open electrical/instrumentation cabinets, open and
protect manholes and/or to operate valves and hydrants as required by the Professional, and
h. Give prompt notice to Professional whenever City observes or otherwise becomes aware of
any development that affects the scope or time of performance or furnishing of Professional's
services, or any defect or nonconformance in Professional's services in the work of any Contractor.
Any documents or information related to the Work/Services provided by the City to the
Professional, including, without limitation, engineering studies, maps, reports, filed data, notes,
plans, diagrams, sketches, or maps (the "Information") is and shall remain the property of the City,
and Professional shall have no ownership or other interest in same. The Professional shall deliver
to the City, if requested, a written itemized receipt for the Information, and shall be responsible for
its safe keeping and shall return it to the City, upon request, in as good condition as when received,
normal wear and tear excepted.
Scope of Work: (describe in detail using additional or separate sheets if necessary):
Preliminary Engineering Phase. This phase involves determination of project scope and economic
and technical evaluation of feasible alternatives. Services during this phase include:
1) Reviewing available data and consulting with the City to clarify and define the City's
requirements for the project.
2) Advising the City as to the necessity of providing or obtaining from others additional data
or services. These additional services may include photogrammetry, reconnaissance surveys,
property surveys, topographic surveys, geotechnical investigations and consultations, compilation
of hydrological data, traffic studies, materials engineering, assembly of zoning, deed, and other
restrictive land use information, and environmental assessments and impact statements.

The project budget includes the following special services:
a) WPAP Application Preparation and TCEQ Fee, and
b) Coordination with USCOE for mitigation measures.
3) Identifying and analyzing requirements of governmental authorities having jurisdiction to
approve the design of the project, and participating in consultations with such authorities.
4) Providing analyses of the City's needs, planning surveys, and comparative evaluations of
prospective sites and solutions.
5) Consulting with the City, reviewing preliminary reports, clarifying and defining the project
requirements, reviewing available data, and discussing general scheduling. Conferences may also
be required with approving and regulatory governmental agencies and affected utilities.
6) Advising the City as to whether additional data or services are required, and assisting the
City in obtaining such data and services.
7) Preparing preliminary design documents consisting of final design criteria, preliminary
drawings, outline of specifications, and written descriptions of the project. A maximum of five
copies will be provided to the City.
8) Preparing revised opinions of probable total project costs.
Final Design Phase. This phase of project development is undertaken only after the City has
approved the preliminary engineering phase material. The basic services for the final design phase
includes:
1) Preparing construction drawings and specifications showing the character and extent of the
project based on the accepted preliminary engineering documents.
2) Preparing and furnishing to the City a revised opinion of probable total project costs based
on the final drawings and specifications.
3) Furnishing the necessary engineering data required to apply for regulatory permits from
local, state, or federal authorities. This is distinguished from and does not include detailed
applications and supporting documents for government grant-in-aid or planning grants that
would be furnished as additional services.
4) Preparing basic documents related to construction contracts for review and approval by the
City (and the City's legal and other advisors). These may include contract agreement forms,
general conditions and supplementary conditions, invitations to bid, instructions to bidders,
insurance and bonding requirements, and preparation of other contract -related documents.

5) Furnishing to the City a maximum of five copies of drawings, specifications, and other
contract documents.
Bidding Phase/Negotiation Phase. Services under this phase include:
1) Assisting the City in obtaining bids for the prime construction contract, maintaining a
record of prospective bidders to whom bidding documents have been issued, attending pre-bid
conferences, and receiving and processing deposits for bidding documents.
2) Issuing addenda as appropriate to interpret, clarify, or expand the bidding documents.
3) Assisting the City in determining the qualifications and acceptability of prospective
constructors, subcontractors, and suppliers.
4) When substitution prior to the award of contracts is allowed by the bidding documents,
consultation with and advising the City as to the acceptability of alternate materials and equipment
proposed by the prospective constructors.
5) Providing assistance to the City in evaluating bids or proposals and in assembling and
awarding contracts for construction, materials, equipment, and services.
Construction Phase. Services under this phase involve consulting with and advising the City
during construction and are limited to those services associated with performing as the City's
representative. Such services comprise:
1) Preparing for and conducting a preconstruction conference and issuing a Notice to Proceed
on behalf of the City.
2) Reviewing shop and erection drawings submitted by the constructors for compliance with
design concepts.
3) Reviewing laboratory, shop, and mill test reports on materials and equipment.
4) Visiting the project site monthly as construction proceeds to observe and report on the
progress and the quality of the executed work.
5) Issuing necessary interpretations and clarifications of contract documents, preparing
change orders requiring special inspections and testing of the work, and making recommendations
as to the acceptability of the work.
6) Preparing sketches required to resolve problems due to actual field conditions
encountered.
7) Determining amounts of progress payments due, based on degree of completion of the

work, and recommending issuance of such payments by the City.
8) Preparing record drawings from information submitted by the Contractor.
9) Making a final inspection and reporting on completion of the project, including
recommendations concerning final payments to constructors and release of retained percentages.
Statement Regarding Non -Collusion; Prohibited Financial Interests; Prohibited Political
Influences: (Per Article 36 in the Master Service Agreement): Professional.hereby represents
and warrants to City that Professional shall not perform any work or services for a third party
that is potentially or actually related to, connected to, a part of, or integral to the work or
services that it has performed is or is performing for the City under this Task Order.
Professional shall have the affirmative duty to bring all such conflicts or potential conflicts to
the attention of the City, and Professional agrees that the City shall be the sole judge as to
whether a conflict or potential conflict of interest with work for private parties or Developer
work exists. If in the judgment of the City such a conflict or potential conflict between City
work and Developer work exists, then Professional agrees to terminate all work under the
affected Task Order(s) immediately and that it shall not be eligible for payment for such
services.

Consideration and possible action for the award of the annual bid for electric metering
material to various bidders in the estimated amount of $200,000.00. Kenneth Arnold, Energy

ITEM SUMMARY:
Bids were received for the purchase of electric metering material on a one-year period
beginning October 1, 2009. The staff recommendation is to award this bid to the low bidder for each
item, as designated on the attached bid tabulation
This equipment is stocked in the City warehouse and is used primarily for the new
installation and for replacement of existing meters and metering equipment. Material will be
ordered by the using department on an as needed basis.

ITEM SUMMARY:
The purpose of the proposed ordinance is to establish procedures for the abandonment and sale of city -owned
property and to provide the City staff and the public with a timely procedure for reviewing and processing
these transactions.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS ADDING NEW CHAPTER 12.10 TO THE
CODE OF ORDINANCES RELATING TO ABANDONMENT AND
SALE OF CITY LAND, STREETS, EASEMENTS AND RIGHTS OF
WAY; PROVIDING A PENALTY CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, the City Council of the City of Georgetown desires to codify its
procedures for the abandonment and sale of city land, streets, easements, and rights of
way; and
WHEREAS, establishing procedures will assist the City and the public in timely
review and processing of these transactions as contemplated herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, that:
SECTION 1 The facts and recitations contained in the preamble of this
Ordinance are hereby declared to be true and correct and are incorporated be
reference herein and made a part hereof, as if copied verbatim. The City
Council hereby finds that this Ordinance implements the following 2030
Comprehensive Plan Goals, Policies and Actions:
Goal 4.1 Efficient, Responsive Government.
4.1.13 We have created and enforced innovative, effective and fair regulatory codes
and developed standards to guide growth and improve development quality. We
have streamlined the regulatory process, particularly for desired development
types and locations.
Further, the City Council hereby finds that the enactment of this Ordinance is not
inconsistent with or in conflict with any other 2030 Comprehensive Plan Goals, Policies
and Strategies.

SECTION 2 New Chapter 12.10 is hereby added to the City of Georgetown
Code of Ordinances as follows:
CHAPTER 12.10 ABANDONMENT AND SALE OF CITY LAND, STREETS,
EASEMENTS AND RIGHTS OF WAY
Section 12.10.010. Sale of City Land Generally.
Subject to the provisions of Section 12.10.050, any land owned by the City, other than
land described in Sections 12.10.020, 12.10.030, 12.10.040, that the City Council finds and
determines is not needed for City purposes, may be sold by the City Council and such
sales shall be subject to all applicable procedures in state law.
Section 12.10.020. Abandonment and Sale of Streets and Alleys.
(A) The City Council may sell streets or alleys, whether owned in fee or used by
easement, to the abutting owner or owners in proportion to the underlying fee
ownership as exists, or would exist if by easement, under the terms and conditions of
this Section. Apportionment will be based on the linear foot pro rata share of the
existing abutting property lines to the centerline of the street or alley.
(B) Upon the submittal of a completed application on a form approved by the City,
payment of the required application fee, and obtaining written consent of all abutting
owners on both sides of the portion of the street or alley proposed to be abandoned and
sold, the City Manager, or his designee, as defined in Section 12.10.060, shall review the
application. In reviewing the application, the City Manager shall evaluate whether the
street or alley is needed for current or future public purposes.
(C) If the City Manager finds and determines that the street or alley or portion
thereof is needed for current or future public purposes, the application shall be denied.
(D) If the City Manager finds and determines that the street or alley is not needed for
current or future public purposes, the City Manager shall prepare an ordinance
authorizing abandonment and a quitclaim deed and the request shall be forwarded to
City Council for final consideration.
(E) If the City Council approves the ordinance and quitclaim deed, and upon
payment by the applicant of all closing costs and recording fees, the City will record the
ordinance in the real property records of the County in which the property is located
and deliver an executed quit claim deed affecting abandonment to the owner(s) of the
fee simple title thereto, or to the abutting owner(s).

Section 12.10.030. Abandonment and Sale of Public Utility Easements
(A) Public Utility Easements (not including easements for streets or alleys) may be
sold to the abutting owner or owners in proportion to the underlying fee ownership
under the terms and conditions of this Section. Upon the submittal of a completed
application and payment of the required application fee, the City Manager shall
evaluate whether the easement is needed for current or future public purposes.
(B) If the City Manager finds and determines that the easement is needed for current
or future public purposes, the request shall be denied.
(C) If the City Manager determines that the easement is not needed for current or
future public purposes, he shall prepare a resolution authorizing abandonment and a
quitclaim deed and the request shall be forwarded to City Council for final
consideration.
(D) If the City Council approves the resolution, and after payment by the applicant
of all closing costs and recording fees, the City Manager will deliver an executed
quitclaim deed effecting abandonment to the owner(s) of the fee simple title thereto.
Section 12.10.040. Abandonment and Sale of Narrow Strips of Land.
The City Council may sell fee -owned narrow strips of land, or land so shaped as to be
incapable of being used independently, to the abutting owner or owners, under the
terms and conditions of this Section and in proportion to the abutting ownership.
(A) Apportionment will generally be based on:
(1) The projection of existing abutting property lines over such narrow strip;
or
(2) Street frontage, if any; or
(3) Access to the property;
said apportionment to be determined by City Council, which determination will be
final.
(B) Upon the submittal of a completed application on a form approved by the City,
payment of the required application fee, the City Manager shall review the application.
In reviewing the application, the City Manager shall evaluate whether the narrow strip
of land is needed for current or future public purposes. If the City Manager finds and

determines that the narrow strip of land is needed for current or future public purposes,
the application shall be denied.
(C) If the City Manager finds and determines that the narrow strip of land is not
needed for current or future public purposes, the City Manager shall prepare a
resolution and quitclaim deed authorizing sale of the narrow strip of land and the
application shall be forwarded to City Council for final consideration.
(D) If the City Council approves the resolution and quitclaim deed, and upon
payment by the applicant of all closing and recording fees, the City will deliver an
executed quit claim deed affecting the sale to the owners of the simple title thereto, or to
the abutting owners.
Section 12.10.050. Conditions to All Sales.
(A) Applications under this Chapter shall be made on forms approved by the City
and accompanied by a non-refundable fee of Three Hundred Dollars ($300.00).
(B) Nothing in this Chapter shall be construed to require the City Council to accept
any bid or offer, or be required to consummate any sale of any land or property interest
or to give any person a vested right to compel the City either to abandon, vacate or
dispose of any land or any easement or right therein, or to compel or require that the
same be upon any particular or exact terms or consideration.
(C) Any applicant under Sections 12.10.020, 12.10.030 or 12.10.040 shall be required
to make a cash deposit with the City equal to the City's estimate of its cost to obtain
appraisals of the land or property interest in question, or any re -appraisal thereof
requested by or on behalf of the applicant, as reflected by the estimates of the cost to
perform such work submitted by the appraisers selected by the City. All such
appraisals or re -appraisals shall be obtained in the name of, and solely for the use and
benefit of, the City. The sums deposited hereunder shall be applied to the purchase
price of the land or property interest under Sections 12.10.020, 12.10.030 or 12.10.040 if
the abandonment and sale is completed. The entire amount so deposited shall be
forfeited by the applicant to the City the event the abandonment and sale is not
approved or completed.
(D) If the City Council approves a sale of property, the applicant must pay for all
associated closing and recording costs.

(E) The City Council shall not sell any interest in real property in which the most
recent appraised value, as determined by the Williamson Central Appraisal District, in
excess of Ten Thousand Dollars ($10,000.00), unless the property has been appraised by
at least one independent qualified professional appraiser selected by the City.
Section 12.10.060. Authorized City Representatives.
The City Council hereby delegates to the City Manager, and to any authorized deputy,
assistant director, manager, or City staff person that the City Manager may designate,
the authority to perform the functions contemplated in this Chapter.
Section 12.10.070. Preliminary Evaluation.
An applicant under Sections 12.10.020, 12.10.030, or 12.10.040 may submit an informal
request in writing to the City of Georgetown identifying the property requested to be
abandoned or sold. The purpose of the informal request is to provide the applicant
with the option to not submit a formal application, nor pay the accompanying fees, if
after preliminary evaluation, the Authorized City Representative(s) do not support the
proposed abandonment or sale of the property. The process for making an informal
request and/or formal application will be set out in "Instructions for Applications for
the Abandonment of a Public Street, Alley, and/or Public Right -of -Way, or a portion
thereof, in the City of Georgetown", which instructions will be provided to the
applicant with the application form.
Section 12.10.080. Exceptions.
(A) This Chapter shall not apply to transactions involving the Georgetown
Municipal Airport, or to land proposed for conveyance or disposition in
connection with any economic development project, parkland or cemetery
land.
(B) If this Chapter is found to be in conflict with state law, state law shall
prevail.
SECTION 3 All Ordinances and Resolutions, or parts of Ordinances and
Resolutions that are in conflict with this Ordinance are hereby repealed, and no
longer in effect.
SECTION 4 If any provisions of this Ordinance or application thereof to any
person or circumstance, shall be held invalid, such invalidity shall not affect the
other provisions, or applications thereof, of this Ordinance which can be given

effect without the invalid provision or application and to this end the
provisions of this Ordinance are hereby declared to be severable.
SECTIONS The Mayor of Georgetown is hereby authorized to sign this
Ordinance and the City Secretary to attest. This Ordinance shall become
effective and be in full force and effecting accordance with the terms of the City
Charter.
