Brandenburg, City Manager Cover Memo Item # A City of Georgetown, Texas September 14, 2010 SUBJECT: Presentation and discussion regarding the Utility Impact Fee Review Committee report -- Glenn W. Dishong, Utility Director ITEM SUMMARY: The adoption of a new Impact Fee is required every five years by Local Government Code, Chapter 395, and at least every three years as directed by City Council. The Impact Fees were last updated in October 2005. The process of adopting a new impact fee was initiated to revise the current fees in accordance with the Local Government Code. The Local Government Code, Chapter 395, requires the City of Georgetown to establish an impact fee committee to oversee the creation of the Capital Improvements Program and information regarding financial impact for the creation and adoption of a new impact fee. The committee will present recommendations, reflecting true costs of service for completion of the water and wastewater capital improvements infrastructure projects for the next 10 years, for Council adoption. Intended to mitigate rate impacts arising from the capital costs of new development and help make growth pay for itself. Impact fees in Texas are statutorily addressed in Chapter 395 of the Local Government Code. Item # B whatis an Impact Fee.? The real issue underlying impact fees and rates is, "Who pays for utility capacity related to growth?" If there are no impact fees, rate -payers carry the capital costs for new development. If there are impact fees, the costs are shared. Weighted Capacity Cost per LUE — Rate Credit per LUE = Maximum Impact Fee per LUE Item # B Verify that the land use basis for the CIP and the CIP itself have been reasonably defined. • Verify that the maximum water and wastewater impact fees have been reasonably calculated, and the resultant maximum fee is $X for water and $Y for wastewater. • Recommend a new fee for water and wastewater (less than or equal to the maximum) for Council consideration. Item # B 11 ;L'o' "Ll—o", F The land use assumptions and Capital Improvements Plans underlying the maximum fee calculations are consistent with State law and good engineering practices. By a 7-0 vote, the Advisory Committee finds that the data and methodology underlying the maximum impact fee calculation are reasonable and useful for City purposes. By a 7-0 vote and consistent with State law, the Committee recommends the wastewater impact fee (outside of the South/Middle Fork San Gabriel) be lowered and set at the maximum $1,694 per SU calculated with this update. By 7-0 vote, the Committee recommends that the Council consider the other water and wastewater impact fees be set at the maximum calculated fees.
