The City of Georgetown is committed to compliance with the Americans with Disabilities Act (ADA). The following Members were in attendance: Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, Ben Stewart, and Josh Schroeder 1. Executive Session In compliance with the Open Meetings Act, Chapter 551, Texas Government Code, Vernon's Codes, Annotated, the items listed below will be discussed in closed session and are subject to action in the regular session. Mayor Schroeder called the meeting to order at5:14 p.m. The Council then immediately recessed into Executive Session'. When the the meeting was called to order Triggs was not on the dais, but he did join the Council for Executive Session. 1.A Executive Session 1132.2024 Sec. 551.071 Consultation with Attorney Advice from attorney about pending or contemplated litigation and other matters on which the attorney has a duty to advise the City Council, including agenda items. Mayor Schroeder called this portion of the meeting to order at 6.14 p.m. 2.A Call to Order 11.12.2024 Pledge of Allegiance Recognitions Shop Small Proclamation Action Out of Executive Session 3. Public Wishing to Address Council On a subiect that is posted on this agenda: Please fill out a speaker registration form which can be found on the table at the entrance to the Council Chamber. Clearly print your name and the letter of the item on which you wish to speak and present it to the City Secretary on the dais, prior to the start of the meeting. You will be called forward to speak when the Council considers that item. Only persons who have delivered the speaker form prior to the meeting being called to order may speak. Speakers will be allowed up to three minutes to speak. If you wish to speak for six minutes, it is permissible to use another requestor's granted time to speak. No more than six minutes for a speaker maybe granted. The requester granting time to another speaker must also submit a form and be present at the meeting. An item may be pulled from the Consent Agenda in order to be discussed and acted upon individually as part of the Regular Agenda. Mayor Schroeder recused himself for the Consent Agenda due to a conflict with Item 4.Xw Moved by Jake French; seconded by Ron Garland to Approve as presented. LegislativeRegular Agenda 5.A First Reading - 2024-12-SUP - 508 Riverbend Drive Public Hearing and First Reading of an Ordinance on a request for a Special Use Permit (SUP) for the specific use of `Personal Services, Restricted' in the Local Commercial (C-1) zoning district on the property located at 508 Riverbend Drive, Georgetown, Texas, bearing the legal description of Part of Lot 1,'Block 10 out of the Quail Meadow Unit III Subdivision (2024-12-SUP) --- Sofia Nelson, Planning Director Nelson presented and reviewed: UDC definition of Personal Services, Restricted; Aerial Map; site photos; inventory of existing and entitled uses; Zoning Map; Future Land Use/Overall Transportation Plan Map; Medium Density Mixed Housing in the Williams Drive Gateway Plan; Local Commercial (C-1) zoning designation; Special Use Permit explanation; and how the application complies or does not comply with the approval criteria for UDC Sections 3.07.03 and 3.06.030. She then noted that public notifications were sent and to date staffhasreceived one written comment in opposition; and at their October 14, 2024 meeting, the Planning and Zoning Commission recommended approval of the request with a 7-0 vote Nelson read the Ordinance caption. Mayor Schroeder opened and closed the public hearing at 6.22 p.m. as there were no speakers. Motion Approved: 7- 0 Voting For: Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, and Ben Stewart Voting Against: None 5.13 first Reading - 2024-7-SUP 1301,1303 and 1305 Blue Ridge Drive Public Hearing and First Reading of an Ordinance on a request for a Special Use Permit for the ,specific use of 'Warehouse and Distribution, Limited', in the Business Park (BP) zoning district for the property located at"1301 Blue Ridge Drive, Suites 106, 107, & 108, 1303 Blue Ridge Drive, Suites 304, 305, 308, & 309 and,1305 Blue Ridge Drive, Suites 502, 503, & 504, Georgetown, Texas, being a portion of Lot 1, Block C out of the Windmill Hill Phase 5 Subdivision (2024-7-SUP) -- Travis Baird, Assistant Planning Director - Current Planning Baird presented and reviewed: Aerial Map; site photos; nearby development; inventory of nearby existing or entitled uses; Zoning Map; Future Land Use/Overall Transportation Plan Map; Pegional Center (RC) zoning designation explanation; Business Park (BP) zoning designation explanation; Special Use Permit (SUP) explanation; Warehousing and Distribution, Limited explanation; proposed site plan; and how the application complies, partially complies, or does not comply with the approval criteria for UDC Section 3.07.030. He then noticed the proposed conditions of the hours of operation for the suites subject to this request shall be limited to 7:00 a.m. - 6:00 pm., light shields shall be installed on uncovered outdoor lighting, and trash collection shall take place after 8:00 a.m. Baird stated that notices were sent and to date staff has received 6 written comment in opposition; and at their October 15, 2024 meeting, the Planning and Zoning Commission failed to approve a motion of approval with a 6-1 vote, resulting in a denial of the request. Baird read the Ordinance Caption. General discussion among Council and staff regarding how the proposed conditions would apply to the suites in the application, specific location of the specified usage, and differences between warehouse and distribution business types. Shannon Mattingly presented on behalf of the applicant and reviewed: site aerial and property facts; project details; SUP units requested; current/requested entitlement; warehouse and distribution, limited definition; community outreach; proposed restrictions to add to the SUP based on outreach with the neighborhood; SUP reduction; current buildings; and developer's existing project. General discussion among Council, applicant, and staff regarding timing of trash pickup, reason for including certain suites in the application and not all, different units having different operating hours, consideration for moving dumpsters to new location on the property, and difficulty associated with moving them. Mayor Schroeder opened the public hearing at 7:02 pm. Katherine Smith received time from Karin Cook; Braden Gilbert received time from Lori Alvarez; John Oliver; Mary Oliver; Scott Engebrit received time from Vivienne Engebrit; Greg Hight; and Linda Machery Kuriakose all addressed the Council regarding their concerns with the project. Main topics of concern were related to the timing of garbage collection, noise happening on the properties at all hours of the night, how the nearby neighbors disagree with some aspects of the staff reporting regarding the property, trash leaving the property and making it's way into yards, how the developer has not been,a good neighbor, brightness of the lights on the property, demographics of the neighborhood, and how the clevelopTnent negatively impacts the neighborhood. Mayor Schroeder closed the public hearing at 7:32 p.m. General discussion among Council and staff regarding how a denial of tonight's items does not remedy all of the neighbors concerns, not correct use for the area, addressing concerns related to lighting, possible changes to the SUP to meet the needs of all involved, trash concerns with roll off dumpsters, impacts of a denial versus approval with conditions, acceptable times for noise based on the City"s noise ordinance, concerns related to sounds of roll off dumpsters, and what the City can do to work with TDS'regarding pickup times. Moved by Ben Stewart; seconded by Jake French to Amend postpone item to November 26, 2024, council meeting. Motion Approved: 7- 0 Voting For. Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, and Ben Stewart Voting Against: None 5.0 First Reading - 2023-21-REZ - 552 Stadium Drive Public Hearing and First Reading of an Ordinance on a request for a Zoning Map Amendment to rezone Lot 1, -Block -A, D&L Printing Subdivision, from the Agriculture -(AG) zoning district ;to the Industrial (IN) zoning district, for the property generally located at 552 Stadium Drive, Georgetown, TX 78626 (2023-21- REZ) Travis Baird, Assistant Planning Director - Current Planning Baird presented and reviewed Location Map, site photo, Aerial Map, Zoning Map, Future Land Use/Overall Transportation Plan Map, Industrial (IN) zoning designation explanation, IN uses permitted by right, with limitations, and with an SUP, how the application complies or does not comply with the approval criteria for UDC Section 3.06.030, and Comprehensive Plan guidance. He added notifications were sent and to date staff has received no comments; and at their Novembers, 2024, meeting, the Planning ,and Zoning Commission recommended approval of the request with a 7-0 vote. Baird read the Ordinance caption: General discussion among Council and staff regarding health, safety, and welfare criteria, rezoning brought upon by currently being out of compliance,and issues that would arise if the property continues to be a nonconforming use. Mayor Schroeder opened and closed the public hearing at 8:15 p.m. as there were no speakers. General discussion among Council and staff regarding how the change in zoning is appropriate with the existing use. Moved by Jake French; seconded by Shawn Hood to Approve as presented. Motion Approved: 6-1 Voting For: Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, and Ron Garland Voting Against: Ben Stewart 5.D First Reading of an Ordinance Regarding Paid Parental Leave First Reading of an Ordinance amending Chapter 3.01 of the Code of Ordinances adding paid parental leave as an additional leave benefit for eligible employees Wayne Nero, Assistant City Manager Nero presented and reviewed purpose, background, comparable cities trend, survey results and length of leave offered, eligibility for leave, specifics of surveyed cities, and proposed City of Georgetown policy highlights. Nero read the Ordinance caption. There was no Council discussion regarding this item. Moved by Ran Garland; seconded by Amanda Parr to Approve as presented. Motion Approved: 7- 0 Voting For: Amanda Parr, Shawn Hood, Mike Triggs, Kevin Pitts, Jake French, Ron Garland, and Ben Stewart Voting Against.
