COIv]KISSIONER OF THE SAID CITY, AIM PROVIDING HOWL A-7PLICATION
FOR SUCH CONSENT SHALL BE WOE, KYD PROVIDING THAT THE PERSON
MAKING SUCH EXCAVATION SHALL REPAIR A7TD RESTOT-2 THE PAVEMENT
AND PROVIDING A PENALTY FOR A VIOLATION THEREOF, AND PROVIDING
AN EMERGENCY.
BE IT ORDAINED by the City Council of the City of
Georgetown, Texas that.
It shall hereafter be unlawful for any person or persons
to dig up or make any excavation upon any paved street in
this City, without first obtaining the written consent of
the Street Commissioner of the said City, based upon the
written application of such person or persons. That such
application, shall set out in detail, the desired excavation
to be made, and the location thereof, and shall be accompanied
with a cash payment to the said City of the sum of $100.009
to be retained by the said City in satisfaction of the damage
that may thereafter develop by reason of such excavation.
That any excavation, so made, shall within one day
thereafter, be refilled, the ground thoroughly tamped, the
foundation for the pavement relaid, thoroughly set and packed;
and the topping place thereon, as nearly like the original
street, as practicable, within ten days, by the person making
the said excavation, or causing same to be made.
That any person violating any of the provisions of this
ordinance, shall on conviction be fined in any sum not less
than Twenty-five Dollars, and not more than Two Hundred Dollars.
That, whereas, the City has determined to pave certain
of the streets, and whereas, any excavation on any portion
of the streets so paved will greatly damage the same, and
whereas, there is property along each of the streets proposed

to be paved that is not now connected with the sewer
mains and the water mains along said streets, and that
excavations on said streets will be necessary, if the
said property is so connected; makes an emergency, that
this ordinance be and take effect from and after its
passage, in order that persons wishing to make any ex-
cavations on any of said streets may do so, before the
said streets are paved.
