HomeMy WebLinkAboutORD 04.09.1923 - Property Assessment Tenth StreetORDINANCE DETERMINING THE ASSESSnNT AGAINST PROPERTY, ;.ND OWN- ERS TBEIMOF ABUTTING UPON TENTH STRELT, TO BE PAVED IN THE CITY OF GEORGEri0111, TEXAS: A resolution of the City Colmcil of Georgetown, Texas, determ- ining the necessity of levying an assessment against the property and the ovnere thereof, abutting upon loth Street, within the City of Georgetown, Texas, fixing a time for the hearing of the ov:ners of said property and declaring -amie to be an emergency measure to-vit: Be it resolved by the City Council of the City of Georgetown, Texas: THAT INHEHEAS, The City Council of the City of Georgetown have heretofore, by -resolution, ordered the improvement of loth Street from I. & G. N. R. R. to best Property line of Brushy Street kith Uvalde Rock Asphalt, and the building of curb and gutters on either side of said strcet, when and .:here found necessary, in accordance with the terms of said resolution; and t:HLREAS, in a�:;ordance . ith law and the City Charter of -aid City of Georgetown, after advertising for bids, the cork of improving the above mentioned street, between -laid points, to be improved with Uvalde Rock Asphalt has been let to I. E. Dozier; and VIMItEAS, a contract has been entered into between the said City of Geergeto= and W. E. Dozier, on the 7th day of July, 1922; and WHEREAS, W. N. Harris, The City Engineer of said City of George- town, Texas, in accordance with a resolution of said City Council heretofore passed, has filed his report with the City Council as to the cost of said improvements and as to the matter recsired by law and said resolution, which report or statement so filed by said City Engineer, has been duly approved; and VvMR .i.S, the City Council of said City of Georgetordn, has finally determined to Cassess a part of the cost of said improvements against the said oviners and their property. 1st. That it is finally determined hereby to assess such part of the cost of said improvements against the owners of said property and against their property, as hereinafter provided. 2nd. That a htarir_g --hall be given to the ov,ners of the said property or their agents or attorneys, and all persons interested in the said matter us to i.heir assessm+_.nts and as to the amc unt to be assessed against each o mer ;�..nd his property,:and as to the benefits to said property from said improve.�ments or any other thing in con- nection therel�;ith, which hearing shell be had in the City Hall of Georgetozn, Texas, on the 30th day of "pril, 1923, at 2:30 o'clock, P. M. at ,,-,hich time all said o:•.nt-,rs, their agents or attorneys, or persons interested in said property are notified to appear and be heard; at v,,hich hearing said ov-ners or other persons may appear by council or in person, and may of'fer evidence, and said hearing shall be adjourned from day to day until finally accomplished. And the 4cc e' G 0(,&Aanc C5 19Z0 K-9-19z3 City Clerk of the paid City of Georgetown, Texas, is hereby directed -;nd ordered to give notice of said hearing by having this resolution published three times in the Williamson County sun, the first publi- cation t-e be made at least ten days before the date of such hearing, and to mail each owner, their agents or attorneys, a copy thereof, at least ten days before the date of such hearing. 3rd. That after said hearing -aid City Coimcil will, by ordi- nance, assess against the owners of said pro-perty and against their property, such sums as shall be determined to be just and equitable, and that aa.id assessment will be made in accordance with the "Front Foot Plan", as the frontage of the owner is to the whole frontage to be improved, provided that if the said plan shall be determined in any case to be unjust or inequitable, that the City Ceimcil will adopt such rule or apportionment as shall be just end equitable, hav- ing in mind the benefits to each ct,ner, and the burdens imposed up- on them, provided that no assessment shall be made against any owner or his property in excess of the benefits to said property in enhanced value the? eof , by means of such improvements. 4th. That the total cost of such improvements as shown by the reports of the City Engineer, which report is made a part of this resolution is the sum of $9616.34. ThGt the proportion of the cost which it is proposed to assess against property o'�e,ners and their pro- perty is $5655.74. That the amount per front foot .,,hick it is propos- ed to assess against each parcel of property and its owner, not in- cluding the cost of curbs and gutters, all of .Yhich cost of curbs and gutters is assessed against the respective property owners, is, to- „it: $1.82. 5th. That the names of persons, firms, corporations and es- tates owning property abutting the improvements, the descriptions of their property and the total amount including the cost of curbs and gutters, to be assessed udainst each parcel of property and its ot,;ner is as follows, to -gait: Geo rgc town, Texas, April 9th, 1923. TO THE CITY 'COUNCIL OF THE CITY OF G ORCETUI'.'N, TEXAS: In accordance tgith your directions contained in resolution heretofore passed, I have made a preliminary estimate of the total cost of the improvement of the street, covered by Zesolution, of your body to be improved, the proportion to be paid by the City of Georgetown, and the property o-ners, the cost per lineal foot to be assessed a- gainst the property owners and their property, the names of the property ov=:ners and a description of the _property ov°ned by them and the total cost to be assessed against each, and beg to erevrith submit my said estimate and report thereon. That the fact that the street named to be improved is in great need of improvement, creates a public necessity that this resolution be and the same is hereby declared to bean emergency measure and that it take effect from and after its passage and ap- proval by the Wyor and City Council.
