Section 1. BE IT ORDAINLD by the City Council of the City of Georgetown, Texas, that the right is herby granted to George- town Telephone Company, its successors and assigns, to construct, operate and maintain its lines of poles, wires and fixtures con- nected therewith, along, in and upon the streets, alleys anti public grounds of -the City of Georgetown, for the purpose of maintaining and operating a telephone exchange in said City, and to maintain and operate the same for the term of twenty-five years from the date and passage of this ordinance. Section 2. The said Georgetown Telephone Company is also hereby granted the right to construct underground conduits along and under all the streets, alleys and public grounds of the said City of Georgetown, and to place therein its wires and cables and to connect same with its overhead telephone construction in said city of Georgetown and such other overhead construction as may be from time to time convenient and necessary for the purpose of operating its telephone system in said City, and to maintain and operate the same so connected and ;laced for the ,term of this franchise. Section 3. Said telephone poles, wires and fixtures, shall be constructed and maintained subject to the reasonable regulations of the City Council of said City of Georgetown, and erected at such places as the Council may direct, and said underground conduits shall be placed along such sides of said streets and alleys and at such places as may be provided by said City Council. The said Georgetown Telephone Company shall not of Get t ; %'IN i p(D4A&INC4 be required to construct underground conduits but may do so at such times and on°such streets as in the judgment of said Georgetown Telephone Company, the same may be necessary for the proper maintenance and operation of said telephone plant and exchange in said City ; and if such underground conduits shall be constructed, then the same shall be so placed as not to interfere with the use and operation of any water or sewer pipes owned and maintained by the said City of Georgetown or any person or corporation maintaining such system or systems for public use and under authority of said City; and if such underground conduits are constructed, then said Georgetown Telephone Company, shall repair and place such streets and alleys in the same condition as same were in before such con- duits were constructed. Section 4. The said telephone p©les, wires, conduits and fixtures shall be so placed and maintained as not to incommode public travel in sia,d highways after the same are constructed, and the said Georgetown Telephone Company shall hold said City free from all Damages that may be recovered against it by reason of any negligence on the part of said Georgetown Telephone Company, in the construction, maintenance and operation of the said telephone plant. Section 5. The rights herein granted are not exclusive, but the City Council may grant similar rights to any other per- son or corporation at any time, provided such grant shall not interfere with the proper exercise of the privileges herein granted. Section 6. In consideration of the rights granted to herein by said city, the Georgetown Telephone Company agrees to pay to the said City of Georgetown, on or before the first of January, of each and every year during the term of this franchise the sum of 3100.00, the first payment to be made on the first day of January. Section 7. Said Georgetown Telephone Company shall, as soon as same can reasonably be done, build and install in said city a complete modern central energy or common battery telephone system and in order to install such system it is under- stood that said company shall install a new central energy or common battery switchboard in its exchange of sufficient cap- acity to take care of all its business, and shall install for all subscribers new central energy or common battery phones, and that lead cable shall be installed and used for all main leads at the time of cutting in such new system. No charge shall be made against subscribers who have old phones for in- stalling such new phones. Section 8. Pending the completion of said new system and until said new system is completed and cut into service the rates now being charged shall remain in effect. Section 9.'When said system is completed and cut into service, then the maximum rates and rentals to be charged for local telephone sevice in said City, unless changed in the manner and at the time hereinafter set out, shall not exceed, for one year contracts the following: For business phones $4.25 per month. phone extension $1.00 per month. " residence phones $2.25 per month phone extension $.50' " Two party selective ringing party lines, $1.75. " Four party selective ringing party lines, $1.50. Desk phones $.25 per month extra. Where phone is taken for less than a year $.50 per month may be added to above rates. Insailment of phone, $3.50 Inside Change $2.00 Outside Change• $3.50 Hotels, boarding and rooming houses shall pay $4.25 per month. and every residence occupied by two families, who use the same phone, or in which two or more rooms are rented and the occupants of the rented rooms use the phone in such residence shall pay $4.00 per month. Section 10. The rates provided for in section 9 hereof shall remain in force for a term of five years from the time they take effect. The rates to be charged by the company for local telephone service shall be subject to readjustment and change every five years from the time they go into effect and such change and read'j-UBtment shall be made by agreement be- tween the City and the Company, provided an agreement thereon can be reached. It is contemplated that in any such change or readjustment the Company shall be entitled to such rates, and only such rates, as till give it a fair and reasonable return on its investment. If at the end of any such five year period the City and Company cannot agree on such readjustment of rates$ then either party shall have the right to pursue such remedy and to take such action as it deems proper to arrive at and es- tablish the rates to be charged. Section 11. This ordinance shall take effect and be in force from and after its passage and the filing by said company of an unconditional written acceptance of the terms of this franchise in the office of the City Cl-erk of said City of Georgetown.
