HomeMy WebLinkAboutORD 09.13.1965 - IH-35 LightingORDINANCE AUTHORIZING THE MAYOR OF THE CITY BF GEORGETOWN WILLIAMSON COUNTY, TEXAS, TO MAKE A FORMNL WRITTEN REQUEST TO THE TEXAS HIGHWAY DEPARTMENT OF THE STATE OF TEXAS, FOR CONTINUOUS LIGHTING FACILITIES OF THE ROADSIDE OF INTER- STATE 35 FROM LEANDER ROAD INTERSECTION WITH INTERSTATE 35 TO THE ANDICE ROAD INTERSECTION WITH U. S. HIGHWAY 35 TO LESSEN THE HAZARDS TO TRAFFICE CAUSED BY DEER CROSSING: WHEREAS, that area of U. S. Interstate Highway 35 lying between Leander Road Intersection ind the Andice Road Intersection has been and is used by deer for ingress and egress crossing said Interstate 35 to available water in San Gabriel River; and WHEREAS, the use of said area Cy such deer will constitute a traffic hazard to motorist using said Interstate 35, and WHEREAS, said traffic hazard would be condiderable lessened if said area were so equipped with continuous lighting in said area; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: The Nayor of Georgetown is hereby authorized and directed to make writte petition to the Texas Highway Department of the State of Texas through its appropriate official for the erection of continuous lighting to be located along side U. S. Highway 35 in the area lying between the Leander Road Intersection with sia d Interstate Highway and the Andice Road Intersection with said Inter - State Highway, and said Mayor is further directed to call to the attentiion of said Texas Highway Department the clear and present danger wraich will be pre- sented by roaming deer is ing said area as pathway going to and from a supply of water located in the San Gabriel River and to further advise said Texas Highway Department that if and after said facilities are furnished and erected by said Department that the City of Georgetown shall at its cost and expense operate and maintain said facilities in the future. DULY APPROVED AND ENACTEN this the 9th day of August 1965 at the regular meeting of the City Council of the City of Georgetown, Texas. MAYOR+ CITY OF GEORGETOWN, TEXAS ATTEST: CITY SECRETARY [43-6 THE STAVE OF TEXAS COUNTY OF WILLIAMSON THIS CONTRACT, is made and entered into by and between the City of Georgetown Texas, acting herein by and through its governing body, hereinafter styled First Party, and Emzy Cooper, hereinafter styled Second Party. I. First Party agrees to emply and does hereby employ Second Party to collect all delinquuent taxes, penalty and interest owing to First Party during the term of this contract. II. Seoond party agrees to furnish -stationery and postage for sending out itemized statements and Collow up notices, together with the clerical force necessary for the computation and sending out thereof, and legal services for tax suits, and tax sales if necessary, with the provision that at the request of local officials a local attorne.V mau be employed if desired by tge local authorities, if satisfactory terms can be arranged between said attorney and Second Party. III. Second Party agrees to order Title Reports from an abstract company for tax suits, giving legal description of deliiquent property, record owner, lien holder, judgements and probate records, in order that the proper information may be secured for taz suit6, the initial cost to be defrayed by Second Party, This cost is usually con- strued as a court cost at the termination of the tax suit, and if so construed, Second Party may be so reimbursed. IV. First Party agrees to pay Second Party as compensation for the services required hereunder fifteen per cent (15%) of the amount collected of all delinquent taxes, penalty and interest covered by this contract, actually collected and paid to the collector of taxes during the terms of this contract, as and when collected, provided current taxes falling delinquent within the period of this contract shall become subject to its terms on the first dA.y of June after becoming delinquent. V. This contract is drawn to cover a period of two (2) years beginning October 15, 1965 and ending October 15, 1967, providing however that attorneys hereto fore provided for shall have an additional six months to reducetjudgement alll suits filed prior to the date last mentioned. In consideration of the terms and compen- sation herein stated, Second Party hereby accepts employment and undertakes the per- formance of said contract as aobve written. This contract is executed�,on behalf of First Party by the presiding officer of its governing body who is authorized to execute this instrument by order heretofore passed and duly recorded in its minutes.
