THENCE southwesterly along said west right of way which is on a curve,

THENCE S 63*150 E, along a line that passes through Interstate Highway
35, Survey Station 708=50.8, for a distance of 689.6 feet to a point being
in the existing east right of way of U.S. Highway 81, which is the point of
beginning.

AN ORDINANCE ESTABLISHING MINIMUM HEALTH AND HOUSING
STANDARDS: PROVIDING FOR AN ENFORCING OFFICIAL: CREAT-
ING A BOARD OF HOUSING APPEALS: PROVIDING FOR THE IN-
SPECTION OF DWELLING AND PREMISES: AND PROVIDING PENALTIES
FOR VIOLATIONS.
WHEREAS, the elimination of slums and blighted areas and the prevention
of their future growth is a matter of concern to the people of the City of
Georgetown, Williamson County, Texas; and,
WHEREAS, in this City there are dwelling structures which are dilap-
idated, unsafe, and unsanitary and some to such an extent as to constitute
a menace to the health and safety of the people; and,
WHEREAS, this City has the right and duty to adopt and enforce such
health and sanitary regulations as are necessary in order to prevent the spread
of disease.
BE IT THEREFORE ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN,
WILLIA11SON COUNTY, TEXAS, AS FOLLOWS:
SECTION I. ADOPTION OF MINIMUM HOUSING CODE.
There is hereby adopted by the City Council of the City of Georgetown,
Texas, that certain health and housing standards known as 1965 Edition of the
SOUTHERN STANDARD HOUSING CODE, of which not less than three (3) copies have
been and are now filed in the office of the Clerk of the City of Georgetown,
Texas, and the same are hereby adopted and incorporated as fully as if set out
at length herein, and from the date on which this ordinance shall take effect,
the provisions thereof shall be controlling on all dwellings and premises within
the corporate limits of the City of Georgetown, Texas.
SECTION 2. ESTABLISHMENT OF THE OFFICE OF HOUSING ENFORCING OFFICIAL.
(a) The office of Building Official is hereby created.
(b) The Building Official shall be responsible for the enforcement of
this ordinance.
(c) The Building Official shall be appointed by the Mayor subjecy to
confirmation of the City Council. His appointment shall continue during good
behavior and sitistactory service. He shall not be removed from office ex-
cept for cause after full opportunity has been given him to be heard on specific
charges by the City Council; however, appeals from such orders of discharge or
other orders in this connection shall be had under the Substantial Evidence
Rule.
SECTION 3. ESTABLISHMENT OF A HOUSING BOARD OF APPEALS.
(a) There is hereby created a Board of Housing Appeals which shall consist
of five (5) members appointed by the Mayor subject to confirmation of the City
Council. One member shall be appointed to serve one(1) year, two members to
serve two (2) years, and two members to serve three 3 years.
(b) This Board shall act by majority vote of the members present.
(c) Said Board shall have the power and be required to hold public hearings
in deciding appeals where it is alleged there is an error in law or fact in any
order or decision of the Housing Enforcing Official in' the enforcement of this
ordinance.
SECTION 4. DUTIES OF THE HOUSING ENFORCING OFFICIAL.
It shall be the duty of the Housing Enforcing Official to enforce all laws
and provisions specified in the 1965 Edition of the Southern Standard Housing
Code.
SECTION 5 RIGHT OF ENTRY.
The Housing Enforcing Official, in the discharge of his official duties,
and upon proper identificati6n, shall have authority to enter any building,
structure, or premises at any reasonable hour.
SECTION 6. VIOLATIONS AND PENALTIES
In addition to the violations and penalties provided for in the 1965 Edition
of Southern Standard Housing Code, it is hereby further provided that violations
of said Code shall be punishable by a fine of not less than Ten Dollars (810.00)
nor more than Two Hundred Dollars ($200.00) or by imprisonment not exceeding
six (6) months, or by both fine and imprisonment.
SECTION 7. SAVING CLAUSE
Nothing in this ordinance or in the code hereby adopted shall be construed
to affect any suit or proceeding now pending in any court, or any right acquired,
or liability incurred, nor any cause or causes of action accrued or existing,
under any act or ordinance repealed hereby. Nor shall any right or remedy of
any character be lost, impaired or affected by this ordinance.
SECTION 8. VALIDITY
The invalidity of any section or provision of this ordinance or of the code
hereby adopted shall not invalidate other section or provisions thereof.
SECTION 9. INCONSISTENT ORDINANCES REPEALED.
Ordinances or parts thereof in force at the time that this ordinance shall
take effect and inconsistent herewith, are hereby repealed.
SECTION 10. DATE OF EFFECT
The provisions of this Code shall take effect on the 15th day of April, 1966.
