LOCP.TION AND MAINTEWANCF. OF BUILDINGS AND STRUCTURES. BE IT ORDAINED by the City Council of the City of Georgetown, Williamson County, Texas: Section 1. ADOPTION OF BUILDING CODE. There is hereby adopted by the City Council of the City of Georgetown, Texas, for the purpose of establishing rules and regulations for the con- struction, alteration, removal, demolition. equipment, nse and occupancy. location and maintenance of buildings and structures, including permits and penalties, that certain building code known as the National Building Code recomrsended by the National Board of Fire Undemriters, being particularly the 1955 ediction°thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified, or amended, of which -not less than (3) copies have been and now are filed in the officO.of the Clerk of the City of Georgetown and the same are hereby adopted and incorporated as fully as if set 16 out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling in the construction of all buildings and structures therein contained within the corporate limits of the City of Georgetown, Texas. Section 2. ESTABLISHMENT OF OFFICE OF BUILDING OFFICIAL (a) The office of building official is hereby created and the exec- utive official in charge shall be known as the building official. (b) The building official shall be appointed by the Mayor of the City of Georgetown, Texas. His appointment shall continue during good behavior and satisfactory service. He shall not be removed from office except for cause after full opportunity has been given him to be heard on specific charges. (c) During temporary absence or disability of the building official the appointing authority shall designate an acting building official. Section 3. QUALIFICATIONS OF BUILDING OFFICIAL. He shall be in good health, physically capable of making the necessary examinations and inspections. He shall not have an interest whatever, direct- ly or indirectly, in the sale or manufacture of any material, process or de- vice entering into or used in or in connection with building construction, alterations, Section 4. DUTIES OF BUILDING OFFICIAL (a) He shall receive applications required by this code, issue permits and furnish the prescribed certificates. He shall examine the inspections to see that the provisions of law are complied with and that construction is prosecuted safely. He shall enforce all provisions of the building code. He shall, when requested by proper authority, or when the public interest l so request, make investigations in connection With matters referred to in the building code and render written reports on the same. To enforce compliance with law, to remove illegal or unsafe conditions, to secure the necessary safe- guards during construction, or to require adequate exit facilities in buildings and structures. he shall issue notices or orders as may be necessary. (b) Inspections required under the provisions of the b»ildin.g code shall be made by the building official or his, duly appointed assistant. The building official may accept reports of inspectors of recognized inspec- tion services, after investigation of their qualifications and reliability. No certificate called for b�T any provision of the building code shall be issued on such reports unless the same are in writing and certified to by a responsible officer of such service. (c) The bnildinQ officia.l''shall keep comprehensive records of appli- cations, of pernits issued, of certificates issued, of inspections made, of reports rendered, and of notices of orders issued. (d) All such records shall be open to public inspection for good and sufficient reasons at the stated office hours, but shall not be removed from �. the office of the building official without his written consent. (e) The building official shall make written reports to his ir►mediate superior once each month, or oftener if requested, including statements of permits and certificates issued, and orders promulgated. Section 5. LIABILITY. Any officer or employee, or member of the Board of Adjustments and Appeals, charged with the enforcement of this code, acting for the City in the discharge of his duties, shall not thereby render himself liable personally, and he is hereby relieved from all personal liability for any damage that may accrue to 17 persons or property as a result of any act required or permitted in the dis- charge of his duties. Any suit brought against officer or employee because of such act performed by him in the enforcement of any provision of this code shall be defended by the Department of Law -until the final termination of the proceedings. Section 6. RIGHT OF ENTRY. The building official, in the discharge of his official duties, and upon proper identification, shall have authority to enter any building, structure or premises at any reasonable hour. Section 7. DEFINITIONS. (a) Whereever the word "Municipality" is used in the building code, it shall be held to mean the City of Georgetown, TLias/ (b) Whereever the term "Corporation Counsel" is used in the building code, it shall be held to mean the Attorney for the City of Georgegown, Texas. Section 8. FIRE LIMITS ESTABLISHED. The fire limits of the City of Georgetown, Texas, are hereby established by an Ordinance duly enacted by the City Council of Georgetown, Texas dated June 28, 1949 and reference to same is hereby made for all purposes. Section 9. Saving Clause. Nothing in this ordinance or in the building code hereby adopted shall be construed to affect any suit or proceeding now pending in any court, or any rights acquired, or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby. Nor shall any right or remedy of any character be lost, impaired or affected by this ordinance. Section 10. VALIDITY. The invalidity of any section or provision of this ordinance or of the building code hereby adopted shall not invalidate other sections or provisions thereof. Section 11. INCONSISTENT ORDINANCES REPEALED. Ordinances or parts thereof in force at the time that this ordinance shall take effect and inconsistent herewith, are hereby repealed. Section 12. AMENDMENTS. The Code adopted hereby is amended as follows: (a) By deleting the follow- ing: pg. (a) (d) (e) (g) (i) of section 11.5; pg. (b) section 33.3 of said code. (b) By adding the following amendment to section 23 of said Building Code and immediately following sub -section (3) to be numbered sub -section (4) as follows: (4) Outside the firelimits, dwelling, private garages and barns, separated by at least twelve feet from other buildings may be roofed with approved vertical grain or edgegrain wooder. shingles. The combined thickness of each five shingles measured at the butts shall not be less than two inches. The exposure of such wooden shingles to be the weather shall not exceed, on roofs greater than five-24ths pitch, five inches for 16-inch shingles, five and one- half inches for 18-inch shingles, and seven and one-half inches for 24-inch shingles, noron roofs with less than five-24ths pitch, but not less than one -eighth pitch, three and three-quarters inches for 16-inch shingles,,fonr and one -quarter inches for 18-inch shingles. Such shingles shall be firmly nailed to the roof deck *ith corrosion resistant nails according to accepted good practice. M6s Unless otherwise specified by law, the Conmercial Standard for Wood Shingles, CS 1 -52 of the U:S. Department of Commerce, Ghall be accepted as means of estab- lishing the grade of shingles. (c) By adopting Appendix A and C of the National Building Code 155 Edition Abbriviated pertaining to the fire prevention code and publications listed thereafter shall be used as a guide for standards, so far as same are not in conflict with the requirements of the Fire Marshall of the State of TExas. (d) By especially adopting the 1957 and 1958 amendments to the National Building Code '55 Edition Abbreviated. In so far as said amendments are not in conflict with requirements of the State Fire Marshall. Section 13. PERMITS. Wherever in this ordinance and code adopted, herein reference is made to construction or building repair, removal, or move into; same shall not be done until the requirements set out in the Permit Ordinance and the amendments thereto, if any, have been complied with. The Building Official or Inspector Or any person or persons having the authority to issue permits shall not do so until they are satisfied with the requirements of the ordinance and same have been met. Section 14. This ordinance shall take effect 30 days after its approval. Jay C. Be it ordained by the City Council of the City of Georgetown, Texas Section 1. Adoptions of Electric Code. That there is hereby adopted by the City of Georgetown, Texas, for the purpose of establishing rules and regulations for the construction,'alteration, removal and maintenance of electric wiring and apparatus, including permits and penalties, that certain electric code known as the National Electric Code Standard of the National Board of Fire Underwriters, being particularly the 1965 Edition thereof and the whole thereof, save and except such portions as are hereby deleted, modified, or amended, of which not less than three (3) copies have been and now are filed in the office of the City Clerk of the City of Georgetown, TExds, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling in the construction, alteration, maintenance or removal of all electric wiring and apparatus within the corporate limits of the
