HomeMy WebLinkAboutORD 69-07 - Amending Zoning Ordinance16 AN ORDINANCE AMENDING THE "ZONING ORDINANCE" PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN ON THE 131h DAY OF OCTO➢ER, 1969, BY RESCINDING SECTIONS 14. 2 AND 14. 3 AND THE SUBSECTION OF SOME OF "PART FOURTEEN: Al2NDMENTS" AND PROVIDING FOR THE AMENDMENT OF SAID ZONING" ORDINANCE BY THE CITY COUNCIL ON ITS OWN MOTION AND BY APPLICATION AND PETITION BY ANY PERSON, FIWII OR CORPORATION BY 19KING APPLICATION TO THE CITY PLANNING AND ZONING COMMISSION; PROVIDING FOR NOTICE OF SUCH MEETINGS THROUGH NhIVSPAPER PUBLICATION AND TI1ROUGH DELIVERY OF CERTIFIED MAID NOTICE AND PROVIDING FOR THE NECESSITY OR A THREE - FOURTHS MAJORITY VOTE OF THE CITY COUNCIL FOR PASSAGE OF ANY SUCH AMEND?d-NT; AMENDING TIC PUELIC NOTICE'REQUIRE- MENT SO AS TO APPLY ONLY TO PROPOSED "USE" CHANGES AND SPECIAL PERMITS; AMENDING SAID ZONING ORDINANCE TO ELIMI- NATE ANY REQUIREWNT OF ANY JOINT MEETINGS OF THE CITY COUNCIL AND THE PLANNING AND -ZONING COMMISSION, AND AMEND_-z ING PART T1,VO, SECTION 2.02, SUBSECTION 2.0203 TO CHArIGE MINIMUM WIDTH OF RESIDENTIAL LOT FROM 65 FEET TO_;•60 FEET AND AREA FROM 7000 SQUARE FEET TO 6000 SQUARE FEET. M BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETO%VN, TEXAS: !ZH OSectionl. "PART FOURTEEN: AMENDIIE TS" Section 14. 2 through Section 14. 3 0► of the zoning ordinance of the City of Georgetown is hereby rescinded, cancelled, set aside and held for nought. In liew of and in substitution for said rescinded U portions of such zoning ordinance it is hereby Ordained by the City Council of the City of Georgetown, Texas, as follows: "PART FOURTEEN: AMENDMENTS" Section 14.2 Application and petition for amendme::t_s_ or changes_ to the Regulations and/or District Map. 14a201c Any person, form or corporation petitioning the City Council for a change in the Regulations or the District Map, shall do so upon forms provided for such purposes by the office of the City Secretary. All petitions or applications for changes in the Regulations or District Map shall be filed with the office of the City Secretary. 14.202 No action to amend, supplement, change, modify or repeal the zoning ordinance of the District Map relative to uses and special permits shall be final until there shall have been a public zoning hearing thereon with public notice of such hearing as herein required. 14.203 Notice of such public zoning hearing on uses and special permits involving any such change in zoning shall be given by publication once in a newspaper of general circulation in the City of Georgetow]}, stating briefly the change or amendment to be considered at the hearing, and the time and place of the City Planning and Zoning Commission hearing, which time shall not be earlier than fifteen (15) days from the date of such publication. In addition to the said newspaper notice, written notice shall be given of the time and place of the hearing of said Planning and Zoning Commission, stating the address of the pro- perty proposed for change or special permit and briefly the change or special permit that is to be considered. Such notice shall be sent to the owners, as determined from the most recently approved City tax roll, of all real property lying within 200 feet of the property on which the change is classification or a Special permit is proposed. Such notice shall be given not less than fifteen (15) days befor the date set for hearing before the City Planning and Zoning Commiss- ion and shall be made by depositing the same, properly addressed and postage paid, in the United States Post Office. 14.204 The public meeting of said City Planning and Zoning Commission shall be had under Rules of order commensurate with proper conduct. No action on any proposed change, amendment or Special Permit shall be taken by the City Planning and Zoning Commission at or during the public zoning hearing. 14.205 The City Planning and Zoning, Commission shall, within ter. (10) days after a public zoning hearing, hold a special meeting to act and recommend upon the changes, amendments or Special Permits considered an such'hearing. This meeting shall not be a public hearing and neither proponents nor opponents to a proposed chancre, amendment or Special Permit shall be heard. The members of the City Planning and Zoning Commission shall vote on each proposed change, amendment or Special Permit as to their recommendations to the City Council for either adoption or denial. The recommendations of the City Planning and Zoning Commission shall be transmitted the office of the City Secretary for the City Council, in writing, within five (5) days following the meeting of the City Planning and Zoning Commission. 166 14.206 After receipt by the City Council of the recommendation of the City Planning and Zoning Commission, the City Council shall at either a regular or special meeting, act a on the proposed changes, amendments or Special Permits. A three -fourths t3/4) majority vote of the City Council shall be -required for passage of a proposed change, amendment or Special Permit. 14.3 The only public notice to be given by newspaper publication is that required in the preceding sections dealing with proposed amendment relative to 'use' and to "special permits". In all other respects, the City Council may amend, change, alter or rescind this Ordinance or any portion here®f in the same manner as its other ordinances. The "Zoning Ordinance" of City of Georgetown is hereby amended so that joint meetings of the City Council and Planning and Zoning Commission shall not be required. In those instances where the Planning and Zoning Commission consider requests for changes, amendments and the like, such Commission shall make its recommendations known to the City Council, but no joint meetings of the City Council and Planning and Zoning Commission shall be required. "PART TWO: DISTRICT'REGULATIONS" ` Section 2.02 R-S Single -Family District Regulations. Subsection 2.0203 (Area Regulations) 2(a) (Size of Lot) of the Zoning Ordinance of the City of Georgetown is amended to read as follows: (a) Lot Area and hot Width. No building shall be erected or moved on to a lot for residential purposes unless sane shall have an area of approximately 6000 square feet and width at building set back line of app- rozimately 60 feet. However, in applying these standards, consideration shall be given to the size of the proposed building in relation to the size of the lot, the neighborhood in question and whether ornot the health and fire safety purposes of this ordinance are being met." Whereas an emergency is apparent for the immediate preservation of order, good government and the general public safety and welfare, this ordinance shall become effective and applicable immediately upon its passage and it is accordingly so ordained.
