BULK STORAGE PLANTS, PRIVATE PLANTS, DEFINING CERTAIN WORDS AND PHRASES USED. HEREIN: PROHIBITING THE REFECTION OR ALTERATION OF ANY FILLING STATION, WHOLESALE OR BULK STORAGE PLANTOR PRIVATE PLANT WITHOUT PENIT THERFOR FROM THE COUNCIL; PRESCRIBING APPLI- CATION FOR SUCH PERMIT AND PROVIDING PROCEDURE AND BASIS FOR CON- SIDERATION OF SUCH APPLICATION, PROVIDING FOR INSPECTION OF FILLING STATIONS AND SUCH PLANTS, PROVIDING FOR REVOCATION OF SUCH PERMITS, REGULATING THE SALE, DELIVERY, AND PURCHASE OF GASOLINE FROM TANK TRUCKS OR PORTABLE TADS, THE BUILDINGS USED IN CONNECTION W1111 ANY FILLING STATION, REGULATING THE USE OF FILLING STATION BUILDING OR PORTION THEREOF FOR SLEEPING FOR LIVING QUARTERS, PROVIDING A PENALTY FOR VILLATION, PROVIDING A SAVING CLAUSE, REPEAU'.NG ALL CONFLICTING ORDIANCES OR PARTS THEREOF AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE GITY OF GEORGETOWNM TEXAS: Section 1. Words and Phrases defined: The following words and phrases used in the Ordinan,,,r shall for the purpose ofthis Ordinance have the meanings respectfully ascribed to them in this Section. (a) Person. Every natural person, firm, co -partnership, association partnership, corporati �r or other entity. (b) Filling Station, Any place where gasoline or other volatile liquid is sold, supplied,; dispensed or offered for sale to the retail motor vehicle trade. (c) Tank Truck. A metal receptacle of more. than sixty (60) gallons capacity, mounted on wheels and ordinarly used for the purpose of transporting gasoline, (d) Portable Tank. A metal receptacle or not more than sixty (60) gallons capacity, moun'.c' on wheels and provided with means for filling.,and withdrawi:Ag liquid and bearing the label the National Board of Fire Underwriters. (e) Wholesale or Bulk Storage Plant_ Any place where gasoline or other volatile liquid i- scored for the purpose of sale to the wholesale trade, or any place where such liquid is:F,: to the wholesale trade; (f) Private Plant, Any gasoline pump or other gasoline despensing equipment used by an r4._ or operator thereof, or by authority of such owner or operators exclusively for motor vei1i owned or operated by such owner or operator and from which no gasoline is Bold, Section 2. Scope of Ordinance Defined. It shall be unlawful for any person, or the ages u representative of any person, to keep, store, handle, or offer for sale, gasoline, or any *they volatile or explosive fuel or liquid, except upon conpliance by such person with the. provisions of this Ordinance. The regulations set forth in this Ordinance shall govern all filling stations, wholesale or balk, storage plants, private plants, tank trucks building- within the corpoaate limits of the City of Georgetown in thesale and delivery of gasoline .0 any other volatile or explosives fuel or liquid. Section 3. Permits and Certification Required. (a) Any person desiring to erect a filling station, or wholesale or bulk storage plant, or private plant, or to erect or alter and building to be used as a filling station or as such a plant, shall first obtain a permit therefor from the City Council; The application for such permit shall be in wtiting, and sahll be signed by the owner or authorized agent, or the peoperty upon which the filling station is to be located __:_. = and shall be accompanied by four (4) like plans (1) the proposed layout of the filling station or cast inclusding the proposed loc�.tton buildings, tanks, pump and .other service .wits, (2 wahetier each proposed a,a_nk or pum_ the label of the Underwriters Laboratories, Inc. (3) arjr propese3 use of the psi dewaEr for driveways, and (4) the proposed method of collecting waste oil a -Aid water and final c ir- centration of same for disposals all in relation to contiguos street and property lip ro (b) In granting or refusing the permit to erect, maintain a filling station , wholeza, c�, or bulk storage plant, or private plant, or to erect or alter any building to be used. �. the purpose of storing ormhandling gasoline or atehr volatile or explosive lic;acid, t.h., 0 A shall take r.nty eorwii era3u i cr 'she plc. : e wil ere sjuell s H.�;' storage plant, or private plant, s proposed to be established its eorr�A;p.i y ". o buildings or residences, the location of public buildings, shcoois, and places o3 resort in relation to the location of such filling station or plant, the &iaract'er azld condition of public traffic on streets immediately contiguous to or within three hundred (300) feet of such proposed filling station or plant, the hazards presented by the use of the sidewalks as a means of ingress and egress to and from such filling station or plant and the question of whether the operatt*n of such filling station or plant might create such odors, noises, nocturnal iAtft illumination or increased traffic, as might be un- reasonably offensive to the inhabitants or occupants of buildings or residences adjacent thereto or withing three hundred (300) feet thereof as measured by the most direct line. (c) If the City Council, after a consideration of the facts is of the opinion that the application for the permit should �e refused, the Council, before taking final action thereon shall first give the applicant an opportunity to be fully and fairly heard on such application Written notices of such hearing shall be given to the applicant at least five (5) days beafe the date of such hearing. (d) Any person desiring to locate, or replace any tank or punp on premises then being used as a filling station, wholesale, or bulk storage plant, or private plant, shall first oba;in a permit threrfor from the City Council of -the City of Georgetown. The applicantion for such permit shall show the location or proposed location of such equipment on the premises and character of such equipment and shall show that each tank or pump to be used bears the labdl of the Underwriters Laboratories, Inc. showing that any such is an Underwriters Laboratories ap orved pump or tank. Ie) After the installation of pipe work connected with any tank or pump to be used for -the handling or storing gasoline at a filling station , Wholesale or bulk storage plant, or private plant, but before the said installation has been covered or concelaed from vicar, the person who was physically in charge of such installation shall notify the City Plumbing Inspector of such facts. It shall be unlawful for any person to cover or conceal.from veiw such installation or cause same to becovered or concealed until the said Inspector has inspected and approved such installation. (f) After the completion of the filling station, wholesale or balk storage plant, or private plant, or the " Anstallation or the location, relocation or replacement of any equipment on premises then being used as a filling station, wholesale or balk storage plant, or private plant, and the inspection and approval thereof, as provided in this Ordinance, and the full compliance by the applicant for the permit with all the pertinent provisions of this Ordinance and all laws and Ordinances pertaining to such matters, the City Council shall issue a Certificate of Operation for such filling station, wholesale or bulk sotrage p1ant; or private plant or such equipment, (g) The permit to operate a filling station, wholesale or bulk storage or private plant, or operate any of teh equipment regulated in this Ordiance, may be revoked by the City Council if it is found by the City Council that the permittee or transferee of such permit has failed and refused to comply with the provisions of this Ordinance and all of the other laws applicable to such operations but the City Council before taking final steps thereon, shall first give the permitee or the transferee an opportunity to be fully and fairly heard and written notice of such hearings must be given the permitee or transferee at least five (5) days before such hearing. Section 4e Sleeping Quarters Regulated, It shall be unlawful to use or allow to be use any room, or part of any building, hereafter to be constructed, altered, fitted, equipped, or furnished'as a living or sleeping quarters, if portion of such building is used at the same time as a filling station, or for the purpose of storing or handling gasoline or other volatile liquids, unless the walls, floors and ceilings separating that portion of the buildings used as a filling station and that portion used as a sleeping or living quarters shall constitute an absolute fire separation, which fire separation shall be composed of floors, and ceilings, unbroken by openings of any description and of thickness sufficient to prevent any escape of gas through same, Section 5. Storage tanks and pumps regulated. Only underground tanks shall be used for the storage of gasoline at filling stations, and the said tanks and applica"nces shall be placed entirely within the property lines of the premises. Section 5A. That no trtack hauling gasoline. that has a carrying capacity of over ' 100 gallons, shall hereafter be permitted to deliver gasoline, therefrom to any filling 3taticm, private plant, or to any tank used by any filling station or private plant distributing gasoline therefrom within said City. That each track used for, or by which gasoline or other volatile or vxplosive liquids are transported, or are delivered, withia said City, shall carry gasoline, or other volatile or other explosives liquids, in a tank thereon suitable for such purpose; and that such tanks shall be made of not less than twelve gauge galvamise steel; or at beast ona-fourth inch black open hearth tank steel; and that such t€u1k shall Aye equipped with outlet faucets of theantidrip approved selfclosing type, and also must ',e equipped with automatic check valves for safety in the went of mechanical injury to vile outlet faucet, and said tank and equipment shall have been approved by and shall bean the label of approval of the National Board of Fire Underwriters. (Section 5 and 5A being ammaded as printed above on the 14th day of April, 1960.) Section 7. Section 13, Underwriters Laboratories Inc. Label Prescribed. All tanks and pumps installed shall bear the labels of the Underwriters Laboratories Inc. for such use, &-ad shail be conetructed and installed in compliance with the regulations of the Wational Eoard. of Fire Underwriters governing such construction and installation; and all such tank-2 , pups;, piping and eqnIpment shall be inspected and approved by the Plumbing Inopector and the Fins, Marshall b�Iore being pit into service. Section 14. Tank Track and Portable Tank Sales Regulated.
