HomeMy WebLinkAboutORD 72-13 - Setting Telephone Rates292 AN ORDINANCE REGULATING AND PRESCRIBING THE RATES OF THE GENERAL TELEPHONE COMPANY OF THE SOUTHWEST: AND PROVIDING FOR THE EFFECTIVE DATE OF THESE RATES. WHEREAS, the General Telephone Company of the Southwest has filed an Application with the City Council of the City of Georgetown to be charged to users of local exchange telephone service, and the City Council after duly considering said Application, making an investigation, study, and giving the Company a Hearing, is of the opinion that the rates prescribed in this Ordin- ance will yield a fair rate of return to the company on the property actually used for rendering service to the public; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGE- TOWN: Section 1. That the General Telephone Company of the Southwest is hereby authorized to place in effect as of the 19th day of October A.D., 1972, the following schedule of rates: CLASS OF SERVICE MONTHLY RATE One Party Business - Flat Rate $10.50 Two Party Business - Flat Rate 8.50 Multi Party Business, Rural - Flat Rate 10.50 Business Extension - Flat Rate 1.85 Semi Public Coin Station 10.50 (a) One Party Residence - Flat Rate 5.85 Two Party Residence - Flat Rate 4.80 Four Party Residence - Flat Rate 3.75 Multi Party Residence, Rural - Flat Rate 6.50 Residence Extension - Flat Rate 1.25 293 The rate for PBX trunks is 150% of the Business One Party Flat Rate. ($15.75) The rate for PBX Stations is equal to the rate for Business Flat Rate Exten- sion Stations. 41.00) NOTE: (a) local messages, 100 each, proprietor's daily guarantee is 340. ` Section 2. That these rates shall become effective at 12:01 A.M. on the 19th day of October A.D., 1972. Section 3. That the rates prescribed in the Ordinance No. Bk. 1, P. 292 of July 8, 1963, are hereby rescinded and set aside as of the effective date of the rates prescribed in this Ordinance. Section 4. That the General Telephone Company of the Southwest shall file, within ten (10) days from the passage of this Ordinance, an unqualified acceptance of the terms and provisions of this Rate Ordinance, and the failure to promptly accept the terms hereof within the specified time, or an attempted acceptance under protest, or with qualifications, shall render this Ordinance void, and the rates fixed by Ordinance Bk. No. 1, P. 292 shall continue in effect. Should the General Telephone Company of the Southwest fail, within the reasonable time, to provide additional telephone facilities so that all who desire service of whatever grade or character, then in that event the City Council reserves the right O to give reasonable notice to the General Telephone Company of the Southwest to show cause why the rates provided for in this Ordinance should not be revoked and the rates provided in.Ordinance Bk. 1, P. 292 should not be reinstated. Section 5. That nothing in this Ordinance shall be construed as in any manner limiting modifying, or abrogating the right and power of the City Council, under the Charter of the City of Georgetown, the constitution and laws of the state and of the United States to regulate the rates charged by the General Telephone Company of the Southwest for local exchange telephone service within the City of Georgetown. This Ordinance relates to the immediate preservation of the public peace, hea- lth, safety and welfare of the Citizens of the City of Georgetown and therefore constitutes an emergency and is to take effect on the first --reading and the nature of the emergency being the preservation and maintenance of continuous telephone service. The rates reflected in the foregoing Ordinance shall be effective beginning the 19th day of October, 1972. PASSED AND APPROVED this the 25th day of September, A.D. 1972. ATTEST: City Secretary
